HomeMy WebLinkAboutOrdinance 14-074-CC I I� il GRANT COUNTY BOARD OF COMMISSIONERS Grant County, Washington ORDINANCE NO. 14- (�'�7 -CC RESOLUTION NO. 14- d�j -CC AN ORDINANCE ItEGARDING COUNTY VEHICLE MARKING AND EXCEPTIONS WHEI2EAS, Grant County, Washington, is a duly organized and existing municipal corporation operating under and by virtue of the Constitution and the laws of the State of Washington; and WHEREAS, the Board of County Conunissioners, as the legislative authority of Grant County, is empowered with the authority under RCW 36.32.120(7) to malce and enforce, by appropriate resolutions or ordinances, all such police regulations as are not in conflict with state law; and WHEREAS,pursuant to RCW 46.08.065(1),the appropriate governing body inay provide by rule or ordinance exceptions to the marlcing requirements for local govermnental agencies for the purpose of law enforcement,confidential public health worlc,and public assistance fi�aud or support investigative purposes; and WHEREAS,it is the desire of the Board of County Commissianers to continue to promote, � protect and enhance the health, safety and welfare of Grant County residents; and ' WHEREAS, the Board of County Commissioners has determined that it is reasonable, advisable and necessary for the public health,safety and welfare of the residents of Grant County to establish marlcing requirements and exceptions concerning publicly owned vehicles owned or controlled by Grant County: and, i ( � WHEItEAS,the Board o f County Comnlissioners finds that such marking requirements and ' exceptions concerning publicly owned vehicles owned or controlled by Grant County will likely 'i, protect persons and property from injury and annoyance, and coi�tinue to promote, protect and enhance the health, safety and welfare of Grant County residents. '� � NOW, THEItEFORE, BE IT HEREBY ORDAINED by the Board of County ' Commissioners oF Grant County, State of Washington: � � Section 1. This chapter shall be lalown and may be commonly referred to and cited as the "County Vehicles." 2.54.020 Marking—Requirements. ' All county vehicles shall be marked in accordance with RCW 46.08.065, as amended, with the ' exceptions perinitted therein of the following: (1) Vehicles used for law enforcement purposes, liniited to the vehicles assigned to the county sheriff's office, the county prosecuting attorney's office, and the county juvenile court services; (2) Vehicles used for confidential public health worlc; (3) Vehicles used for public assistance fraud or support investigative purposes; (4) Vehicles leased or rented by the County on a casual basis for a period of less than ninety(9Q) days; and (5) Vehicles granted use of confidential license plates by the Director of Motor Vehicles for necessary personal security of a county officer or employee. 2.54.030 Marl�ing—Exceptions. The Board of County Commissioners reserves the right to determine whether County vehicles are used for purposes listed in the exceptions of the rule enacted in Section 2,54.020. 2.54.040 Severability. If any section, subsection, sentence, clause, phrase, words, word of this chapter is for any reason found to be unconstitutional or otherwise invalid, such unconstitutionality or invalidity shall not afFect the constitutionality or validity of the remainiilg portions of this chapter, it bei�ig expressly declared that each section, subsection, sentei�ce, clause, phrase, words or word would have been prepared, proposed, adopted, approved and ratified irrespective of the fact that any one or more section, subsection, sentence, clause, phrase, words, or word be declared or otherwise found unconstitutional or invalid for any reason. This ordinance/resolution creating a new chapter to Title 2 of the Grant County Code shall be effective when signed.
