HomeMy WebLinkAboutOrdinance 15-061-CC F �OARD-O��OUNTY�OMMIS�IONERS - ' Grant County, Washington ORDINANCE NO. 15- ��, -CC AN ORDINANCE CREATING AND ADDING CHAPTER 3.80 TO THE GRANT COUNTY CODE AUTHORIZING AND ESTABLISHING A DEDICATED FUND FOR THE OPERATION AND ADMINISTRATION O� THE INTERAGENCY NARCOTICS ENFORCEMENT TEAM. RECITALS: WHEREAS, the sale and use of illegal controlled substances has serious and adverse effects on the quality of life of the citizens of Grant County; and WHEREAS, the Interagency Narcotics Enforcement Team (INET) was established to target mid to upper level drug violators, reducing drug availability and trafficking, thereby improving the quality of life in the County; and WHEREAS, the operating costs of drug interdiction often exceed budgeted funds and grant moneys; and WHEREAS, based on the recommendation of the Sheriff and the Prosecutor, the Board of County Commissioners has found and determined that it is appropriate to authorize and establish a dedicated fund for INET Operations funded by negotiated contributions of low level adult drug offenders at case adjudication; and NOW, THEREFORE, BE IT HEREBY ORDAINED by the Board af County Commissioners of Granfi County, State of Washington, that chapter 3.8p be created and, that pursuant to this ordinance is hereby enacted and shall be added to the Grant County Code, as follows: Chapter 3.$0 - INTERAGENCY NARCOTIC� �NFORCEMENT TEAM (INET) DRUGFUND Sections: 3.80.010 Interagency Narcotics Enforcement Team drug fund established. 3.$0,020 Definitions. 3.80,030 Administration of the fund. '3.80.040 Sources of moneys for fund. 3.80.050 Disbursements from fund—Use of moneys. 3.80.060 Disbursements from fund—Accounting, liability. 3.80.070 Limitations on fund—Redeposit. The Grant County Auditor shall create separate and distinct from the general fund of the county, a special fund to be known as the Interagency Narcotics Enforcement Team (INET) drug fund. 3.80.020 Definitions. All terms used in this chapter shall, in addition to their ordinary meaning, also be defined according to common law and any state statute or county ordinance. 3.80.Q30 Administration o#the fund. The fund established by this chapter shall be administered by the Grant County Sheriff's Department according to sound accounting and principles consistent with all applicable laws, rules, regulations and orders, consistent with the purpose of this chapter, and in accordance with RCW 10.01.220. 3.80.040 Sources of moneys for fund. The fund established by this chapter shall consist of the following: A. All contributions ordered paid by the superior or district courts. Contributions into the fund shall be an amount negotiated between the Prosecuting Attorney and Defense Counsel on a case by case basis for low level adult drug offenders. The defendant's financial situation, along with present and future ability to pay, shall be considered when negatiating a contribution. Amounts considered shall range from $100 to $10,000. B. Moneys budgeted for such fund; and C. Federal and state grant funds acquired by the county to support enforcement and prevention of drug related crimes and substance abuse. 3.80.050 Disbursements from fund—Use of moneys. The Grant County Sheriff or his designee may authorize disbursements from the fund created by this chapter only for purposes of enforcing state statutes and county ordinances for the administration and/or operation of the INET. The Sheriff may also authorize disbursements to support drug enforcement and prevention efforts that align with state and federal grant requirements and are coordinated with specific revenue received and budgeted. 3.80.060 Disbursements from fund—Accounting, liability. All disbursements from said fund shall be approved by signature of the Sheriff, or his designee.
