HomeMy WebLinkAboutResolution 08-064-CC1 GRANT COUNTY BOARD OF COMMISSIONERS Grant County, Washington ORDINANCE NO. 08- ��� -CC RESOLUTION NO. 08- p(� -CC AN ORDINANCE/RESOLUTION REPEALING ORDINANCE/ RESOLUTION NO. 07-161-CC, AMENDING CHAPTER 11.32 OF THE GRANT COUNTY CODE BY ADDING A PORTION OF CRESCENT BAR ROAD TO THE "NO PARKING" LIST OF ROADS ON WHICH PARKING IS RESTRICTED, AND OTHER MATTERS PROPERLY RELATING THERETO. RECITALS: WHEREAS, the Crescent Bar area has undergone rapid development and population growth, acquiring a higher urban-type density than is normal in rural settings; and i�'�IEREAS, increased growth and usage of vehicles in the Crescent Bar area has resulted in traffic congestion, necessitating the restriction of vehicles in specified areas; and WHEREAS, the Grant County Road Engineer has determined that a safety concern exists caused by vehicles stopping, standing and parking on Crescent Bar Road; and WHEREAS, the Board of County Commissioners desires to protect the safety, health and welfare of those persons utilizing Crescent Bar Road, by prohibiting stopping, standing and parlcing of vehicles on Crescent Bar Road; and WHEREAS, RCW 46.61.570 empowers the legislative authority of a county to authorize placement of official signs prohibiting parking on county roadways; and WHEREAS, the Board of County Commissioners adopted Ordinance/Resolution No. 07- 161-CC, prohibiting stopping, standing and parlcing of vehicles on Crescent Bar Road. A procedural defect requires the Board of County Commissioners to ratify its decision regarding same. NOW, THEItEFORE, THE BOARD OF COMMISSIONERS OF GRANT COUNTY, STATE OF WASHINGTON, DO HEREBY ORDAIN AND ESTABLISH, THAT CHAPTER 11.32 GCC BE AMENDED BY ADDING A NEW SUBSECTION TO SECTION .010(2.). ORDINANCE AMENDING CHAPTER 11.32 GCC Page - 1 Y:\Civil\8\M-R\Ordinances\2008\No Parking Section 1: Grant County Ordinance/Resolution No. 07-161-CC, adopted by the Board of County Commissioners on November 20, 2007, is hereby repealed in its entirety. Section 2: Grant County Code Chapter 11.32.010(2.), adopted by Ordinance/Resolution No. 99-71-CC on May 10, 1999, is amended by adding a new subsection to read: 11.32.010 De�nitions. For the purpose of this chapter, the following words and phrases used herein shall have the designated meaning unless a different meaning is expressly provided: (1). "Vehicle" includes every device capable of being moved upon a public highway and in, upon, or by which any persons or property is or may be transported or drawn upon a public highway, including bicycles. (2). "No Parking Area" means the following unincorporated areas within Grant County in which standing, parking and stopping of a vehicle on any portion of the roadway or Grant County right of way is prohibited, except as provided herein: (3). A. Airway Drive, Grant County Road Log Number 41690, Milepost 2.0 beginning at Hillcrest Drive and thence in a southeasterly direction for one-half mile, along Airway Drive, to Milepost 1.5; B. Crescent Bar through Milepost Bar Bridge; Road, Grant County Road Log Number 31790, Milepost 2.35 2.60 inclusive, from the Orchards Housing Area to the Crescent C. Silica Road, Grant County Road Log Number 30990, Milepost 5.08 through Milepost 6.07 inclusive, from Baseline West Road to 1 NW Road; D. Rd. 1 NW, Grant County Road Log Number 30990, Milepost 6.07 through Milepost 6.57 inclusive, from Silica Road eastward'/2 mile. E. Crescent Bar Road, be i�g at the ninety�90) de�ree turn located south of Crescent Bar brid�e and thence in a westerlv direction along Crescent Bar Road a distance of saven hundred and fort feet 740') to the Columbia River (Wanapum Pool) and there terminating. All other words and phrases used herein will have their commonly accepted meanings. Section 3: If any provision of this ordinance/resolution or its application to any person or circumstance is held invalid, the remainder of the ordinance/resolution or the application of the provisions to other persons or circumstances shall not be affected. . Section 4: This ordinance shall take effect the 1 St day of September, 2008.
