GRANT COUNTY, WASHINGTON
RESOLUTION NO.
A Resolution Amending Resolution No 05 -267 -CC for Comprehensive
Planning in Grant County in Accordance with the Washington State Growth
Management Act (RCW36.70 A)
WHEREAS, in 1990, the Washington State Legislature passed and the Governor signed
into law the Growth Management Act (GMA) as contained in SHB No 2929
(Washington Laws, 19901st Ex Sess., Ch 17), which was subsequently codified as
among other chapters, Chapter 36 70 A RCW; and
WHEREAS, the Washington State Growth Management Act requires all counties and
cities in the State to do some planning and the fastest growing counties and cities with
them, to plan extensively in keeping with state goals and policies on sprawl reduction,
affordable housing, economic development, open space and recreation, regional
transportation, environmental protection, property rights, natural resource industries,
historic lands and buildings, permit processing, public facilities and services, and early
and continuous public participation, and
WHEREAS, the Washington State Growth Management Act requires all counties and
cities within the state to classify, designate, and conserve natural resource lands
(agricultural and mineral) and protect critical areas (wetlands, geologically hazardous
areas, fish and wildlife habitat conservation areas, aquifer recharge areas, and frequently
flooded areas); and
WHEREAS, Chapter 36 70 RCW required Grant County to adopt a Comprehensive Plan
that met specified GMA goals and addressed the mandated GMA elements; and
WHEREAS, after complete review and public record of the State Environmental Review
process, the Grant County Planning Commission issued a Final Environmental Impact
Statement on July, 2, 1999, and subsequent addendums through 2004 and;
WHEREAS, over the past years, the Comprehensive Plan's policies may have changed
to insure that the development patterns in the County remain consistent with the intent of
the communities' vision for the future and the Plan's goals and policies, and

WHEREAS, it is important that amendments to this plan retain the broad perspectives
articulated in the community vision statements, satisfies the goals and policies of this
Plan, and remain consistent with the intent of the GMA; and
WHEREAS, the Growth Management Act (GMA) establishes procedures for the review
and amendment of Comprehensive Plans governing counties and cities planning under
the Act; and
WHEREAS, the county has established a public participation program ideritifying
procedures whereby proposed amendments or revisions of the Comprehensive Plan are
considered by the governing body of the County no more frequently than once every
year, and
WHEREAS, amendments to the Comprehensive Plan fall into several major categories
or types and different review application and review criteria apply to each. The kinds of
amendments identified herein include:
Urban Growth Area Boundary Changes;
• Plan policy or text changes;
• Plan Map changes;
• Supporting document changes; emergency amendments, and
• Site-specific amendments, and
WHEREAS, policy amendments may be initiated by the County or by other entities,
organizations or individuals through petition; and
WHEREAS, petitions were received on forms provided by the Department, containing
appropriate maps showing the proposed change and addressing the policy or map
evaluation criteria as described in the Comprehensive Plan; and
WHEREAS, a public meeting was held on September 17, 2004, by the Grant County
Board of Commissioners in compliance with Section 25 12.030, Grant County Unified
Development Code for the purpose of considering the Planning Department staff
recommendation for each of the individual submitted proposed amendments to the
Comprehensive Plan and determine whether to initiate the plan amendment review
process for each proposal; and
WHEREAS, after receiving testimony from citizens and staff at the public meeting, the
motion was made, seconded and unanimously approved to recommend staff initiate the
SEPA review process and schedule each of the amendments proposed, along with staff
recommendations before the Planning Commission for public hearing; and

WHEREAS, a public hearing was conducted by the Planning Commission on April 27,
2005 and continued to May 04, 2005 to hear staff recommendations and take public
testimony on each of the proposed amendments to the Grant County Comprehensive
Plan; making recommendations and listing Findings of Fact on each amendment, and,
WHEREAS, the Planning Commission used Grant County Code (GCC) Chapter 25.12
and evidence along with the redesignation requirements, the Planning Commission
unimously recommended denial of File No. 2004-01, submitted by Larry and Preta
Laughlin for a land use re -designation from Agricultural Resource to Master Planned
Resort, and,
WHEREAS, the Planning Commission staff reports and recommendations were made a
part of the record of this public hearing as it relates to SEPA and the attached
amendments
WHEREAS, copies of this EIS Addendum were distributed to agencies, organizations
and individuals listed on the Planning Department distribution list and requesting that
comments be submitted in accordance with WAC 197-11-340 (2), and;
WHEREAS, the Board of County Commissioners for Grant County adopted the
Findings of Fact and the attached record pertaining to the approval or denial of the 2004
Comprehensive Plan amendments; and
WHEREAS, said Resolution 05 -267 -CC was signed by the Board of County
Commissioners on August 1, 2005
WHEREAS, among those items approved was 2004-01, a site specific land use re-
designation, and Master Plan for a Master Planned Resort submitted by Larry and Preta
Laughlin, Quincy, for the location and operation of a water ski lake with boat launch and
amenities to include 7 single family residential units, 2 town houses, 6 RV sites, a sports
court, a 2,500 square foot pro shop and store, with a shower facility, 6 sites for park
model RV's, an area designated for future commercial development which may have
been used to accommodate a bed and breakfast or eating establishment, a camping area
and additional amenities including jogging trails, a sport court, a beach volleyball court,
swimming and picnic areas and a putting green.
WHEREAS, the action by the Board of County Commissioners was challenged by the
Friends of Agriculture on October 3, 2005 to the Eastern Washington Growth
Management Hearings Board who filed 05-0010 Petition for Review, and;
WHEREAS, the Growth Management Hearings Board found that Grant County failed to
protect agricultural land of long-term commercial significance, failed to assure the
conservation of agricultural resource land and allowed for the conversion of agricultural
lands in a manner that interferes with the continued use of designated lands for the

production of food and/or agricultural products, and failed to follow the requirements for
designation of "Master Planned Resorts.
WHEREAS, the Growth Management Hearings Board also determined that Grant
County is out of compliance by Adopting Resolution No. 05 -267 -CC, which substantially
interferes with the fulfillment of the goals of the GMA, The Board finds the Board of
County Commissioners action invalid, and,
WHEREAS, the Growth Management Hearings Board issued their Final Decision and
Order on March 14, 2006,
NOW THEREFORE, BE IT RESOLVED, in the spirit of cooperation with the
decision made by the Eastern Washington Growth Management Hearings Board, that the
Board of County Commissioners for Grant County, does hereby rescind its approval of
Comprehensive Plan amendment 2004-01 submitted by Larry and Preta Laughlin from
Resolution No 05 -267 -CC adopted by the Board of County Commissioners and hereby
re-establishes the land use designation to "Irrigated Agriculture".
