MONDAY,JULY 7, 2014
The Grant County Commissioners session began at 8:30 a.m. with all Commissioners in attendance.
8:30 a.m.—9:00 a.m. Elected Official Roundtable Meeting
9:00 a.m.—9;20 a.m. J Strickler,ASC Update and Misc BOCC Action
A motion was made by Commissioner Carter, seconded by Commissioner Stevens,to approve items 1
through 5 on the ASC Agenda as presented. The motion passed unanimously.
1. Possible vouchers for Interfund Communications, insurance, and/or grant administration.

2. Working Agreement by and between Grant County and Teamsters Local Union No. 760,
Teamsters, Food Processing Employees, Public Employees, Warehousemen and Helpers—Grant
Integrated Services, Community Support Specialists—January 1, 2014 to December 31, 2016.
(Approved)
3. Interagency Agreement IAA between the State of Washington, Office of Civil Legal Aid, and
Grant County for the purpose of reimbursing the County for allowable expenses associated with
attorneys appointed to represent certain children in dependency proceedings pursuant to 2ESSB
6126(Laws of 2014, Ch. 108). (Approved)
4. Resolution No. 04-038-CC Authorizing Execution of Interlocal Agreement between Grant County
and the State of Washington Office of Civil Legal Aid. (Approved)
5. Professional Services Agreement between Grant County, by and through the Grant County
Building Department, and Lee Creiglow for residential plan review. Term is July 8, 2014 through
July 31, 2016. (Approved)

MISCELLANEOUS ITEMS
As of this date,the Board, by a majority vote, does approve for payment those vouchers certified by the
auditing officer as required by RCW 42.24.080, and those expense reimbursement claims certified by the
auditing officer as required by RCW 42.24.090, in the amounts of$562,461.78, $48.00, and$74,781.54,
as recorded on a listing and made available to the Board.

Pursuant to RCW 42.30.110(1)(i) Commissioner Swartz called an Executive Session to order at
9:45 a.m. to go until 9:52 a.m, to discuss with legal counsel representing the agency matters
relating to agency enforcement actions, or to discuss with legal counsel representing the agency
litigation or potential litigation. In attendance were Commissioners Stevens, Carter, Swartz, and
Lee Pence, Civil Deputy Attorney. Commissioner Swartz closed the session at 9:52 a.m.

, 1:50 p.m.—2:00 p.m, Bid Opening, Fairgrounds Path Project, Phase#1 (CRP 14-04)
The following bids were received:
1. Granite Construction $10,779.00
2. Central Washington Asphalt $16,249.00
' A motion was made by Commissioner Swartz, seconded by Commissioner Carter,to turn over the
bids to Public Works for their review and recommendation, The motion passed unanimously.
2:15 p.m.—2:25 p.m. Open Record Public Hearing, Park Place Road Vacation
The Commissioners held an Open Record Public Hearing regarding a request from Kris Dexter to
vacate that portion of County Road and Right-of-Way known as Park Place, Pelican Point
Addition 3, in S 3,T 18 N, R 28 E, W M, all in Grant County.
Jeff Tincher read the following Engineer's Report into the record:
The Board of County Commissioners of Grant County Washington has received a petition
to vacate that portion of County Road being all that portion of County Road Park Place,
Road Log Number 21608,from Mile Post 0.000 to Mile Post 0.050, lying in Section 3 of
Township 18 North, Range 28 East W.M., all in Grant County, Washington, as
highlighted on the attached ExhibitA.
The Board of County Commissioners determined that consideration should be given to
the petition and directed the County Road Engineer to prepare a report on the proposed
vacation and abandonment for a public hearing to be held at 2:15 PM,July 8, 2014.
The proponents of the petition awn the majority of the frontage along the petitioned
County Road as shown on the attached Exhibit e. There is one(1)Approach Permit(5-
225-AJ at M.P. 0.019 on County Road Park Place for Lot#2, Pelican Point Addition No. 3,
this lot also has an existing approach onto Goodrich Road just west of Park P/ace.
County Road Park Place does not abut on a body of freshwater(Moses Lake)as shown
by the Mean High Water Line on Pelican Point Addition No. 3 Plat, Exhibit A.
Along the Westerly side of County Road Park P/ace is a drainage ditch that collects storm
water from Park Place Road, Goodrich Road and a portion from Pelican Drive. The storm
water from Pelican Drive is captured in catch basins and then piped down the hill, enters
the ditch along Goodrich Road just East of Park Place Road then crosses Goodrich Road
into the drainage ditch along Park Place.
At the location where this storm water enters Goodrich Road there also appears to be
ground water coming in from the hill side and/or piped from the adjacent properties.

On March 18, 2014 an Open Record Public Hearing was held for the Vacation on this
same portion of County Road Park Place, 10 citizens spoke against the vacation stating
there was a use for this road and the road vacation was denied.
There would be benefit to the public in that road fund expenditures on this road would
no longer be necessary.
The office of the County Road Engineer recommends denying this road vacation based
on the public use of the road and to accommodate the existing and future drainage in ,
the area.
Commissioner Swartz stated numerous letters were received in favor of and against this road I
vacation.
Kris Dexter read into the record a letter describing his application and also submitted pictures.

Tom Taylor spoke against the road vacation.
Clifford Morgan spoke against the application and of utility access needed to get water from the
lake to their park.
Mark Johnson spoke against the road vacation.
Dave Donley, spoke against the road vacation and requested from the Public Worl<s Department
to add speed limit signs to the area, Mr. Donley also submitted a written letter for the record.

Rich Walpole, Columbia Northwest Engineering representing the Homeowners Association, read
into the record a letter from Jill Goodrich. The letter requests that if the road vacation is
approved,that an easement be granted to maintain the utilities that are currently being used to
water the park. (Grant Counfiv Exhibit C)
Tom Keilman spoke against the road vacation. ;
Kay Morgan spoke against the road vacation.
Commissioner Swartz informed those in attendance that Public Works did visit the site and is
aware of the water running down the hill side. The Commissioners held this second hearing to
guarantee that everyone can be heard. She also stated they do not expect a 3rd or 4t" hearing on
this issue.

Freya Liggett spoke against the road vacatinn.
Kim Thomas,Secretary/Treasurer of the Home Owners Association, spoke against the road
vacation.
; Kris Dexter, clarified that RCW 36.87.140 talks about the retaining of the easement of utilities if
a vacation occurs. Mr. Dexter provided copies of law suits that state only residents from Pelican
Point 1, 2, 3, and 4 are to use the easements. Mr. Dexter stated that no one parks in this area.

Cliff Morgan discussed boat trailers and parking in this area.
Dave Donley spoke in rebuttal of Mr. Dexter's comments.
Marl<Johnson reiterated that this area is being used for parking and boat trailers.
Charles Mehre discussed the Home Owners Association adversarial relationship with Mr, Dexter.
Commissioner Stevens moved to close the public comment portion of the hearing.
Commissioner Carter seconded and the motion passed unanimously. Commissioner Carter
moved to deny the application to vacate Parl< Place as the public continues to use the area,
Commissioner Stevens seconded and the motion passed unanimously. The hearing adjourned.

MISCELLANEOUS ITEMS
The Commissioners approved the recommendation of the Public Works Director to award the bid for the
S. Frontage Road (CRP 13-19) project to Central Washington Asphalt in the amount of$339,371.65.
The Commissioners approved the recommendation of the Public Works Director to award the bid for the
Fairgrounds Path Project, Phase#1 (CRP 14-04)to Granite Construction Co., in the amount of
$10,779,00.
The Commissioners signed a proclamation of local emergency due to the impacts suffered from the
wildfire of July 9, 2014 located within a portion of Grant County, Palisades area,which threatened the
area of Sagebrush Flats Road, and County Road 23 NE and the surrounding farmland,
The Chair of the Board was authorized to sign the Eustaquio and Paulina Angel (Angel Short Plat) File
#13-5759-01 Final Plat Submission and Review.
