GI2ANT COUNTY, WA It�solaUz Torr No. Q9- Q� �-CC ft�AsoNAB�,� Usr Exc�r'r1o�v For Vasyl Nakoz�echnyy WHEREAS, the Baard of County Commissioners ofiGrant County has been advised by the Grant County Planning Commission that an open record public hear�r�g was conducted on May 6, 2QQ9, an the matter o� granting a Reasonable Use Exception to Vasyl Nakonec�inyy to allow the residential develop�nent af a 1.05-acre parcel in the Rural Residential3 Zone of Grant County. I"he subject parcel (#�11-Q693-QO1) is located zn a portion of Section 11, "Township 1� North, and Kange 28 East, Willamette Meridian, Grant County, Washington; and WHEREAS, the Grant Caunty Planning Commission on May 6, 2009 �n�de a recolnmendation to the Board o�' County Camzllissianers to apprave ttlis proposed Reasonable Use Exception; and, WIIGREAS, the Grant County Board of Commissioners held a closed record public hea�ing regarding this Inatter on June 2, 2009; and WI�EREAS, thc Ba�rd of Coutlty Colnmissioners has Inade a dccision to u�hold the recan�znendation to appt�ove the proposed Reasonable Use Exceptian; and WHEREf1S, the Board of County Coz�lmissioners has found that tl�e proposal is consistei�t with the Crant Cou�zty Col��prehe�lsive Plan; and WHEREAS, the Board of County Co�lm�issioners has found that the public use and interest wi11 be served by tl�e Reasonable Use Exception; anc� WH�REAS, the Boax•d of County Calnmissianers has faund that the pro��osal wil l not adversely aflect the health, safety, and general welf�re c�f the public in the vicinity of the proposal. WHERE�S, the Board of Coutlty Coz�nz�issioners has found thaC the a�plicatia�l of UDC chapter 23.04 Zozaing Districts wol�ld deny all economically vi�blc a� beneficial uses c�f tl�e IteasouabJe Use ��eeption (09-5265} - 1_ Vasyl Nako�ieelu7yy property, absent a demonstration by the county that the proposed use(s) are prohibited by the laws of nuisance or other pre-existing limits on the property which prohibit such use(s). WHEREAS, the Board of County Commissioners has found that there are not other reasonable uses to which the property can be put. WHEREAS, the Board of County Commissioners has found that the inability of the applicant to derive reasonable use of the property is not the result of actions by the applicant in subdividing or adjusting a boundary line thereby creating the un-developable condition after the effective date of this chapter. WHEREAS, the Board of County Coinmissioners has found that the exception being sought is the minimuin necessary to allow for reasonable uses of the property. CONDITIONS OF APPROVAL: 1. The proponent shall comply with the requirements of Grant County Public Worlcs, including but not limited to: a. An Approach Permit shall be obtained prior to a building permit NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution and subject to conditions, a lZ�asonable Use Exception granted to Vasyl Nakone�hnyy to allow the resiclential development of a 1.05 acre parcel, #11-0693-001, in the Rural Residential 1 Zone located in a portion of Section 2, Township 21 North, Range 22 East, Willamette Meridian, Grant County, Washington, EFFECTIVE DATE: Upon signature DATED this �� day of June, 2009.
