ORDER GRANTING VACATION WHEREAS, The Board of County Commissioners of Grant County, Washington, considered a certain county road right-of-way useless, and by this resolution entered upon it's minutes, declared its intention to vacate and abandon a certain county road nght-of-way described as follows Legal Description. That portion of the dedicated Crescent Bar Road, Road 737, established by Order to Road Supervisor to Open Road dated May 31, 1910 See Exhibit A attached Lying within the property boundary of the parcel of land described as That Portion of Government Lot 3, Section 18, Township 20 North, Range 23 East, W M, Grant County, Washington Tax Parcel Number 15-0631-000 See Exhibit B attached WHEREAS, a notice of hearing on the report for vacation and abandonment was published in the county official newspaper at least once a week for two consecutive weeks preceding the date fixed for the hearing, and a copy of said notice was posted for at least twenty days preceding the date fixed for hearing at each termini of the county road or portion thereof to be vacated or abandoned, and WHEREAS, the Board of County Commissioners did consider the report given by the County Road Engineer, together with any evidence for or objection against said vacation and abandonment, and WHEREAS, the above described county road right-of-way is not useful as part of the county road system and the public will be benefited by the vacation and abandonment WHEREAS, said vacation is contingent upon the proponent establishing the new public access corridor as a public easement or dedicated to a willing public entity and the proponent constructs the trail link as required in the plat approval for Crescent Bay Resort If the proponent fails to accomplish this then the vacation action shall be null and void NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners vacates and abandons all interest in the County road right-of-way described above, EXCEPT an easement along the vacated right-of-way to accommodate existing power lines, communications lines and other franchised and/or permitted public and private utilities 1194334 111111IIIII IIIII111111 IIIII 11111111111 mIlli 111100/27/2000 Grant Coe2:i ea GRANT COUNTY COMMISS OR 0.00 iiud to F$ &,d6- "Woe t Deborah Kay a (Member) ATTEST-/��L,f,Xk Clerk of the toard Richard Stevens (Chair) fl&-�'x- (e/a-G LeRoy Allison (Member) Constituting the Board of County Commissioners of Grant County, Washington 0 0 Exhibit A Vacation Legal Description This description is to vacate that portion of the County Road as filed the 1910 Trinidad -Crescent County Road Bond No 739 Grant County by the Feb 14, 1910 Petitioner's Bond, lying in Government Lot 3 of Section 18, T20N, R23E Grant County, Washington and being a portion of that property as described under Grant County Auditor 41074975, described as follows: Beginning at the W '/4 comer of the said Section 18 which lies a distance of 147.74 feet S00007'32"W from a found 3" PUD brass cap monument marked "M174E", thence from the said W 1/4 corner N85°34'35"E along the North boundary of the said Government Lot 3 a distance of 308.20 feet, thence S31°17'53"E a distance of 27.34 feet to a found 3" PUD brass cap marked "M172E", thence continuing S31°17'53"E a distance of 6.31 feet to a point that lies 30.00 feet Southerly from the North boundary line of the said Government Lot 3, thence N85°34'35"E parallel to the North line of the said Government Lot a distance of 280.60 feet to the Westerly R/W line of the said 40.00 foot County Road and a point on a curve whose radial line bears 58391'48"W, thence along the said curve whose radius is 194.56 feet Southeasterly through a central angle of 02°03'52" for a distance of 7.01 feet to the P.T. of the said curve, thence along the said Westerly R/W line SO4°24'20"E 2.99 feet to the point of beginning of this description and a point lying 40.00 feet measured at right angles from the North line of the said Government Lot 3, thence N85°34'35"E 40.00 feet to the Easterly R/W line of the said County Road, thence along the said Easterly R/W line SO4024'20"E 197.02 feet to the P.C. of a curve right whose radius is 582.74 feet, thence along the said curve right through a central angle of 20'09'10" for a distance of 204.97 feet to the P.T. of the said curve, thence S15°44'50"W 95.39 feet to the Southwest line of that parcel as described under Auditor #1074975, thence along the said Southwest line of the said parcel N3 1017'53"W 54.65 feet to the Westerly line of the said 40.00 foot R/W, thence along the County Road R/W N15044'50"E 58.15 feet to the P.C. of a curve left whose radius is 542.74 feet, thence along the said curve through a central angle of 20'09'10" for a distance of 190.90 feet to the P.T. of the said curve, thence N04°24'20"W 197.01 feet to the point of beginning and the end of this description.
