J STRICKLER. ASC UPDATE AND MISC. BOCC ACTION The Commissioners approved and signed items i-8 as listed above. CLO�ED RECORD PUBLIC HEARING,DEWEY AND SARBARA ROGERS (DEWEY LONG PLAT The Commissioners held a Closed Record Public Hearing regarding a Preliminary Plat application from Dewey and Barbara Rogers to create i4lots from a �6.21 acre parcel in the Rural Residential � Zone of Grant County. The subject area is approx. � miles west of Ephrata, near the intersection of State Hwy 283 and Rd io.2-NW and is in a portion of the SE quarter of S i2, T 2o N, R 26 E, W M(Parcel no. 15-�8gi- 000). Commissioner Stevens moved to uphold the Planning Commission unanimous recornmendation and approve the application as presented, recognizing the 6 Conditions of Approval (with modifications to approval # 1 and 4 as stated by the Planning Commission) and io Findings of Fact. Commissioner Swartz seconded and the motion passed unanimously. The hearing adjourned. CONSENT AGENDA AND COMMI�SIONERS WORK SESSION The Commissioners approved and signed items i through 5. A public hearing was set for the budget extensions for March 1�, 2009 at io:go a.m. Commissioner Stevens moved to approve the Consent Agenda, Commissioner Swartz seconded and the motion passed with all the Commissioners in attendance, as presented below: COMMISSIONERS' OFFICE: Cornmissioners Office Vouchers Memorandum of Agreement between Grant County and the Public Employees Association (Courthouse, Juvenile, and Public Works) to extend the current Working Agreement for a one- year term for the period January i, 2009 to December 3i, 2009. This extension is agreed to on the basis that there will be no increases in any compensation and benefits for 2009. Special Occasion license application for the Moses Lake J.E.T.S. Personnel Action Request Recommendation to initiate the County sick leave donation policy for a Grant Mental Healthcare employee, Recipient o9-oi, who suffers from an illness which is extraordinary in nature. J MOSERG, EXECUTIVE SE�SION REGARDING WHISTLEBLOWER ACT LITIGATION Pursuant to RCW 42.30.110 (i)(i), Commissioner Carter called the session to order at i:go p.m, to go until 1:go p.m. Commissioner Carter closed the session at �:3o p.m. OPEN RECORD PUBIC HEARING, PROPOSED CHANGES TO SECTION 24 06 OF THE ITNIFIED DEVELOPMENT CODE (UDC) "FLOOD DAMAGE PREVENTION" The Commissioners held an Open Record Public Hearing regarding a proposed amendment to Ch 24.i6 "Flood Damage Prevention" of the Unified Development Code (UDC). Grant County, as a jurisdiction required to fully plan under the Growth Management Act, is required to provide for protection of critical areas. Flood prone areas by statute are one of the critical areas that must be protected. These flood prone areas within the County are identified by the Federal Emergency Management Agency (FEMA) and the development within these areas, although outlined in the Grant County UDC are regulated by state and federal agencies, specifically Washington State Department of Ecology (DOE) and FEMA. These agencies provide the County with the necessary mapping to identify where these flood prone areas are; these maps are called Flood Insurance Rate Maps (FIRMs).When Grant County planning staff is reviewing building permits and land use applications, they are required to verify whether or not the site subject to that action is located in a flood prone area, and if so, the applicant will be required to design the project such that it complies with the standards set forth by FEMA and DOE, and as adopted generally by reference in the UDC. FEMA and DOE have issued new FIRMS for Grant County, and these rnaps will be effective February i8, 2009. In order for our Flood Damage Prevention portion of the UDC to be consistent with state and federal statutes, Grant County must make these minor changes to that code section to reflect the new maps that have recently been issued and clarify a few minor points in the code as well. The changes were provided by DOE as the minimum required changes to malce our ordinance consistent with the new maps and changes in state and federal statues. It should be noted that our standards are not changing, nor is our process for how projects are reviewed as a result of this amendment. Commissioner Stevens moved to close the public comment portion of the hearing. Commissioner Swartz seconded and the motion passed unanimously. Commissioner Stevens moved to uphold the Planning Commission unanimous recommendation and approve this application as presented recognizing the 5 Findings of Fact. Commissioner Swartz seconded and the motion passed unanimously. The hearing adjourned. (Ordinance No. o9-oi3-CC) OPEN RECORD PUBIC HEARING. DOUGLAS T. BOYDEN ET AL OPEN SPACE APPLICATION The Commissioners held an Open Record Public Hearing in regards to an application from Douglas T. Boyden et al for Classification or Reclassification as Open Space Land or Timber Land for Current Use Assessment under Ch. 84•34 RCW. Assessor's Office does not recommend approval of this application because it is not open to the public. Its intended usage is a ducic hunting area for a club. Commissioner Swartz moved to close the public comment portion of the hearing. Commissioner Carter seconded and the motion passed with 2 Commissioners in attendance. Commissioner Swartz moved to deny this application and not change the classification to open space. Commissioner Carter seconded and the motion passed with 2 Commissioners in attendance. ANTHONY AND DEBRA SCHNEIDER OPEN SIDACE APPLICATION The Commissioners held an Open Record Public Hearing in regards to an application from Douglas T. Boyden et al for Classification or Reclassification as Open Space Land or Timber Land for Current Use Assessment under Ch. 84•34 RCW. Staff has determined that only �.94 acres should be set as open space, not the io.�o acres requested in the application. Commissioner Swartz moved to close the public comment portion of the hearing. Commissioner Carter seconded and the motion passed with 2 Commissioners in attendance. Commissioner Swartz moved to approve this application as amended by the Assessor's office and moving 7•94 acres into the Open Space Zone. Comrnissioner Carter seconded and the motion passed with 2 Commissioners in attendance. The hearing adjourned.
