HomeMy WebLinkAboutResolution 07-108-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION: IN THE MATTER OF APPROVING A PUD PRELIMINARY SUBDIVISION OF 267 -ACRES KNOWN AS THE POTHOLES GOLF AND RV RESORT FOR DOUG LAKMAN AND THE POTHOLES LLC, LOCATED IN A PORTION OF SECTION 18, TOWNSHIP 17 N., RANGE 28 E., W.M., GRANT COUNTY, WA. RESOLUTION N. 2007- 10�CC APPROVING A PUD PRELIMINARY PLAT OF POTHOLES GOLF RESORT WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on June 6, 2007, on the matter of a preliminary PUD Subdivision of —267 -acres into 190 single family residential lots, 28 park model/residential lots, 23 RV rental lots, 30 park model lots, 40 condo units, 36 RV/condo units, and 323 RV lots. Also included, are an expansion of an existing 9 -hole golf course to 18 -holes, and the construction of a restaurant, clubhouse/pro-shop complex, and additional recreational areas; located in a portion of Section 18, Township 17 :North, Range 28 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission did approve a motion to recommend to the Board of County Commissioners to approve the proposed Preliminary PUD Subdivision with nineteen (19) conditions of approval and sixteen (16) findings of fact in the affirmative; and, WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on July 11, 2007; and, WHEREAS, the Board of County Commissioners, have reviewed the application material, staff report and Planning Commission minutes; and, WHEREAS, the Board of County Commissioners have found that the PUD Subdivision will not adversely affect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the PUD Subdivision does comply with the Grant County Comprehensive Plan, the Shoreline IN THE MATTER OF APPROVING A PUD SUBDIVISION OF —267 ACRES INTO THE POTHOLES GOLF AND RV RESORT POTHOLES RESERVOIR GOLF RESORT LLC AND DOUG LAKMAN Master Program, the Unified Development Code, Chapter 23.04 "Zoning", Chapter 22.04 "Subdivis ions and Plats", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the PUD Subdivision does serve the public use and interest, and, WHEREAS, the Board of County Commissioners have found that the PUD Subdivision does comply with the Health District's requirements for sewage disposal and potable water supply, and, WHEREAS, the Board of County Commissioners have found that the PUD Subdivision does contain an accurate legal description of the lots being created, and the roads and easements therein; and, WHEREAS, the Board of County Commissioners have found that the PUD Subdivision does function as a single site with respect to, but not limited to, access, interior circulation, open space, landscaping, drainage facilities, facility maintenance and parking; and, WHEREAS, the Board of County Commissioners have found that the PUD Subdivision does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Board of County Commissioners have found that the "Best Available Science" has been considered in the final decision regarding the PUD Subdivision; and, WHEREAS, the Board of County Commissioners have found that the PUD Subdivision is consistent in design, character and appearance with the goals and policies for the zoning district in which the proposal is located; and, WHEREAS, the Board of County Commissioners have found that the characteristics of the PUD Subdivision will be reasonably compatible with the types of uses permitted in surrounding areas; and, WHEREAS, the Board of County Commissioners have found that the PUD Subdivision will not create undue noise, odor, heat, vibration, air or water pollution impacts on surrounding existing or potential dwelling units; and, WHEREAS, the Board of County Commissioners have found that the PUD Subdivision will not materially endanger the health, safety and welfare of the community; and, File #07-4754 / Final Decision 2 IN THE MATTER OF APPROVING A PUD SUBDIVISION OF —267 ACRES INTO THE POTHOLES GOLF AND RV RESORT POTHOLES RESERVOIR GOLF RESORT LLC AND DOUG LAKMAN WHEREAS, the Board of County Commissioners have found that the PUD Subdivision is such that pedestrian and vehicular traffic associated with the use will not be hazardous or conflict with existing and anticipated traffic in the local area, and, WHEREAS, the Board of County Commissioners have found that the PUD Subdivision does include evidence of availability of adequate public services and facilities, including access, fire protection, storm water control, and sewage disposal facilities; and, WHEREAS, the Board of County Commissioners have found that the location, size and height of buildings, structures, walls and fences and screening vegetation for the PUD Subdivision shall not hinder or discourage the appropriate development or use of neighboring properties; and, WHEREAS, the Board of County Commissioners have found that the impacts on the long-term natural resource management of adjacent lands zoned as Agriculture will be minimized; and, WHEREAS, the Board of County Commissioners have found that the PUD Subdivision will not cause significant adverse impacts on the human or natural environments that cannot be mitigated by conditions of approval; and, WHEREAS, the Board of County Commissioners have found that the proposed land uses, activities, and structures do comply with applicable development standards of GCC 23.12 and performance standards specified in GCC 23.08, and with any required mitigation measures, and, WHEREAS, the Board of County Commissioners have found that the PUD Subdivision does appropriately identify and protect critical areas, archaeological and historic resources, and visual and aesthetic resources, and environmental considerations are employed in the design, placement and screening of facilities and amenities, and, WHEREAS, the Board of County Commissioners have made a decision to approve "The Potholes Golf Resort." NOW, THEREFORE, BE IT RESOLVED THAT, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, with the conditions of approval listed below, a PUD Preliminary Subdivision of —267 -acres into 190 single family residential lots, 28 park model/residential lots, 23 RV rental lots, 30 park model lots, 40 condo units, 36 RV/condo units, and 323 RV lots. Also included, are an expansion of an existing 9 -hole golf course to 18 -holes, and the construction of a restaurant, clubhouse/pro-shop complex, and additional recreational areas; located in a portion of Section 18, Township 17 North, Range 28 East, Willamette Meridian, Grant County, Washington. File #074754 / Final Decision 3 IN THE MATTER OF APPROVING A PUD SUBDIVISION OF —267 ACRES INTO THE POTHOLES GOLF AND RV RESORT CONDITIONS OF APPROVAL: POTHOLES RESERVOIR GOLF RESORT LLC AND DOUG LAKMAN 1) Development shall be in compliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health District, by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90 48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards, and, WAC 246-272, On -Site Sewage Systems. 3) Proposal shall comply with all requirements of the Grant County Fire Marshal and shall comply with the Grant County Fire Flow Guidelines, the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection and life safety. 4) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 5) Approval of the PUD Subdivision shall be contingent upon conformance with all applicable land use rules and regulations in effect as of May 21, 2007. 6) During road grading and/or construction activities, county roads shall be maintained clear of soil and rocks at the point of ingress / egress. 7) This proposal shall comply with the requirements of GCC 23.12.080 Clearing, Grading and Drainage Standards, including but not limited to: a) Clearing and grading activities shall be conducted so as to minimize potential adverse effects on offsite property. b) All development shall ensure that soil erosion and sedimentation of drainage -ways will be controlled to prevent damage to adjoining properties. c) Surface drainage shall not be directed to or discharged onto County Roads or ditches within County right-of-ways unless approved by the County Engineer. 8) This proposal shall comply with the requirements of GCC 23.12.100 Road Standards, including but not limited to: File #074754 / Final Decision IN THE MATTER OF APPROVING A PUD SUBDIVISION OF —267 ACRES INTO THE POTHOLES GOLF AND RV RESORT POTHOLES RESERVOIR GOLF RESORT LLC AND DOUG LAKMAN a) County and Private road names shall be approved by the Grant County Emergency Services Department and addressing shall be established using the addressing and grid system delineated in GCC 10.36. 9) Development shall comply with all requirements of the Grant County Health District. 10) Development shall comply with all requirements of the Grant County Auditor. 11) Development shall comply with the requirements of the WA State Department of Health regarding approval of a community water system and a community waster water treatment system. 12) Development shall comply with all requirements of Grant County Assessor's Office including, but not limited to; a) The subtitle shall be amended to include the Farm Units involved in this proposal. b) The subtitle shall be consistent on all pages. c) Segregation/Boundary Line Adjustment application #488 currently on file with the Assessor's office shall be canceled. d) The legal description shall be amended to reflect changes in boundary of subdivision. 13) Development shall comply with all requirements of Grant County's Public Works Department including, but not limited to; a) A plat review fee of $200 shall be provided. b) The applicant shall contact the Washington State Department of Transportation in regards to access on the state highway. 14) Development shall comply with all requirements of Grant County Public Utility District including, but not limited to, a) The following note shall be added to the face of the plat: "All lots are subject to a public utility easement 5' in width on all interior lot boundaries and 10' in width on all exterior lot boundaries." 15) Development shall comply with the requirements of the WA State Department of Transportation including, but not limited to; a) The developer shall donate a 10 -foot strip of land along SR 262 for right of way purposes and to accommodate future tum land improvements. The donation shall be shown on the final plat b) The shoulder width on SR 262 along the length of the project shall be increased to 6 feet to accommodate pedestrian traffic. c) The developer shall provide an updated Traffic Impact Analysis, which shall include a right tum analysis and propose mitigation for right turn improvements at the 2 new connection locations. d) The NW access of the development shall be constructed in Phase 1. File #07-4754 / Final Decision 5 IN THE MATTER OF APPROVING A PUD SUBDIVISION OF —267 ACRES INTO THE POTHOLES GOLF AND RV RESORT POTHOLES RESERVOIR GOLF RESORT LLC AND DOUG LAKMAN e) A Reimbursable Agreement to cover state related expenses for real estate services, engineering and inspection is required. I) Access connection permits are required. 16) Development shall comply with the requirements of the US Bureau of Reclamation and the Quincy -Columbia Imgation District. 17) Appropriate and adequate Utility and Access Easements shall be noted and/or identified on the plat for including, but not limited to, public utilities, septic drain field areas, sewer lines, water lines, private roads, and access easements for all lots not fronting a private or county road. 18) Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a) Comply with all requirements listed in UDC Chapter 22.04 Article V Final Subdivisions and Short Subdivisions. b) Comply with all requirements listed in the SEPA Mitigated Determination of Non -Significance issued by Grant County on May 22, 2007. c) Pursuant to the requirements of GCC 22.04 Final Subdivisions, the Final Plat Map shall include the following: 1) Legend, 2) The boundary lines, including bearings and distances, of the proposed subdivision and each lot contained therein drawn to scale; 3) The name of all streets within and adjoining the subdivision and showing right-of-way and centerline dimensions, 4) Identification of areas to be dedicated; 5) All section, township, range and county lines lying within or adjacent to the subdivision; 6) The location of all monuments, markers and other evidence used to establish the subdivision boundaries together with statement of datum relied upon; 7) The location of all permanent control monuments found and established within the subdivision; 8) The boundaries of the subdivision, including bearings and distances, and including a legend denoting the source of all bearings used; 9) The bearings, distances, curve data and other data necessary for the location of any block or lot line; 10) A designation of any lot that never can contain a dwelling or building unit or that is otherwise undevelopable, 11) A certificate, seal, date and signature of the registered land surveyor who made, or under whose supervision was made, the survey of the subdivision, in substantially the following language: registered as a land surveyor by the State of Washington, certify that this plat is based on an actual survey of the land described herein, conducted by me or under my supervision, during the period of 20 , through 20 ; that the distances, bearings and angles are shown thereon correctly, and that monuments other than those File #074754 / Final Decision 6 IN THE MATTER OF APPROVING A POTHOLES RESERVOIR GOLF PUD SUBDIVISION OF —267 ACRES RESORT LLC AND DOUG INTO THE POTHOLES GOLF AND LAKMAN RV RESORT monuments approved for setting at a later date, have been set and lot corners staked on the ground as depicted on the plat." 12) A plat certificate conforming to the requirements of RCW 58.17.165; and 13) Signature blocks for the following entities: (A) County Engineer, (B) County Auditor; (C) County Assessor; (D) County Treasurer; (E) County Planning Director; (F) County Fire Marshall/Building Official; (G) County Sanitarian; and (H) U.S. Department of the Interior, Bureau of Reclamation and Imgation District when subdivision is located within the boundaries of the Columbia Basin Irrigation Project; (I) Clerk of the Board of County Commissioners; and (J) Chairperson, Grant County Board of Commissioners; The signature blocks for each of the signatories shall be in a form and contain language specified by the signatory. d) The boundary of the subdivision shall be decreased to exclude all of parcels #07-1331-418 through 07-1331-443. e) The title block shall be corrected to identify section, township and range information. f) Pursuant to the requirements of GCC § 23.04.080, the language for the Right to Farm Disclosure as specified in 23.04.080(d)(1) shall be recorded on the face of the plat. g) Pursuant to the requirements of GCC § 22.04.390 the appropriate dedications shall be made for public streets and right-of-ways. h) Pursuant to GCC § 22.04.390(d), the dedications as outline in 1-6 shall be provided on the face of the plat. i) All potable water and wastewater treatment facilities shall be approved by the WA State Department of Health, and shall coincide with the materials submitted by the applicant for review. 19) All lots in the Potholes RV and Resort PUD Subdivision shall be served by a community sewer wastewater treatment system.
