WM, GRANT, WA RESOLUTION No. 2007- 0" CC APPROVING A PRELIMINARY PLAT OF ANTHONY SCHNEIDER LONG PLAT WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearings were conducted, before the Grant County Planning Commission on April 4, 2007 and May 2, 2007 on the matter of a preliminary plat of -53.28-acres into five (5) lots; located in the northeast quarter of Section 18, Township 20 North, Range 26 East, Willamette Meridian, Grant County, Washington, and, WHEREAS, the Grant County Planning Commission did approve a motion to recommend to the Board of County Commissioners to approve the proposed preliminary plat with fifteen (15) conditions of approval and twelve (12) findings of fact affirming the recommendation, and, WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on June 25, 2007; and, WHEREAS, the Board of County Commissioners, have reviewed the application material, staff report and Planning Commission minutes; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision x ill not adversely affect the health, safety, and general welfare of the public m the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does meet the applicable requirements of Grant County Unified Development Code Chapter 22.04 `Subdivisions and Plats'; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does serve the public use and interest, and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does MITIv Nx ith the Grant C ounty Comprehensive Plan, the Shoreline IN THE MATTER OF APPROVING A ANTHONY SCHNEiDER PRELIMINARY PLAT OF 53.28 ACRES LONG PLAT INTO FIVE (5) LOTS Master Program, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with the Health District's requirements for sewage disposal and potable water supply, and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does contain an accurate legal description of the lots being created, and the roads and easements therein, and, WHEREAS, the Boaid of County Commissioners have found that the proposed subdivision does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Board of County Commissioners have found that the "Best Available Science" has hewn considered in the final decision regarding the proposed subdivision, and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with the requirements of the U.S. Department of Interior. Bureau of Reclamation and the Qmncy-Columbia Irrigation District, and. WHEREAS, the Board of County Commissioners have found that the subdivision is an independent planning unit with safe and convenient circulation. and contains facilities and utilities that have been coordinated with the requirements established for the entire subdn ision and, WHEREAS, the Board of County Commissioners have found that all road improvement requirements are ensured pursuant to GCC § 22 04 450, and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does appropriately identify and protect critical areas pursuant to GCC § 24 08, and, WHEREAS, the Board of County Commissioners have made a decision to approve "Anthony Schneider Long Plat." NOW, THEREFORE, BE IT RESOLVED THAT, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, with the conditions of approval listed below, a preliminary plat of 53.28 -acres into fire (5) space lots, located in the northeast quarter of Section 18. Toii m hip 20 North. Range 26 East, Willamette Meridian, Grant County, Washington. Parcel #16-0621-001. IN THE MATTER OF APPROVING A ANTHONY SCHNEIDER PRELIMINARY PLAT OF 53.28 ACRES LONG PLAT INTO FIVE (5) LOTS CONDITIONS OF APPROVAL: 1) Development shall be In compliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code. and all applicable local, state, and federal regulations, rulings or requirements. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health Di;uict, by the Washington State Department of Health. and the Washington State Department of Lcology regarding domestic water supply, sewage systems and storm water control and treatment Including, but not limited to, RCW 90.48 080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards, WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 3) If any Natne Annetican Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Coly elle Confcdei ated Tribes and the Washington State Office of Archaeology and Historic Preservation. 4) Approval of the plat shall be contingent upon conformance with all applicable land use rules and regulations in effect as of March 14, 2007. 5) During road grading and/or construction activities, county roads shall be maintained clear of soil and Locks at the point of ingress % egress 6) This proposal shall comply with the requirements of GCC 23.12.080 Clearing, Grading and Drainage Standards, mcludmLT but not limned to. a) Clearing and grading activities shall be conducted so as to minimize potential adverse effects on offsite property, b) All des elopment shall ensure that soil erosion and sedimentation of dramage- ways w it] be controlled to present damage to adjoining properties C) Surface drainage shall not be directed to or discharged onto County Roads or ditches within County right-of-ways unless approved by the County Engineer. 7) This proposal shall comply with the requirements of GCC 23.12 100 Road Standards. 8) Development shall comply with all requirements of the Grant County Health District including, but not limited to - a) A vtc evaluation will be required for each lot to determine the suitability for septic system installation before final plat approval is given. A licensed septic system designer or engineer most do vv ork. Completed evaluations must be submitted to the Health District for rev iew and all fees paid. 9) Development shall comply with the requirements of the WA State Department of Ecology. 10) Development shall comply with all requirements of the Grant County Public Works, including but not limited to: IN THE MATTER OF APPROVING A ANTHONY SCHNEIDER PRELIMINARY PLAT OF 53.28 ACRES LONG PLAT INTO FIVF (5) LOTS a) Provide a plat review fee of S100.00. b) Provide a plat certificate from the title company for all land being dedicated to Grant County. c) Cori eetions need to be made to the vicinity map. d) An approach permit must be obtained for each lot prior to the issuance of a building permit e) The plat map does not clarify as to whether the internal plat road is to be public or private. This needs to be specified. 11) Development shall comply with all requirements of the WA State Department of Fish & Wildlife; including but not limited to Habitat Evaluation and Mitigation -Measures submitted to Planning Department on February 9. 2007 by Ronald C Friesz/Wildlife Biologist/ Specifically, the applicant shall. a) Designate a 7.5 acres open space (250 It by 1350 ft) in the north side of Lot #5 to protect the burrow sites and basic foraging area of the ow is. This would include a portion of the irrigation canal right-of-way Post `Burrowing Owl Protection Zone" signs along the west. south, and east boundaries of the area The irrigation canal would border the north side Signs shall be posted at approximately 200 niterrals (see mitigation plan). b) Sign an agreement with the Central Basin Audubon (CBA) to install one artificial burrow within the protection zone to pro%ide a potential third nesting burrow. CBA would agree to proN ide long-term maintenance to all three burrow s, as well as provide, post and maintain the protection zone signs, Burrow numbers would be limited to three to avoid potential food competition problems within the owl populations, WDFW-PHS, 2003. c) Maintain the three existing wooden fence posts within the fenced open space to provide owl perching sites. 12) Development shall comply with all requirements of the United States Department of Interior, including but not limited to: a) The Bureau of Reclamation Canal, W22, should be noted as a buried pipe. b) It was noted that the proposed access to Lots 3, 4, and 5 is depicted crossing the W22 right-of-way. The proponent w ill need to contact Reclamation regarding use of this right-of-way. Reclamation will not sign the final plat until this issue is resolved. 13) Development shall comply with all requirements of the Grant County Noxious Weed Board, including but not limited tw a) The development of this property shall be conducted in such manner that the noxious weeds are not spread to other areas by vehicle or soil movement off the site Please contact the Grant County Noxious Weed Board for more information. Disturbance shall be limited to smallest extent possible. b) The spraying of the noxious weeds is recommended to help control the spreading. 14) Development shall comply with all requirements of the Grant County Department of Community Development/Planning Division/, including but not limited to: IN THE MATTER OF APPROVING A ANTHONY SCHNLIDER PRELIMINARY PLAT OF 53.28 ACRES LONG PLAT INTO FIVE (5) LOTS a) Comply with all requirements listed in UDC Chapter 22.04 Article V Final Subdivisions and Short Subdn isions b) Comply with all requirements listed in the SEPA 'Mitigated Determination of Non -Significance issued by Grant County on March 14, 2007 c) Pursuant to the GCC 23 12 070(k)(1) the eastern property line for lot 2 shall have the special agricultural setback recorded on the face of the plat Tine width of the Rd "E" N W may be calculated as part of this special setback d) Pursuant to GCC 23 04 080 the Richt To Farm Disclosure shall be recorded with the Grant County Auditor and noted on the face of the plat in full e) Pursuant to one of the requirements of the Habitat Evaluation that is implemented as Condition of'Approval #11(b), the signed agreement between the developer and CBA shall be recorded with Grant County Auditor and referenced in full on the face of the plat. I) The easement shall be recorded on the face of the plat in order to grant access for CBA to provide long-term maintenance as well as complete the work delineated in the Condition of Approval #1l(b). g) Under Zoning information the number of lots shall be five (5) (sheet I of 3). h) The notes 4 and 5 shall be eliminated (sheet 1 of 3). i) All references to short plat shall be changed to plat. 15) Development shall comply with all requirements of the Quincy -Columbia Basin Irrigation District, mcluc me but not limited to a) The signature block shall say "Quincy -Columbia Basin Irrigation District'. (5) The proposed subdniston does / does not contain an accurate legal description of the lots being created, and the roads and easements therein; (6) The proposed subdn ision does / does not comply with Grant County regulations pertaining to roads. utihtie�. drainage, access for emergency vehicles, and other infrastructure improvements; (7) The best available science has / has not been considered in the final decision regarding the preliminary plat (8) The proposed subdivision does I does not comply with requirements of the U S.
