HomeMy WebLinkAboutResolution 07-052-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington IN THE MATTER OF APPROVING A PRELIMINARY PLAT OF 38.6 ACRES INTO FIVE (5) LOTS, LOCATED IN A PORTION OF SECTION 9, TOWNSHIP 20 NORTH, RANGE 27 EAST, WM, GRANT COUNTY, WASHINGTON RESOLUTION NO. 07- 06-a'- -CC APPROVING A PRELIMINARY PLAT OF DANIEL ROBERTS LONG PLAT WHEREAS, the Board of County Commissioners of Grant County have been advised that an open record public hearing was conducted before the Grant County Planning Commission on March 7, 2007 in the matter of a Preliminary Plat of 38.6 acres into five (5) lots, which are located in the northwest quarter of Section 9, Township 20 North, Range 27 East, Willamette Meridian, Grant County, Washington, and WHEREAS, the Grant County Planning Commission on March 7, 2007 did approve a motion to recommend to the Board of County Commissioners to approve this proposed Preliminary Plat with twelve (12) suggested Conditions of Approval and ten (10) Findings of Fact affirming the recommendation, and WHEREAS, the Board of County Commissioners held a closed record public hearing regarding this matter on April 24, 2007, and WHEREAS, the Board of County Commissioners have reviewed the application material, staff report, and a summary of the Planning Commission hearing, and WHEREAS, the Board of County Commissioners have found that this proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal, and WHEREAS, the Board of County Commissioners have found this proposal to be consistent with the Grant County Comprehensive Plan, the Unified Development Code Chapter 23.04 "Zoning," other land use regulations, and SEPA, and WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the proposed Preliminary Plat, and IN THE MATTER OF APPROVING A DANIEL ROBERTS LONG PLAT PRELIMINARY PLAT OF 38.6 ACRES INTO FIVE (S) LOTS WHEREAS, the proposed Preliminary Plat, subject to the Conditions of Approval, meets the applicable requirements of the Unified Development Code Chapter 22.04 "Land Division," and WHEREAS, the proposed Preliminary Plat does comply with the Health District's requirements for sewage disposal and potable water supply, and WHEREAS, the proposed Preliminary Plat does contain an accurate legal description of the lots being created, and the roads and easements therein, and WHEREAS, the proposed Preliminary Plat does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements, and WHEREAS, the Board of County Commissioners have found that "best available science" has been considered in the final decision regarding the proposed subdivision, and WHEREAS, the Board of County Commissioners have found that all road improvement requirements are ensured pursuant to Grant County Code § 22.04.450, and WHEREAS, the Board of County Commissioners have found that the proposed subdivision does appropriately identify and protect critical areas pursuant to Grant County Code § 24.08, and WHEREAS, the Board of County Commissioners have made a decision to approve the Daniel Roberts Long Plat, NOW, THEREFORE, BE IT RESOLVED THAT the Board of County Commissioners of Grant County, Washington hereby approve by this Resolution, subject to the twelve (12) Conditions of Approval listed below, a Preliminary Plat of 38.6 acres into five (5) lots, located in the northwest quarter of Section 9, Township 20 North, Range 27 East, Willamette Meridian, Grant County, Washington (Parcel 416-1633-005). CONDITIONS OF APPROVAL 1) Development shall be in compliance with the Growth Management Act, the countywide Planning Policies, the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2) Development shall comply with all requirements of the Grant County Fire Marshal and shall be in compliance with Grant County Fire Flow guidelines, the Uniform Building Daniel Roberts Preliminary Plat - BoCC Resolution - page 2 IN THE MATTER OF APPROVING A PRELIMINARY PLAT OF 38.6 ACRES INTO FIVE (5) LOTS DANIEL ROBERTS LONG PLAT Code, the Uniform Fire Code, and all other applicable requirements for fire protection and safety. 3) This proposal shall comply with all requirements deemed necessary by the Washington State Department of Health and the Washington State Department of Ecology in regards to domestic water supply, sewage systems, and storm water control and treatment including, but not limited to: RCW 90.48.080 (Discharge of Polluting Matter in Waters Prohibited), WAC 173-200 (Ground Water Quality Standards), WAC 173-201-A (Surface Water Quality Standards), and WAC 246-272 (On -Site Sewage Systems). 4) If any Native American grave site(s) or archaeological/cultural resources (Indian artifacts) are found, all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, Colville Confederated Tribes, and the Washington State Office of Archaeology and Historic Preservation. 5) This proposal shall comply with any/all applicable Federal, state, and local regulations in place at the time the applications were deemed Technically Complete; that date being December 4, 2006 in this instance. 6) During any construction activities, county roads shall be maintained clear of soil and rocks at point(s) of ingress and egress. 7) The private road providing access to Lots 43, 44, and 45 cannot be dedicated in its present configuration. 8) The applicant shall comply with all requirements as deemed necessary by the Grant County Health District, including, but not limited to: a) A Site Registration is needed for Lots 2, 4, and 5 to determine the requirements for septic system application. b) The location for the well on Lot 2 must be shown on the plat with a radius of 100 ft. drawn around it. 9) The applicant shall comply with all requirements as deemed necessary by the Grant County Public Works Department, including, but not limited to: a) Provide a plat review fee of $200.00. b) Provide a plat certificate from the title company for all land being dedicated to Grant County. C) An Approach Permit must be obtained for each lot prior to the issuance of a Building Permit. Daniel Roberts Preliminary Plat - BoCC Resolution - page 3 IN THE MATTER OF APPROVING A DANIEL ROBERTS LONG PLAT PRELIMINARY PLAT OF 38.6 ACRES INTO FIVE (5) LOTS d) This office has been in contact with the property owner to the south and is aware of his intention to develop his parcel of land. Because of the limited options for access available for both of these developments, the applicant shall contact the landowner to the south and coordinate a single access for these two developments. Both developments shall be served by a single Public County Road. e) The portion of Neppel Road contained within this plat should be dedicated to Grant County. f) Grant County Public Works will not be encumbered by any well head protection zones. 10) The applicant shall comply with all requirements as deemed necessary by the Grant County Auditor, including, but not limited to: a) The name "Daniel Roberts Long Plat" is approved. 11) The applicant shall comply with all requirements as deemed necessary by the WA State Dept. of Ecology (Spokane—SEPA Coordinator), including, but not limited to: a) Any ground water withdrawals in excess of 5,000 gallons per day or for the irrigation of more than one-half acre of lawn or noncommercial garden will require a water right permit from the Department of Ecology. 12) The applicant shall comply with all requirements as deemed necessary by the Grant County Planning Department, including, but not limited to: a) Development shall comply with the requirements of GCC § 22.04 Article V "Final Subdivisions and Short Subdivisions" and all other pertinent portions of Grant County Code. b) Development shall comply with all requirements included in the SEPA Mitigated Determination of Non -Significance issued on December 7, 2006. c) Please make the following corrections/additions to the mapping consistent with UDC 23.04.080: i. In the title on each page, please delete the comma (",") after "Roberts." ii. In Notes 4, 5, 7, and 8 on Page 1, please change the words "short plat' to "plat." iii. Pursuant to GCC § 23.12.075 (e)(9)(B), please indicate a building envelope on Lot #3. In the Dedication on Page 2, please correct the minor misspelling of "waiver." v. In the Acknowledgements on Page 2, please correct (twice) the minor misspelling of"Fire Marshal." vi. In the Acknowledgements on Page 2, please delete the comma between "Grant County" and "Assessors Office." Vii.
