MAY 16. 2oii: The Grant County Commissioners session began at 8:go a.m. with Commissioners Swartz an d Carter in attendance with the Clerk of the Board. Commissioner Stevens was out in the a.m. only and excused. 8:go a.m. — 8:5o a.m. 9:0o a.m. — g:5o a.m. Elected Official Roundtable Discussion Striclder, ASC Update/Misc. BOCC Action A motion was made by Commissioner Carter, seconded by Commissioner Swartz, to approve items i through 6 on the ASC Agenda as presented below. The motion passed with 2 Commissioners in attendance. 10:0o a.m. — io:i5 a.m. io:go a.m. — io:45 a.m. 1. Possible vouchers for Interfund Communications, insurance, and/or grant administration. (Approved) 2. Geographic Information Interlocal Agreement between Grant County and the Washington State Department of Ecology for access to bi- monthly/monthly updates of spatial and tabular data as maintained by the County uia on-line ftp site or quarterly updates of spatial and tabular data as maintained by the County uia CD/ROM or DVD. Term is April 6, 2oi1 to December 3i, 2o1i. (Approved) 3. Amendment A to Washington State Department of Commerce Community Services and Housing Division, Office of Crime Victims Advocacy, Grant No. F�o-31103-015, FF'Y 2oio STOP Violence against Women Formula Grant Program. Amendment extends the grant period and increases the Budget and matching funds. (Approved) 4. Special Counsel Contract between Grant County and Evans, Craven & Lackie, P.S. to perform and render legal assistance and advice, and to conduct discovery, relative to the case commonly known as Ochoa Ag Unlimited Foods, Inc., d/b/a Ochoa Foods, and Idaho Corporation; OB-i LLC, a Washington LLC, v. Grant County, Superior Court Cause No. 07-2-00788-8. (Approved) 5. Domestic Violence Legal Advocacy Grant Program funding application between Grant County, New Hope Domestic Violence and Sexual Assault Services, and the Department of Commerce in the amount of $24,00o to provide legal advocacy to victims of domestic violence. Contract for July i, 2o11-June go, 2oi2. (Approved) 6. Agreement for Independent Contractor Services between Grant County, PARC, and llr. David Scratchley for training service on May 1�, 2o1i. (Approved) Commissioners Office Safety Meeting Citizen PubXic Comment Period Micic Hansen discussed his desire to have Fairway Drive in Moses Lake, added to the Golf Cart Zone in Grant County. He brought in a new description of the area he would like to see added. All roads are currently 25mph. If the Commissioners approve this area, he will bring his proposal to the City of Mases Lake for consideration as they own part of Fairway Drive. Discussion was held about how some of the ditches were filled in along Fairway Drive, and that the Public Worlcs Director stated this needs to be removed. Those ditches are a requirement of the County. COMMISSIONERS' MAY i6, 2oix MINUTES Page 2 of 6 Mr, Hansen stated he delivered sand to the area and dropped it off for the residents to fill in. He was not compensated for this. He stated that the Golf Cart Zone and ditches being filled in are not connected. Commissioner Swartz stated that she believed Mr. Hansen would need 51% of the residents in favor of the Golf Cart Zone on Fairway Drive. The Commissioners will discuss this issue with Derele Pohle, Public Worlcs Director on how many residents will need to sign the petition. The Board will also give the area description to the Assessor's Office to get how many residents are in the area. A copy of the passed Ordinance was given to Mr. Hansen so he would lenow the requirements. Discussion was held again on the ditches. Mr. Hansen is upset that AHO Homes dug ditches instead of putting in curbing and sidewalles. He stated the County gave AHO the option and the citizens are upset over this. The citizens filled in County Right of Way when they should not have. Commissioner Swartz will discuss this issue with Derelc Pohle at his May 1�, 2011 meeting. 11:0o a.m. — i1:go a.m. i2:oo p.m. —1:0o p.m. 1:3o p.m. — i:5o p.m. C Carter at Health District Audit Exit Interview (Health District Ephrata Office) PUD Luncheon (Tequila's Restaurant) Open Record Public Hearing, Douglas T. Boyden et al Application for Classification as Open Space Land for Current Use Assessment under Ch. 84•34 RCW The Commissioners held an Open Record Public Hearing to consider an application from Douglas T. Boyden et al regarding an application for Classification as Open Space Land for Current Use Assessment under Chapter 84•34 RCW. Property is located at Highway 283 and the Winchester Wasteway, in the NE quarter of S gg, T 20, R 25 (Parcel no.15-1952-00� Tax �8336). Laure Grammer, Assessor, discussed the application. On February 18, 2009, this application was presented to the Commissioners along with the Assessor recommended for denial of the application. The current application also came with a letter of denial but the Assessor would now lilce to change this recommendation. She was able to speak with the property owners today regarding their application and now understands their situation. The Assessor now recommends approval. Discussion ensued. Peter Chance, one of the property owners, discussed the application. They put signs up stating there was a charge for hunting on their property to discourage people from hunting on their property. They are concerned about it being a liability issue. Commissioner Carter recommended they speale to the NRCS for signage to detour hunters. Mr. Chance stated they are interested in possibly selling the property �o the County. Commissioner Stevens stated we do not buy property like this but he could contact Fish and Wildlife or ask NRCS. Commissioner Carter moved �o close the public comment portion of the hearing. Comrnissioner Stevens seconded and the motion passed unanimously. Commissioner Stevens moved approve the revised recommendation of the County Assessor and approve the application as presented. Commissioner Carter seconded and the motion passed unanimously. COMMISSIONERS' MAY 16, 2011 MINUTES Page g of 6 TUESDAY, MAY i7, 2o1i: The session was continued at 9: oo am with all the Commissioners in attendance with the Clerlc of the Board. 9:3o a.m. — 9:5o a.m. 10:0o a.m. — io:3o a.m io:3o a.m. — io:5o a.m J Janke, Noxious Weed Board Assessment Discussion Performance Review Open Record Public Hearing, Application for Community Developinent Block Grant No. ii-6q lo00-002 The Commissioners held an Open Record Public Hearing to review community development and housing needs, inform citizens of the availability of funds and eligible uses of the state Community Development Blocic Grant (CDBG) funds, and receive commends on proposed activities, particularly from low and moderate income persons and persons residing in the Grant, Adams, and Lincoln County areas. $76,�22.0o will be available to Opportunities Industrialization Center of Washington (OIC of WA) to fund public service activities that principally benefit low and moderate income persons. This hearing is to also close out 2oio CDBG grant io-64ioo-oo2. June Strickler, Administrative Services Coordinator, discussed the proposed and notified the Commissioners that all hand outs are available in English and Spanish and that a Spanish interpreter is here to assist if necessary. Available handouts: (1) Community Development Block Grant Program description, (2) Federal Regulations 24 CFR 5�0.486(a), (g) Public Participation Plan (PPP), and a(4) Grant County's adopted CDBG Grievance Procedure form (an attachment to the PPP). Ms. Strickler has a resolution for signature with certifications of compliance for CDBG public services grant only. Commissioner Carter moved to close the public comment portion of the hearing. Commissioner Stevens seconded and the motion passed unanimously. Commissioner Carter moved to approve the closeout of the 2oio Grant and approve the implementation of the 2oir Grant. (Approved) Open Record Public Hearing, Port of Royal Slope Franchise Application Hearing The Commissioners held an Open Record Public Hearing to consider a franchise application from the Port of Royal Slope to enter upon, construct, operate, and maintain a water line under, across and along Road E-SW and run water line along the north side of Rd i3.6 SW in a portion of S 8, T 16, R 26 W.M. Derelc Pohle, Director and Engineer, Public Works stated that their department recommends approval. Commissioner Carter moved to close the public comment portion of the hearing. Commissioner Swartz seconded and �he motion passed with 2 Commissioners in attendance. Commissioner Carter moved to approve the franchise application as presented and to sign the Order Granting Franchise.
