HomeMy WebLinkAboutResolution 07-012-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION: IN THE MATTER OF APPROVING A PRELIMINARY PLAT OF --175.5 ACRES INTO FIVE (5) LOTS FOR HENDRICKSON FAMILY LAND, LOCATED IN A PORTION OF S 15 & 22, T 21 N, R 28 E, WM, GRANT, WA RESOLUTION No. 2007-01Z CC APPROVING A PRELIMINARY PLAT OF HENDRICKSON ESTATES WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on December 6, 2006, on the matter of a preliminary plat of 175.5 -acres into five (5) lots; located in a portion of Section 15 & 22, Township 21 North, Range 28 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission did approve a motion to recommend to the Board of County Commissioners to approve the proposed preliminary plat with twelve (12) conditions of approval and twelve (12) findings of fact affirming the recommendation; and, WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on January 30, 2007: and, WHEREAS, the Board of County Commissioners, have reviewed the application material, staff report and Planning Commission minutes; and, WHEREAS. the Board of County Commissioners have found that the proposed subdivision will not adversely affect the health, safety, and general welfare of the public in the vicinity of the proposal: and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does meet the applicable requirements of Grant County Unified DeN clopment Code Chapter 22.04 "Subdivisions and Plats'; and, WHEREAS, the Board of Countv Commissioners have found that the proposed subdivision does serve the public use and interest; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with the Grant County Comprehensive Plan, the Shoreline r. IN THE MATTER OF APPROVING A HENDRICKSON FAMILY PRELIMINARY PLAT OF —175.5 ACRES INTO FIVE (5) LOTS Master Program, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with the Health District's requirements for sewage disposal and potable water supply; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does contain an accurate legal description of the lots being created, and the roads and easements therein; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision docs comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infi-asuucuire improvements; and, WHEREAS, the Board of County Commissioners have found that the "Best Available Science" has been considered in the final decision regarding the proposed subdivision; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with the requirements of the U.S. Department of Interior, Bureau of Reclamation and the East -Columbia Irrigation District; and, WHEREAS, the Board of County Commissioners have found that the phasing plan does include all land within the subdivision; and, WHEREAS, the Board of County Commissioners have found that the subdivision is an independent planning unit with safe and convenient circulation, and contains facilities and utilities that have been coordinated with the requirements established for the entire subdivision; and, WHEREAS, the Board of County Commissioners have found that all road improvement requirements are ensured pursuant to GCC § 22.04.450; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does appropriately identify and protect critical areas pursuant to GCC § 24.08; and, WHEREAS, the Board of County Commissioners have made a decision to approve the subject plat; and NOW, THEREFORE, BE IT RESOLVED THAT, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, with the conditions of approval listed below, a preliminary plat of -175.5 -acres into five (5) lots; located in a portion of Section 15 & 22, Township 21 North, Range 28 East, Willamette, Meridian, Grant County, Washington. Parcel No(s): 21-1747-000. IN THE MATTER OF APPROVING A HENDRICKSON FAMILY PRELIMINARY PLAT OF 175.5 ACRES INTO FIVE (5) LOTS CONDITIONS OF .APPROVAL: 1) Development shall be in compliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health District, by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to: RCW 90.48.080 Discharge of Polluting Water Prohibited: WAC 173-201. Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 3) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 4) Approval of the plat shall be contingent upon conformance with all applicable land use rules and regulations in effect as of November 28, 2006. 5) During road grading and/or construction activities, county roads shall be maintained clear of soil and rocks at the point of ingress / egress. 6) This proposal shall comply with the requirements of GCC 23.12.080 Clearing, Grading and Drainage Standards, including but not limited to: a) Clearing and grading activities shall be conducted so as to minimize potential adverse effects on offsite property. b) All development shall ensure that soil erosion and sedimentation of drainage - ways will be controlled to prevent damage to adjoining properties. c) Surface drainage shall not be directed to or discharged onto County Roads or ditches within County right-of-ways unless approved by the County Engineer. 7) Development shall comply with all requirements of the Grant County Public Works; including, but not limited to: a) Provide a plat review fee of S100.00 plus S2.00 a lot for a total of S 110.00. b) Provide a plat certificate from the Title Company for all land being dedicated to Gant County. c) An approach permit must be obtained prior to the issuance of a building permit. d) Lot 1 and Lot 3 must access off of Road 15 N.E. only. A note shall be added to the face of the plat addressing this. e) A hatched area shall be added to the face of the plat and labeled "No access" in the following areas: IN THE MATTER OF APPROVING A HENDRICKSON FAMILY PRELIMINARY PLAT OF —175.5 ACRES INTO FIVE (5) LOTS i) The southeast corner of Lot 1, on the inside if the lot line, extending for 100' in both directions. The width of this hatched area shall be 20'. ii) The northeast corner of Lot 3, on the inside of the lot line, extending for 100' in both directions. The width of this hatched area shall be 20'. 8) Development shall comply with all requirements of the Grant County Assessor; including, but not limited to: a) Clients most contact Assessor's office regarding status of current use continuance at least one (1) week before recording plat. 9) Development shall comply with all requirements of the Grant County Auditor; including, but not limited to: a) The Auditor's certificate needs to say "plat" instead of "short plat". 10) Development shall comply with all requirements of the Bureau of Reclamation; including, but not limited to: a) On Farm Unit 6 in Block 401 Southeast boundary is labeled incorrectly. The distance on the Short Plat shows 633.19' and as shown on the plat for Block 401 (sheet 6) the distance is 621.1'. 11) Development shall comply with all requirements of the East -Columbia Basin Irrigation District: including, but not limited to: a) The proponent shall construct or bond for an additional turnout to supply the portion of Farm Unit 6 lying south of Road 15 N.E. and build irrigation facilities to each of lots 2, 3, 4 and 5 before the District will sign the final plat. 12) Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a) Comply with all requirements listed in UDC Chapter 22.04 Article V Final Subdivisions and Short Subdivisions. b) Comply with all requirements listed in the SEPA Mitigated Determination of Non -Significance issued by Grant County on November 2, 2006. c) The north side of Lot 3 shall contain a 40 -foot special agricultural setback when including the right-of-way for Road 15 N.E. to the north for a total of a 100 -foot setback. d) The western boundary of lots 3, 4, and 5 shall contain a 100 -foot special agricultural setback. e) The eastern boundary of lots 3, 4, and 5 shall contain a 20 -foot special agricultural setback when including the right-of-way for Stratford Road. f) The southern boundary of Lot 5 shall contain a 70 -foot special agricultural setback when including USBR right-of-way. g) Pursuant to GCC 23.12.075(e)(8) the following notation shall be placed on the face of the plat: "Lot 1 may not be further subdivided; nor may a dwelling unit be permitted on it." h) Pursuant to GCC 23.12.075(e)(14) lots 3, 4, and 5 shall be served by not more than one common access point to an existing county right-of-way.
