HomeMy WebLinkAboutResolution 07-033-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington IN THE MATTER OF APPROVING A PLAT ALTERATION OF LOT 14, THE EAST %2 OF LOT 15, THE WEST h OF LOT 15, & LOT 16 OF MORGAN TRACTS, UNIT 1, LOCATED IN THE NE 1/4 OF SECTION 34, TOWNSHIP 19 NORTH, RANGE 28 EAST, WM, GRANT COUNTY, WASHINGTON RESOLUTION NO. 07- b 3 3 -CC WALKER REPLAT Eric Walker WHEREAS, the Board of County Commissioners of Grant County have been advised that an open record public hearing was conducted before the Grant County Planning Commission on February 7, 2007 in the matter of a preliminary Plat Alteration of Lot 14, the east half of Lot 15, the west half of Lot 15, and Lot 16 of Morgan Tracts, Unit 1, located in the northeast quarter of Section 34, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington, and WHEREAS, the Grant County Planning Commission on February 7, 2007 did approve a motion to recommend to the Board of County Commissioners to approve this proposed preliminary Plat Alteration with twelve (12) suggested Conditions of Approval and seven (7) Findings of Fact consistent with approval, but removing proposed Condition 12(b) with the notation that Lots A, B, and C of the Redevelopment Plan are not part of the Plat Alteration, and WHEREAS, the Board of County Commissioners held a closed record public hearing regarding this matter on March 13, 2007, and WHEREAS, the Board of County Commissioners have reviewed the application material, staff report, and a summary of the Planning Commission hearing, and WHEREAS, the Board of County Commissioners have found that this proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal, and WHEREAS, the Board of County Commissioners have found this proposal to be consistent with the Grant County Comprehensive Plan, the Unified Development Code Chapter 23.04 "Zoning," other land use regulations, and SEPA, and IN THE MATTER OF APPROVING A PLAT ALTERATION OF WALKER REPLAT LOT 14, THE EAST Y: OF LOT 15, THE WEST V: OF LOT 15, & LOT 16 OF MORGAN TRACTS, UNIT 1. WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by this proposed Reasonable Use Exception, and WHEREAS, the proposed Plat Alteration, subject to the Conditions of Approval, meets the applicable requirements of the Unified Development Code Chapter 22.04 "Land Division," and WHEREAS, the proposed preliminary Plat Alteration does comply with the Health District's requirements for sewage disposal and potable water supply, and WHEREAS, the proposed preliminary Plat Alteration does contain an accurate legal description of the lots being created, and the roads and easements therein, and WHEREAS, the proposed preliminary Plat Alteration does comply with Grant County regulation pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements, and WHEREAS, the Board of County Commissioners have made a decision to approve the preliminary Plat Alteration, NOW, THEREFORE, BE IT RESOLVED THAT the Board of County Commissioners of Grant County, Washington hereby approve by this Resolution, subject to the twelve (12) Conditions of Approval listed below, a preliminary Plat Alteration of Lot 14, the east half of Lot 15, the west half of Lot 15, and Lot 16 of Morgan Tracts, Unit 1, located in the northeast quarter of Section 34, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington (Parcels #12-0680-000, #12-0677-000, #12-0678-000, & #12-0679-000). CONDITIONS OF APPROVAL 1) Development shall be in compliance with the Growth Management Act, the countywide Planning Policies, the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2) Development shall comply with all requirements of the Grant County Fire Marshal and shall be in compliance with Grant County Fire Flow guidelines, the Uniform Building Code, the Uniform Fire Code, and all other applicable requirements for fire protection and safety. 3) This proposal shall comply with all requirements deemed necessary by the Washington State Department of Health and the Washington State Department of Ecology in regards to domestic water supply, sewage systems, and storm water control and treatment including, but not limited to: RCW 90.48.080 (Discharge of Polluting Matter in Waters Prohibited), WAC 173-200 (Ground Water Quality Standards), WAC 173-201-A (Surface Water Quality Standards), and WAC 246-272 (On -Site Sewage Systems). Eric Walker Plat Alteration (Replat) - BoCC Resolution - page 2 IN THE MATTER OF APPROVING A PLAT ALTERATION OF - WALKER REPLAT LOT 14, THE EAST % OF LOT 15, THE W EST''% OF LOT 15, & LOT 16 OF MORGAN TRACTS, UNIT I. 4) If any Native American grave site(s) or archaeological/cultural resources (Indian artifacts) are found, all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, Colville Confederated Tribes, and the Washington State Office of Archaeology and Historic Preservation. 5) Approval of the requested Plat Alteration shall be contingent upon conformance with all applicable land use rules and regulations in effect at the time the applications were deemed Technically complete; that date being December 15, 2006 in this instance. 6) The applicant shall comply with all requirements as deemed necessary by the Grant County Health District, including, but not limited to: a) Final approval of the plat will not be given until a Site Registration for Lots 2, 3, and 4 is submitted to the Health District and all fees paid. b) Work must be done by a licensed septic system designer or engineer. c) The location of the well on each lot with a radius of 100 feet must be shown on the plat. 7) The applicant shall comply with all requirements as deemed necessary by the Grant County Public Works Department, including, but not limited to: a) Provide a plat review fee of $50.00. b) Provide a plat certificate from the title company for all land being dedicated to Grant County. C) An Approach Permit must be obtained for each lot prior to the issuance of a building permit. d) A hatched/shaded area shall be added to the inside southwest corner of Lot #2 and shall extend for 100 ft. in both directions from the road right-of-way intersection. This area shall be labeled "No Access." 8) The applicant shall comply with all requirements as deemed necessary by Grant County Emergency Services, including, but not limited to: a) Proponent will need to contact this office to establish new addressing. 9) The applicant shall comply with all requirements as deemed necessary by the City of Moses Lake, including, but not limited to: a) A covenant insuring future street, curb, sidewalk, gutter, sewer, and water infrastructure, built to city standards, shall be provided in favor of the City of Moses Lake. The covenant describing future streets will include all streets Eric Walker Plat Alteration (Replat) - BoCC Resolution - page 3 IN THE MATTER OF APPROVING A PLAT ALTERATION OF WALKER REPLAT LOT 14, THE EAST %: OF LOT 15, THE WEST % OF LOT 15, & LOT 16 OF MORGAN TRACTS, UNIT 1. internal and external to the plat and specifically those portions of Young Road and Morgan Road that front the plat. b) The language contained in GCC § 23.12.040 (e)(2) shall appear on the plat as a restriction. The code states, "No building or structure shall be located such that any building setback contained in Chapter 23.08 is violated at the time of redevelopment." c) The covenant running with the land shall be noted on the plat along with the Grant County Auditor's File Number. d) The redevelopment plan shall be recorded as a page of the plat. 10) The applicant shall comply with all requirements as deemed necessary by the Grant County Auditor, including, but not limited to: a) The name "Walker Replat" is approved. 11) The applicant shall comply with all requirements as deemed necessary by the WA State Dept. of Ecology (Spokane—SEPA Coordinator), including, but not limited to: a) Proper erosion and sediment control practices must be used on the construction site and adjacent areas to prevent upland sediments from entering surface water. All ground disturbed by construction activities must be stabilized. When appropriate, use native vegetation typical of the site. b) The use of chemically treated wood materials in or near water is regulated under WAC 220-110-060. The applicant should not use creosote or pentachlorophenal treated wood or painted wood for in or near -water construction. Naturally preserved woods such as cedar and redwood are the preferred option. c) Stormwater runoff may contain increased levels of grease, oils, sediment, and other debris. Stormwater Best Management Practices (BMP's) should be installed and maintained so that any discharge will be appropriately treated to remove these substances. d) Dumpsters and refuse collection containers shall be durable, corrosion resistant, nonabsorbent, non -leaking, and have close fitting covers. If spillage or leakage does occur, the waste shall be picked up immediately and returned to the container and the area properly cleaned. e) Routine inspections and maintenance of all erosion and sediment control Best Management Practices (BMP's) are recommended both during and after development of the site. OF LOT 15, & LOT 16 OF MORGAN TRACTS, UNIT 1. f) During construction, all release of oils, hydraulic fluids, fuels, and other petroleum products, paints, solvents, and other deleterious materials must be contained and removed in a manner that will prevent their discharge to waters and soils of the state. The cleanup of spills should take precedence over other work on the site. If the contractor does not know how to properly clean up a spill or wishes to check on approval of a clean up technique, he should call the Department of Ecology 24 -Hour Spill Response Program at (509)329-3400. 12) The applicant shall comply with all requirements as deemed necessary by the Grant County Planning Department, including, but not limited to: a) Development shall comply with the requirements of GCC § 22.04 Article V "Final Subdivisions and Short Subdivisions" and all other pertinent portions of Grant County Code. b) A restriction shall be recorded requiring the owner of Lot #1, or its subsequent owner(s), to agree to the completion and timely signing of Preliminary Plat 403- 3617. In the event that finalization of Preliminary Plat 403-3617 is not executed within required time -lines of Grant County Code, the owner(s) of Lot #1 shall be under no other obligation to #03-3617. FINDINGS OF FACT The Plat Alteration does meet the applicable requirements of UDC Chapter 22.04 "Subdivisions and Pas" 2. The Plat Alteration does serve the public use and interest; 3. The Plat Alteration does comply with the Comprehensive Plan, the Shoreline Master Program, the zoning code and other land use regulations, and SEPA; 4. The Plat Alteration does comply with Health District requirements for sewage disposal and potable water supply; 5. The Plat Alteration does contain an accurate legal description of the lots being created, and the roads and easements therein; 6. The Plat Alteration does comply with Grant County and, where applicable, all State Department of Transportation regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; The Plat Alteration does comply with all requirements of the United States Department of the Interior, the Department of Reclamation, and/or a recognized Irrigation District when the proposed preliminary is within the boundaries of an Irrigation District.
