HomeMy WebLinkAboutOrdinance 07-017-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON ORDINANCE: 07- 6 /1 -CC An ordinance relating to the amendment of Unified Development Code §24.12 Shorelines Program by changing a approx. 6 mile portion of the Moses Lake shoreline environments from a Rural to a Suburban Shoreline Designation. Recitals: WHEREAS, the Board of County Commissioners of Grant County intends to comply fully with the laws and regulations of the State of Washington, and; WHEREAS, the Board of County Commissioners of Grant County adopted a Growth Management Act compliant Comprehensive Land Use Plan in September of 1999, and; WHEREAS, the Board of County Commissioners of Grant County adopted a Unified Development Code implementing the Comprehensive Plan on October 1, 2000, and; WHEREAS, the Unified Development Code Chapter 25.12 "Legislative Action" provides a process for amending the Code, and; WHEREAS, T.D. Investments initiated an amendment, under Chapter 25.12 to the Unified Development Code amending Chapter 24.12 Shorelines Program. WHEREAS, the applicants requested a change to the shoreline designation of Rural to Suburban of an approximate 6 mile portion of Moses Lake located on the south side of Moses Lake from Rd R NE to and including parcel # 16-1667-000 as identified in Attachment 1; and; WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on December 6, 2006, on the matter of amending the Grant County Unified Development Code, and; WHEREAS, on December 6, 2006 the Grant County Planning Commission voted to recommend to the Board of County Commissioners, approval of the UDC Amendment as proposed by T.D. Investment, Andy Chen, Et al, received on July 28, 2006, and; WHEREAS, the Board of County Commissioners of Grant County held an open record public hearing on January 30, 2007, and; WHEREAS, the Board of County Commissioners have been advised by the Grant County Planning Department that the proposed UDC Amendment was processed in accordance with the requirements of UDC Chapter 25.12 "Legislative Action"; and, M ordinance relating to the amendment to the Unified Development Code of §24.12 Shoreline Program—Moses Lake. WHEREAS, the Board of County Commissioners have been advised by the Grant County Planning Department that the proposed UDC Amendment was processed in accordance with the requirements of UDC Chapter 24.04 "State Environmental Policy Act": and, WHEREAS, the Board of County Commissioners of Grant County have found that a Determination of Non -Significance and Adoption of Existing Environmental Documentation was issued for this proposal on November 3, 2006; and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan; and, WHEREAS, the Board of County Commissioners have received additional comments from Agencies of Jurisdiction during the open record public hearing; and, WHEREAS, the Board of County Commissioners has found that, the proposed UDC Amendment will serve the public use and interest. NOW, THEREFORE, the Board of County Commissioners of Grant County does hereby ordain amending the Grant County Unified Development Code in the manner as outlined in Attachment #1. BE IT FURTHER ORDAINED, the effective date of this ordinance shall be 5 p.m. of the date of signature. PASSED AND ADOPTED this _62_day of ' 2007.
