A REPLAT OF LOT #3 OF THE SOIL SPRAY SHORT PLAT, PHASE 3 William Johnson Replat IN A PORTION OF SECTION 24, TOWNSHIP 19 N, RANGE 27 EWM, GRANT COUNTY, WASHINGTON WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on September 7, 2005, on the matter of creating two (2) lots from Lot #3 of the Soil Spray Short Plat, Phase 3, located in a portion of Section 24, Township 19 N., Range 27 EW M., Grant County, Washington (Parcel Number 13-1823-000) and; WHEREAS, the Grant County Planning Commission on September 7, 2005, made a unanimous recommendation for approval to the Board of County Commissioners, and; WHEREAS, the Grant County Board of County Commissioners held a closed record public hearing on, , 2005, and; WHEREAS, the Board of County Commissioners have made a decision to uphold the recommendation to approve the proposed plat alteration contingent upon conformance with the) conditions of approval listed herein and in the staff report presented by the Project Planner, and, WHEREAS, the Board of County Commissioners have been advised by the Planning Department that the subject parcel currently is vacant, and, WHEREAS, the Board of County Commissioners have been advised by the Planning Department that the subject replat application was processed in accordance with the requirements of the Grant County Code, Chapter 22.04 "Subdivisions and Plats," Chapter 23.12 "Development Standards," and Chapter 25.04 "Permit Application Review Procedures," and, WHEREAS, the Board of County Commissioners have been advised by the Planning Department that pursuant to Grant County Code, Chapter 24 08, critical areas review was performed and that the subject parcel does not appear to lie in any designated areas and, WHEREAS, the Board of County Commissioners has found that the subject proposal lies in the Rural Residential 1 Comprehensive Plan Land Use Designation and thus is consistent with the underlying zoning district as required by Grant County Code and RCW 36 70A and, Page I of 4 IN THE MATTER OF APPROVING A PRELIMINARY PLAT ALTERATION OF LOT 3, PHASE 3 SOIL SPRAY SHORT PLAT, WILLIAM JOHNSON WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the replat; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal, and, NOW, THEREFORE, BE IT HEREBY RESOLVED THAT the Board of County Commissioners for Grant County, Washington, approves by this Resolution, a plat alteration to create two (2) lots from Lot 3, of the Soil Spray Short Plat, Phase 3 located in a portion of the South half of Section 24, Township 19N., Range 27 EW M., Tax Parcel 31-1823-000. CONDITIONS OF APPROVAL: 1) The Proposal shall be in compliance with the Grant County Comprehensive Plan, the Grant County Unified Development Code, the Growth Management Act, the Washington State Environmental Policy Act, the Grant County Unified Development Code, the Grant County Resource Lands and Critical Areas Development Ordinance and all other applicable federal, state, and local regulations, rulings or requirements.. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48 080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards, and, WAC 246-272, On -Site Sewage Systems. 3) Proposal shall comply with all requirements of the Grant County Fire Marshal and shall comply with the Grant County Fire Flow Guidelines, the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection 4) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found, all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribe, and the Washington State Office of Archaeology and Historic Preservation. S) Preliminary Re -plat approval shall be contingent upon conformance with all applicable land use rules and regulation in effect per the Unified Development Code 6) Development shall comply with Grant County Unified Development Code Chapter 22.04 Article 5 "Final Subdivisions and Short Subdivisions " A) Applicant shall provide a corrected Title Report, with the correct owner's name and Legal Description Page 2 of 4 IN THE MATTER OF APPROVING A PRELA41NARY PLAT ALTERATION OF LOT 3, PHASE 3 SOIL SPRAY SHORT PLAT . WILLIAM JOHNSON 7) Development shall comply with all requirements of the Grant County Auditors office. 8) Development shall comply with all requirements of the Grant County Public Works Department including but not limited to. A) Provide replat check fee of $100.00 B) Provide a plat certificate from the Title company for land being dedicated to Grant County. C) An approach permit must be obtained prior to the issuance of a building permit. D) The north boundary of this plat appears to run along the east -west mid-section line. A 30' future County Road easement shall be added to the face of the plat to accommodate future county roads. E) A 60' future County road easement along the west boundary of Lot #1 shall be Added to the face of the plat to accommodate future county roads. FINDINGS OF FACT Pursuant to GCC § 22.04.250, the Board of County Commissioners has considered the following Findings of Fact in making its decision to approve this proposed preliminary replat as recommended by the Planning Commission in open record public hearing held on September 7, 2005. 1) Does/) meet the applicable requirements of Chapter 22.04; and, 2)oes serve the public use and interest, and, 3) Does comply with the Comprehensive Plan, the Zoning Code and other land use regulations, and SEPA; and, 4)Moes) comply with health requirements for sewage disposal and potable water supply; and, 5} Doescontain an accurate legal description of the lots being created, and the roads and easements therein; and, 6)(Roes comply with Grant County and, where applicable, State Department of Transportation regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements.
