IN THE MATTER OF AMENDING THE
LEGAL DESCRIPTION OF THE
JURISDICTIONAL TRANSFER OF A
CERTAIN ROAD RIGHT-OF-WAY TO
ELCECTRIC CITY, RESOLUTION 08-
107-CC DATED 9TH of DECEMBER,
2008.
WHEI2EAS, in accordance with RCW 39.33.010, Grant County, a political subdivision
of the State of Washington, acting through it's Board of County Commissioners, did transfer
jurisdiction of a certain portion of Right-of Way to the City of Electric City, Resolution No. 08-
107-CC, AND
WHEREAS, Electric City and The Grant County Public Works Department subsequently
did find the legal description to be inaccurate, the original tax record for the property was
deleted, and the legal description of the Quit Claim AFN 504317 is no longer an accurate
description, AND
WHEREAS, the LEGAL DESCRIPTION in Resolution 08-107-CC should be
AMENDED to read as follows AND as shown in Exhibit AAND as described in Exhibit B:
LEGAL DESCRIPTIOI�1:
A PORTION OF THE SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER OF THE SOUTHEAST
QUARTER OF SECTION 9, TOWNSHIP 28 NORTH, RANGE 30 E.W,M., OF ELCECTRIC CITY 1STADD
(UNRECORDED), KNOWN AS PARCEL NUMBER 10381000, FROM THE ORIGINAL TAX RECORD 4902, O.K.A.
SANDY LANE.
WHEIaEAS, Grant County Public Worlcs and the City of Electric City have previously
agreed to worlc towards the transfer of jurisdiction of said Right-of-Way, and
WEIEREAS, the County �;ngineer recommends the Grant County Board of
Commissioners proceed with the j��risdiction transfer as muivally agreed, per RCV4j 39.33.010,
AND
1�UW, THEIZEFOIZE BE IT �IEREBIT RE�()LVED, that the Grant County Board oE
Commissioners transfer jurisdiction c�f a portian af Road Right-oF V�ay to the City af Eleciric
City, as amended, to becom� effective when The City of Electric City executes notice of
accepting jurisdiction af said road right-o�=way.
