HomeMy WebLinkAboutResolution 05-273-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION: I RESOLUTION No. 2005.::7773CC IN THE MATTER OF APPROVING A PRELIMINARY BINDING SITE PLAN APPROVING A PRELIMINARY OF —202 45 -ACRES INTO FORTY-ONE BINDING SITE PLAN LOTS LOCATED IN A PORTION OF I SECTION 04, TOWNSHIP 20 NORTH, NORTH GATEWAY CENTER RANGE 28 EAST, WM GRANT CO. WA BINDING SITE PLAN WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on July 6, 2005, on the matter of a preliminary Binding Site Plan of 202.45 -acres into forty-one (41) lots, located in a portion of Section 4, Township 20 North, Range 28 East, Willamette Meridian, Grant County, Washington (parcel #17- 0150-012, 17-0150-004, and 17-0147-000), and, WHEREAS, the Grant County Planning Commission on July 6 did approve a motion to recommend to the Board of County Commissioners to approve this proposed preliminary plat with eleven (11) suggested conditions of approval; and, WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on August 16, 2005; and, WHEREAS, the Board of County Commissioners, have reviewed the application file, staff report and Planning Commission minutes, and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the preliminary binding site plan; and, WHEREAS, the proposed preliminary binding site plan meets the applicable requirements of Unified Development Code, Chapter 22.04 "Land Division'; and, WHEREAS, the proposed preliminary binding site plan does comply with the Health District's requirements for sewage disposal and potable water supply; and, IN THE MATTER OF APPROVING A NORTH GATEWAY CENTER PRELIMINARY BINDING SITE PLAN PRELIMINARY BINDING OF —202 45 -ACRES± INTO SITE PLAN FORTY-ONE (41) LOTS WHEREAS, the proposed preliminary binding site plan does contain an accurate legal description of the lots being created, and the roads and easements therein; and, WHEREAS, the proposed preliminary binding site plan does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Board of County Commissioners have made a decision to approve the North Gateway Center preliminary binding site plan. NOW, THEREFORE, BE IT HEREBY RESOLVED THAT, the Board of County Commissioners for Grant County, Washington approve by this Resolution, with the twelve (12) conditions of approval listed below, a preliminary binding site plan of —202 45 -acres into forty-one (41) lots; located in a portion of Section 04, Township 20 North, Range 28 East, Willamette Meridian, Grant County, Washington (parcel #17- 0150-012, 17-0150-004, and 17-0147-000); CONDITIONS OF APPROVAL: 1) Development shall be in compliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health District, by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to, RCW 90 48 080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 3) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 4) Approval of the binding site plan shall be contingent upon conformance with all applicable land use rules and regulations in effect as of June 20, 2005. 5) During road grading and/or construction activities, county roads shall be maintained clear of soil and rocks at the point of ingress and egress. 6) Pursuant to GCC 23.04.645(n), the landowner shall record on the face of the Binding Site Plan the approved Grant County Airport Avigahon and Hazard Easement language. IN THE MATTER OF APPROVING A NORTH GATEWAY CENTER PRELIMINARY BINDING SITE PLAN PRELIMINARY BINDING OF —202.45 -ACRES± INTO SITE PLAN FORTY-ONE (41) LOTS 7) This proposal shall comply with the requirements of GCC 23.12 080 Clearing, Grading and Drainage Standards, including but not limited to: a) Clearing and grading activities shall be conducted so as to minimize potential adverse effects on offsite property. b) All development shall ensure that soil erosion and sedimentation of drainage -ways will be controlled to prevent damage to adjoining properties c) Surface drainage shall not be directed to or discharged onto County Roads or ditches within County right-of-ways unless approved by the County Engineer. 8) This proposal shall comply with the requirements of GCC 23.12.100 Road Standards, including but not limited to: a) Road names shall be approved by the Grant County Emergency Services Department and shall be established using the addressing and grid system delineated to GCC 10.36, 9) Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a) Comply with all requirements listed in UDC Chapter 22 04. b) Comply with all requirements listed in the SEPA Mitigated Determination of Non -Significance issued by Grant County on June 16, 2005. c) All subdivisions within the binding site plan shall be numbered 1 through 41 and referred to as lots and not pads. d) The signature lines shall be corrected to reflect Grant County Departments/Officials. e) In addition to the sidewalks constructed by Grant County Public Works the applicant shall construct sidewalks on both sides of all roads internal to the proposal including that portion of the east side of Patton Boulevard that abuts and is adjacent to the project area f) Add the following "block" of information to the final plat. Zoning: Urban Commercial 1 DU Density: None Overall acreage: 202 Number of Lots: 41 Roads Dedicated: ? 10) Development shall comply with the requirements of the Grant County Fire MarshallBuilding Official including, but not limited to: a) In respect to future development on the lots, commercial projects require water availability for fire suppression purposes. 11) Development shall comply with the requirements of the WA State Department of Ecology's Water Quality and Solid Waste Programs. IN THE MATTER OF APPROVING A NORTH GATEWAY CENTER PRELIMINARY BINDING SITE PLAN PRELIMINARY BINDING OF 202.45-ACRESt INTO SITE PLAN FORTY-ONE (41) LOTS 12) Development shall comply with the requirements of the Grant County Public Works Department including, but not limited to: b) The applicant shall provide a Plat check fee of $100.00 plus $2.00 a lot for a total of $182.00. c) The developers of lots 7,8, 19, 20, and Pads 18, 19 will be required to install curb, gutter and sidewalk to match existing infrastructure. d) Lot 11 does not appear to be included on page 4 of 5. This sheet shall be corrected to address this. e) The right-of-way for Patton Blvd does not appear to be the correct width; this shall be verified and corrected f) An approach permit must be obtained for each lot and pad prior to issuance of a Building Permit. g) The extension of ASPI Blvd requires the submission of a complete plan and profile including provision to handle drainage. h) Detail "A" on sheet I of 5 and 4 of 5 appear to conflict. This conflict shall be clarified. i) The Detail "A" on sheet 3 of 5 is incorrectly labeled. The detail does not give adequate information as to what the line overlapping the nght-of-way line is. This line shall be defined. I) A plat certificate form the Title Company shall be provided for all lands being dedicated to Grant County. k) Pads 3, 4, 5, 6, and 9 shall not have direct access to Patton Blvd. These lots shall have internal plat access to other County Roads.
