HomeMy WebLinkAboutResolution 08-063-CCBOARD OF COUl�TTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION: IN THE MATTER OF APPROVING A PRELIMINARY PLAT OF �10.17 ACRES 1NT0 FORTY THREE RESIDEN'�IAL LOTS FOR BARGALS 1NC., LOCATED IN A PORTIONOFS9,T19N,R28E,WM, GRANT COUNTY, WA 3 RESOLUTION No. 2008- U �-CC APPROVING A PRELIMINARY PLAT OF VIEW RIDGE WHEREAS, the Crrant Coun�y Board of County Cornmissionars have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on July 2, 2008, on the matter of a preliminary plat of �10.17- acres into forty-three (43) residential lots and one (1) lift station; located in a portion of Section 9, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission did approve a motion to recommend to the Board of County Commissioners to approve the proposed preliminary plat with seventeen (17) conditions of approval and twelve (12) findings of fact affirming the recornmendation; and, WHEREAS, the Crrant County Board of Commissioners held a closed record public hearing on August 5, 2008; and, WHEItEAS, the Board of County Commissioners, have reviewed the application material, staff report and Planning Cornmission minutes; and, WHEREAS, the Board oi County Commissioners have found that the proposed subdivision will not adversely affect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioilers have found that the proposed subdivision does meet the applic�ble requirements of Grant County Unified Development Code Chapter 22.04 "Subdivisions and Plats"; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does serve the public use and interest; and, WHEREAS, the Bc�ard of County Commissioners have found that the proposed subdivision does comply with the Crrant County Comprehensive Plan, the Shoreline 1N THE MATTER OF APPROVING A BARGALS INC. PRELIMINARY PLAT OF �10.17 ACRES VIEW RIDGE 1NT0 FORTY THREE LOTS Master Program, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with the Health District's requirements for sewage disposal and potable water supply; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does contain an accurate legal description of the lots being created, and the roads and easements therein; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with Crrant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Board of County Comrnissioners have found that the "Best Available Science" has been considered in the final decision regarding the proposed subdivision; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with the requirements of the U.S. Department of Interior, Bureau of Reclamation and the Moses Lake Irrigation and Rehabilitation District; and, WHEREAS, the Board of County Commissioners have found that all road improvement requirements are ensured pursuant to GCC § 22.04.450; and, WI3EREAS, the Board of County Commissioners have found that the proposed subdivision does appropriately identify and protect critical areas pursuant to GCC § 24.08; and, WHEREAS, the Board of County Commissioners have made a decision to approve "Major Subdivision of View Ridge." NOW, THEREFORE, SE IT RESOLVED TI3AT, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, with the conditions of approval listed below, a preliminary plat of �10.17-acres into 43 lots; located in a portion of Section 9, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington. (Parcel #17-0288-000). CONDITIONS OF APPROVAL: 1) Developrnent shall be in cornpliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. IN THE MATTER OF APPROVING A BARGALS INC. PRELIMINARY PLAT OF �10.17 ACRES VIEW RIDGE INTO FORTY THREE LOTS 3) Development shall comply with all requirements deemed necessary by the Grant County Health District, by the Washington State Departinent of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On-Site Sewage Systems. 4) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 5) During road grading and/or construction activities, county roads shall be maintained clear of soil and rocks at the point of ingress / egress. 6) This proposal shall comply with the requirements of GCC 23.12.080 Clearing, Grading and Drainage Standards, including but not limited to: a) Clearing and grading activities shall be conducted so as to minimize potential adverse effects on offsite property. b) All development shall ensure that soil erosion and sedimentation of drainage- ways wi11 be controlled to prevent damage to adjoining properties. c) Surface drainage shall not be directed to or discharged onto County Roads or ditches within County right-of-ways unless approved by the County Engineer. 7) This proposal shall comply with the requirements of GCC 23.12.100 Road Standards, including but not limited to: a) Road names shall be approved by the Grant County Emergency Services Department and shall be established using the addressing and grid system delineated in GCC 10.36. Specifically, road name should be Rd. 4.6 N.E. 8) Development shall comply with the requirements of the Grant County Health District, including, but not limited to: a) The application and environmental checklist shall be corrected to show that the City of Moses Lake will provide water service. 9) Development shall comply with the requirements of ihe Assessor's Ofi"ice, including, but not limited to: a) Title and subtitle need to be consistent on all pages. b) Signature and dedication blocks shall be included on the final plat. 10) Developinent shall comply with the requirements of the Port District #10, including, but not limited to: a) Subject property is located within the Airport FAA Part 77 Airspace, and therefore, requires an Avigation Easement under GCC 23.04.645(n) Airport 1N THE MATTER OF APPROVING A PRELIMINARY PLAT OF �10.17 ACRES 1NT0 FORTY THREE LOTS BARGALS INC. VIEW RIDGE Safety Overlay. Signed easements should be returned to the Port for processing and recording. 11) Development shall comply with the requirements of the Public Utility District, including, but not limited to: a) The following statement shall be included on the face of the plat: "All interior lot lines are subject to a 5-foot wide utility easement and all exterior lot lines are subject to a 10-foot wide easement. In those areas where USBR and/or irrigation district easements exist along property lines, the utility easement(s) shall run parallel and abutting said easement. Said easement subject to being relocated upon an alteration of any boundary of said lots unless said easements are in use." 12) Development shall comply with the requirements of the Noxious Weed Control Board of Grant County, including, but not limited to: a) The area proposed for development, specifically parcel #17-0288-000, is highly infested with Diffuse Knapweed, which is a noxious weed and therefore, it must be sprayed before construction begins. 13) Development shall comply with the requirements of the Grant County Public Works Dapartment, including, but not limited to: a) Provide a plat check fee of $100 for Plats. b) Provide control monuments for all road intersections and centerline tangents. c) Provide a plat certificate fiom the title company for all land being dedicated to d) e) � �) h) i) Grant County. Provide a signature block for the County Engineer. An approach permit shall be obtained prior to a building permit. All lots shall have a minimum of 50' of frontage onto a county maintained or private road. Label all right-of-way dimensions or make notation. Prior to Public Works signing tha �nal plat all required road construction and improvements shall be completed and accepted by Public Works, or a Bond shall be in place for the required work. Provide a 60' radius for the cul-de-sac. 14) The applicant shall comply with GCC 23.12 with regard to the development of water and sewer infrastructure —or— provide a covenant insuring fitture sewer and water infrastructure, built to city standards, in favor of the City of Moses Lake. 15) Development shall coinply with all requirements of the WA Department of Ecology, including but not limited to: a) Proper disposal of construction debris inust be in such manner that debris cannot enter the natural storm water drainage system or cause water quality degradation of surface waters. Dumpsters and refuse collection containers shall be durable, corrosion resistant, nonabsorbent, non-leaking, and have close t"itting covers. If spillage or lealcage does occur, the waste shall be piciced up immediately and returned to the container and the area properly cleaned. IN THE MATTER OF APPROVING A PRELIMINARY PLAT OF �10.17 ACRES 1NT0 FORTY THREE LOTS BARGALS 1NC. VIEW RIDGE 16) Development shall comply with all conclusions and recommendations listed in the submitted Geotechnical Engineering Evaluation prepared by Nelson Geotechnical Associates, Inc. for View Ridge, including but not limited to the following subsections of the report: a) General: Final grading and site drainage plans shall be subjected to geotechnical b) c) a� e) � g) h) i) J) k) 1) engineering review prior to construction. This statement shall be recorded under notes on the face of the plat. Erosion Control. Stonn water Infiltration. 5tructure Setbacks: The future residence foundations shall be setback at least 20 feet from the top of the slope along the west side of the plat area. Specifically, the setback area and top of the slope shall not be disturbed or modified through placement of any fill or removal of the existing vegetation. The setback shall be shown on the final plat map. Site Preparation and Grading. Teinporary and Permanent Slopes. Foundation Support. Structural Fill: General, Materials, and Fill Placement. Slab-on-Grade. Pavements. Site Drainage: Surface Drainage and Subsurface Drainage. Use Of The Report: proponent shall perform the proper maintenance of drainage control measures at the site (runoff shall not be allowed to concentrate on or near the slope). Copy of the report shall be provided to any future owners of the proposed lots. 17) Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a) Comply with all requirements listed in UDC Chapter 22.04 Article V Final Subdivisions and Short Subdivisions. b) Comply with a11 requirements listed in the SEPA Mitigated Determination of Non-Significance issued by Grant County on June 9, 2008. "BOCC FINDINGS OF FACT" The Board of County Commissioners may want to consider the following criteria in making their decision. The following criteria may also be used as findings of fact: (1) The proposed subdivision does / does not meet the applicable requirements of UDC Chapter 22.04 "Subdivisions and Plats"; (2) Tha proposed subdivision does / does not serve the public use and interest; (3) The proposed subdivision does / does not comply with the Comprehensive Plan, the Shoreline Master Program, the zoning code and other land use regulations, and SEPA; (4) The proposed subdivision does / does not comply with health requirements for sewage disposal and potable water supply; IN THE MATTER OF APPROVING A PRELIMINARY PLAT OF �10.17 ACRES 1NT0 FORTY THREE LOTS BARGALS 1NC. VIEW RIDGE (5) The proposed subdivision does / does not contain an accurate legal description of the lots being created, and the roads and easements therein; (6) The proposed subdivision does / does not comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; (7) The best available science has / has not been considered in the final decision regarding the preliminary plat. (8) The proposed subdivision does / does not comply with requirements of the U.S. Department of Interior, Bureau of Reclamation and the Quincy-Columbia Irrigation District. (9) The phasing plan does / does not include all land within the preliminary subdivision. (10) Each phase is / is not an independent planning unit with safe and convenient circulation and with facilities and utilities coordinated with the requirements established for the entire subdivision; and, (11) All road improvement requirements are / are not ensured pursuant to GCC § 22.04.450. (12) The proposed subdivision does / does not appropriately identify and protect critical areas pursuant to GCC § 24.08. `�n Dated this �✓ day of , 2008.
