HomeMy WebLinkAboutResolution 09-006-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington — IN—T-HE—MAT-T-ER OF—APPROVING A— — PRELIMINARY PLAT OF 36.03 ACRES INTO SEVEN (7) LOTS FOR TONY REYES LOCATED IN THE NE'/4 OF THE SW i/a OF SECTI01�126, TOWNSHIP 21 NORTH, RANGE 24 EAST, WM, GRANT COUNTY, WASHINGTON � RESOLUTION NO. 09- �� Y� -CC � � APPROVING A PRELIMINARY PLAT � � TONY REYES LONG PLAT � WI3EI�EAS, the Board of County Commissioners of Grant County have been advised that an open record public hearing was conducted before the Grant County Planning Commission on December 3, 2008 in the matter of a Preliminary Plat of 36.03 acres into seven (7) lots,located in a portion of Section 26, Township 21 North, Range 24 East, Willamette Meridian, Grant County, Washington, and WHEREAS, the Board of County Commissioners held a closed record public hearing regarding this matter on January , 2009, and WHEREAS, the Board of County Commissioners has reviewed the application material, staff report, and a summary of the Planning Commission hearing, and WHEREAS, the Board of County Commissioners have found that this proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal, and WHEI2EAS, the Board of County Commissioners have found this proposal to be consistent with the Grant County Comprehensive Plan, the Unified Development Code Chapter 23.04 "Zoning," other land use regulations, and SEPA, and WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be seived by the proposed Preliminary Plat, and WHEREAS, the proposed Preliminary Plat, subject to the Conditions of Approval, meets the applicable requirements of the Unified Development Code Chapter 22.04 "Land Division," and WHEREAS, the proposed Preliminary Plat does comply with the Health District's requirements for sewage disposal and potable water supply, and WHEREAS, the proposed Preliminary Plat does contain an accurate legal description of the lots being created, and the roads and easements therein, and WHEREAS, tihe proposed Preliminary Plat does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements, and WI3�REAS, the Board of County Commissioners has found that "best available science" has been considered in the final decision regarding the proposed subdivision, and WHEI�AS, the Board of County Commissioners has found that all road improvement requirements are ensured pursuant to Grant County Code § 22.04.450, and IN THE MATTER OF APPROVING A PRELIMINARY TONY REYES LONG PLAT PLAT OF 36.03 ACR�S INTO SEVEN (7) LOTS FOR THE TONY REYES LONG PLAT WHEREAS, the Board of County Commissioners has found that the proposed subdivision does appropriately identify and protect critical areas pursuant to Grant County Code § 24.08, and WHEREAS, the Board of County Commissioners have made a decision to approve the Tony Reyes Long Plat; NOW, THEREFORE, BE IT RESOLVED THAT the Board of County Commissioners of Grant County, Washington hereby approve by this Resolution, subject to the Conditions of Approval listed below, a Preliminary Plat of 36.03 acres into seven (7) lots located in a portion of Section 26, Township 21 North, Range 24 East, Willamette Meridian, Grant County, Washington (Parcel #15-1223-001). CONDITIONS OF APPROVAL 1) Proposal shall comply with all requirements deemed necessary by the Grant County Health District, by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On-Site Sewage Systems. 2) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found, all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 3) Approval of the plat shall be contingent upon conformance with all applicable land use rules and ragulations in effect at the time the application was technically complete, which in this . instance was September 16, 2008. 4) During road grading and/or construction activities, county roads shall be maintained clear of soil and rocics during the points of ingress and egress. 5) This proposal shall comply with the requirements of GCC 23.12.080 Clearing, Grading, and Drainage Standards including, but not limited to: a) Clearing and grading activities shall be conducted so as to minimize potential adverse effects on offsite property. b) All development shall ensure that soil erosion and sedimentation of drainage- ways will be controlled to prevent damage to adjoining properties. c) Surface drainage shall not be directed to or discharged onto County Roads or ditches within County right-of-ways unless approved by the County Engineer.including but not limited to: a) Road names shall be approved by the Grant County Emergency Services Department and shall be established using the addressing and grid system delineated in GCC 10.36. Tony Reyes Preliminary Plat - BoCC Resolution - page 2 IN THE MATTER OF APPROVING A PRELIMINARY TONY REYES LONG PLAT PLAT OF 36.03 ACRES WTO SEVEN (7) LOTS FOR THE TONY REYES LONG PLAT 6) Development shall comply with the requirements of the Grant Count� Assessor's office. _ 7)_ Development �hall compl_y_with_all_r_equirements_of_the_Grant_County_Auditor's-office 8) Development shall comply with all requirements oi the Grant County Public Works Department including, but not limited to: a) Provide a plat check fee of $200.00 for Major plats. b) Scale should be a minimum of 1" = 100'. c) Provide vicinity maps with all local access roads. d) Provide a plat certificate from the title company for all land being dedicated to Grant County. e) An approach shall be obtained prior to a building permit. � Label all Right-of-Way dimensions or malce notation (label the interior plat roads as being public or private on the face of the Plat). g) Grant County shall not recognize nor be encumbered by any wellhead protective zone located in the County Right-of-Way. 9) Development shall comply with all requirements of the Grant County Health District, including, but not limited to: A site registration has been completed for each lot that does not have a residence. Based on this information, it is apparent that each lot has an area which is suitable for a septic system. 10) Development shall comply with all requirements of the Grant County Planning Department including, but not limited to: a) Comply with all requirements listed in UDC Chapter 22.04 Article V Final Subdivisions And Short Subdivisions. b) Comply with all requirements listed in the SEPA Mitigated Determination of Non- Significance issued by Grant County. c) Development shall comply with all requirements of the March 5, 2008 Habitat Manage- ment Plan as identified in the Mitigated Determination of Non- Significance. 11 Development shall comply with all requirements of the Grant County Building and Fire Marshal, including but not limited to: a) All real development shall comply with all applicable local, state and federal codes. 12) Development shall comply with all requirements of the Grant County PUD, including, but not limited to: In the case of private roads, the utility easement note should include a statement placing the easement along the outside of the road instead of along the lot lines located down the middle of the private road, or show the easement as such on the face of the plat. As it is drawin on the Tony Reyes Preliminary plat, the utility easement would actually use the middle 20 feet of the private road between Lot 1 and Lot 2. In the case of the road along the south side of Lot 3, the utility easement would lay in the outer 10 feet of the road. Please have the plat changed to show PUE's located outside the road right of way. Tony Reyes Preliminary Plat - BoCC Resolution - page 3 IN THE MATTER OI' APPROVING A PRELIMINARY TONY REYES LONG PLAT PLAT OF' 36.03 ACRES INTO SEVEN (7) LOTS FOR THE TONY REYES LONG PLAT FINDINGS OF FACT (1) The proposed subdivision does / does not meet the applicable requirements of UDC Chapter 22.04 "Subdivisions and Plats"; (2) The proposed subdivision does / does not serve the public use and interest; (3) The proposed subdivision does / does not comply with the Comprehensive Plan, the Sho�eline Master Program, the zoning code and other land use regulations, and SEPA; (4) The proposed subdivision does / does not comply with health requirements for sewage disposal and potable water supply; (5) The proposed subdivision does / does not contain an accurate legal description of the lots being created, and the roads and easements therein; (6) The proposed subdivision does / does not comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; (7) The best available science has / has not been considered in the final decision regarding the preliminary plat. � (8) The proposed subdivision does/does not comply with all requirements of the United States Dept. of the Interior, the Bureau of Reclamation, and/or a recognized Irrigation District when the proposed preliminary plat is within the boundaries of an Irrigation District. (9) The proposed subdivision does/does not appropriately identify and protect critical areas pursuant to GCC, Chapter 24.08.
