ROBERTSON, President) LOCATED IN THE NORTH/20F SECTION 29, TOWNSHIP 24 NORTH, RANGE 27 EAST, WM, GRANT COUNTY, WASHINGTON nv / RESOLUTION NO. 10- V o -CC APPROVING A PRELIMINARY PLAT OF RIMROCK ESTATES LONG PLAT WHEREAS, the Board of County Commissioners of Grant County have been advised that an open record public hearing was conducted before the Grant County Planning Commission on October 6, 2010 in the matter of a Preliminary Plat of 30.9 acres into eleven (I1) lots, ten lots have residential capacity and Lot #11 will be a community lot with no residential capacity all located in a portion of Section 29, Township 24 North, Range 27 East, Willamette Meridian, Grant County, Washington, and WHEREAS, the Grant County Planning Commission on October 6, 2010 did approve a motion to recommend to the Board of County Commissioners approval of this proposed Preliminary Plat with five (5) suggested Conditions of Approval and seven (7) Findings of Fact affirming the recommendation, and WHEREAS, the Board of County Commissioners held a closed record public hearing regarding this matter on November 17, 2010, and WHEREAS, the Board of County Commissioners have reviewed the application material, staff report, and a summary of the Planning Commission hearing, and WHEREAS, the Board of County Commissioners have found that this proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal, and WHEREAS, the Board of County Commissioners have found this proposal to be consistent with the Grant County Comprehensive Plan, the Unified Development Code Chapter 23.04 "Zoning," other land use regulations, and SEPA, and WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the proposed Preliminary Plat, and WHEREAS, the proposed Preliminary Plat, subject to the Conditions of Approval, meets the applicable requirements of the Unified Development Code Chapter 22.04 "Land Division," and IN THE MATTER OF APPROVING A RIMROCK ESTATES LONG PLAT PRELIMINARY PLAT OF 30.98 ACRES INTO ELEVEN (11) LOTS FOR CREATIVE LIVING, LLC WHEREAS, the proposed Preliminary Plat does comply with the Health District's requirements for sewage disposal and potable water supply, and WHEREAS, the proposed Preliminary Plat does contain an accurate legal description of the lots being created, and the roads and easements therein, and WHEREAS, the proposed Preliminary Plat does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements, and WHEREAS, the Board of County Commissioners have made a decision to approve the Rimrock Estates Long Plat, NOW, THEREFORE, BE IT RESOLVED THAT the Board of County Commissioners of Grant County, Washington hereby approve by this Resolution, subject to the five (5) Conditions of Approval listed below, a Preliminary Plat of 30.9 acres into eleven (11) lots. Lots one (1) through ten (10) will have residential capacity and the eleventh lot (11) is a proposed community lot with no residential capacity all located in a portion of Section 29, Township 24 North, Range 27 East, Willamette Meridian, Grant County, Washington (Parcel #16-2192-000). CONDITIONS OF APPROVAL The applicant shall comply with all requirement as deemed necessary by the Grant County Health District including but not limited to: a) A community septic system is proposed for this development. The design must be submitted to the Health District and approved before final plat approval will be given. b) It appears that individual wells are proposed for these lots. Individual wells may be violation of Washington law, RCW 90.44.050. Contact WA Dept. of Ecology, Office of Water Resources (509) 329-3422. If individual wells are allowed, the location of each well must be shown on the plat with a radius of 100 feet drawn around it. 2. The applicant shall comply with all requirement as deemed necessary by the Grant County Public Works including but not limited to: a) Provide a plat check fee of $200.00 for Major Plats. b) Scale shall be a minimum of I" — 100". c) Provide a plat certificate from the title company for all land being dedicated to Grant County. d) Plat shows Government Lot 4 in the middle of Blue Lake. An indicator shall be added to point to it proper location. e) An Approach Permit must be obtained prior to a building permit. f) The easement AF#1080986 shall be amended or a second Easement created to make available a 60'easement for the purpose of a Private Rd servicing the Plat to the east. The applicant shall comply with all requirement as deemed necessary by the Grant County Auditor's Office including but not limited to: a) The name "Rimrock Estates Long Plat" is approved. 4. The applicant shall comply with all requirement as deemed necessary by the Grant County Planning Department including but not limited to: a) Development shall comply with the requirements of GCC § 22.04 Article V "Final Subdivisions and Short Subdivisions" and all other pertinent portions of Grant County Code. b) The landowner/applicant shall comply with all findings, recommendations, restrictions, and mitigation requirements of the "Wetland Delineation and Critical Areas Assessment dated December 12, 2002 prepared by Grette Associates of Wenatchee. WA. c) The landowner/applicant shall incorporate restrictions as requested by WA State Dept. of Fish & Wildlife within the wetland buffer area into the Covenants. d) All development shall comply with all requirements included in the SEPA Mitigated Determination of Non -Significance issued on January 13, 2003. e) The wetland buffer shall be identified by the developer placing permanent monuments every fifty -feet (50) along said boundaries. The monuments shall minimally be a 4"x 4" buried posts exposed a minimum of 2 feet above ground or by another method as approved by Planning Department. f) Please make the following corrections/additions to the mapping: 1) Correct within the Zoning Information block the following: a) Change the number of lots to 11 b) Please correct the maximum number of potential dwelling units to 30. 2) Under Covenants: correct the language to reflect covenants as outlined in MDNS item #10 dtd 01/13/03 and correct the spelling of Records. 3) Please remove item #4 under Notes located on page 2. 5) The applicant shall comply with all requirements as deemed necessary by the WA State Dept. of Ecology (Spokane—SEPA Coordinator), including, but not limited to: a) The water purveyor is responsible for ensuring that the proposed use(s) are within the limitations of its water rights. If the proposal's actions are different than the existing water right (source, purpose, the place of use, or period of use), then it is subject to approval from the Department of Ecology pursuant to Sections 90.03.380 RCW and 90.44. 100 RCW. b) Any surface water diversions will require application to the Department of Ecology for a water right permit. c) Any ground water development proposal that will withdraw water in excess of 5,000 gallons per day for single or group domestic supply, or for industrial purposes, or for the irrigation of more than % acre of lawn or non-commercial garden will require a permit from the Department of Ecology. d) Routine inspections and maintenance of all erosion and sediment control Best Management Practices (BMPs) are recommended both during and after development of the site. e) The operator of a construction site that disturbs one acre or more of total land area, and which has or will have a discharge of stormwater to a surface water or to a storm sewer, Creative Living, LLC (C.E. Robertson) - Rimrock Estates Preliminary Plat - BoCC Resolution - Page 3 IN THE MATTER OF APPROVING A RIMROCK ESTATES LONG PLAT PRELIMINARY PLAT OF 30.98 ACRES INTO ELEVEN (ll) LOTS FOR CREATIVE LIVING, LLC must apply for coverage under Department of Ecology's Construction Stormwater General Permit. f) Owners of sites where less than one acre of total land area will be disturbed must also apply if the construction activity is part of a larger plan of development or sale in which more than one acre will eventually be disturbed. Discharge of stormwater from such sites without a permit is illegal and subject to enforcement action by the Department of Ecology. EFFECTIVE DATE: Upon signature. DATED this I day of h 2010.
