HomeMy WebLinkAboutResolution 06-164-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION: IN THE MATTER OF APPROVING A PRELIMINARY PLAT OF A 4.67 ACRES INTO EIGHT (8) LOTS FOR EDDIE E. & SHIRLEY SMITH, LOCATED IN A PORTION OF S 12, T 18 N, R 22 E., W.M., GRANT, WA RESOLUTION No. 200646jkC APPROVING A PRELIMINARY PLAT SMITH'S COLUMBIA RIVER VIEW ESTATES WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on April 5, 2006, on the matter of a preliminary plat of 4 67 acres into eight lots; located in a portion of Section 12, Township 18 North, Range 22 East, Willamette Meridian, Grant County, Washington, and, WHEREAS, the Grant County Planning Commission did approve a motion to recommend to the Board of County Commissioners to approve the proposed preliminary plat with twelve (12) conditions of approval and eight (8) findings of fact in the affirmative; and, WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on May 15, 2006; and, WHEREAS, the Board of County Commissioners, have reviewed the application material, staff report and Planning Commission minutes; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision will not adversely affect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does meet the applicable requirements of Grant County Unified Development Code Chapter 22 04 "Subdivisions and Plats"; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does serve the public use and interest; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with the Grant County Comprehensive Plan, the Shoreline Master Program, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA, and, IN THE MATTER OF APPROVING A EDDIE E. & SHIRLEY SMITH PRELIMINARY PLAT OF 4 67 ACRES SMITH'S COLUMBIA INTO EIGIIT LOTS RIVER VIEW ESTATES WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with the Health District's requirements for sewage disposal and potable water supply, and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does contain an accurate legal description of the lots being created, and the roads and easements therein, and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Board of County Commissioners have found that the "Best Available Science" has been considered in the final decision regarding the proposed subdivision; and, WHEREAS, the Board of County Commissioners have found that the proposed subdivision does appropriately identify and protect critical areas pursuant to GCC § 24.08; and, WHEREAS, the Board of County Commissioners have made a decision to approve "Smith's Columbia River View Estates Preliminary Plat." NOW, THEREFORE, BE IT RESOLVED THAT, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, with the conditions of approval listed below, a preliminary plat of 4.67 acres into 8 lots; located in a portion of Sections 12, Township 18 North, Range 22 East, Willamette Mendian, Grant County, Washington (parcel # 15-0008-000); CONDITIONS OF APPROVAL: 1) Development shall be in compliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health District, by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to, RCW 90.48 080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 3) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation -2- IN THE MATTER OF APPROVING A EDDIE E. & SHIRLEY SMITH PRELIMINARY PLAT OF 4 67 ACRES SMITH'S COLUMBIA INTO LIGHT LOTS RIVER VIEW ESTATES 4) Approval of the plat shall be contingent upon conformance with all applicable land use rules and regulations in effect as of September 1, 2004. 5) During road grading and/or construction activities, county roads shall be maintained clear of soil and rocks at the point of ingress / egress. 6) This proposal shall comply with the requirements of GCC 23.12.080 Clearing, Grading and Drainage Standards, including but not limited to: a) Clearing and grading activities shall be conducted so as to minimize potential adverse effects on offsite property. b) All development shall ensure that soil erosion and sedimentation of drainage - ways will be controlled to prevent damage to adjoining properties. c) Surface drainage shall not be directed to or discharged onto County Roads or ditches within County right-of-ways unless approved by the County Engineer. 7) Development shall comply with the requirements of the Grant County Assessor's office; including but not limited to, a) Plat Name OK b) Legal description should not say "revised". 8) Development shall comply with all requirements of Grant County's Public Works Department, including but not limited to a) Provide a long plat check fee of $116.00. b) Provide a north arrow. c) Revise the vicinity map to include surrounding county roads. d) An approach permit must be obtained prior to the issuance of a Building Permit. e) A note shall be added to the face of the plat, indicating the private easement stating the following " Shared access for Lot 2 and 4. Lot 2 and Lot 4 must access from this point only f) After examining the layout of this plat in relation to the existing topography it appears that Lots 5, 6, and 7 may have access difficulties. These lots may need to be reconfigured to address these issues 9) Development shall comply with all requirements of the Grant County Health District, including but not limited to: a) An evaluation of each site to examine soil and terrain conditions must be done by a licensed engineer or septic system designer. The results of the evaluation must be submitted to the Grant County Health District with the required fee for each lot. b) The water system must be approved as a community water system by the WA Dept. of Health for the number of service connections proposed c) A restriction on the number of bedrooms allowed and the ability to develop each lot may be imposed. 10) Pursuant to GCC 24.08 Critical Areas, the developer shall comply with the following:. a) Pursuant to the Geologically Hazardous report filed by Nelson Geotechnical Associates applicant shall delineate on the map the geological hazardous areas. b) Developer shall clearly identify the buffer by placing a permanent monument minimally every 50 feet along said boundaries The monuments shall minimally be a 4" x 4" buried post exposed a minimum of 2 feet above ground. 3- IN THE MATTER OF APPROVING A EDDIE E & SHIRLEY SMITH PRELIMINARY PLAT OF 4 67 ACRES SMITH'S COLUMBIA INTO EIGHT LOTS RIVER VIEW ESTATES c) To achieve the reduced setbacks for lots 7 & 8 all mitigation measures as outlined in the Engineering Geologic Evaluation and Addendum dated December 30, 2005 shall be implemented. 11) Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a) Comply with all requirements listed in UDC Chapter 22.04 Article V Final Subdivisions and Short Subdivisions. b) Comply with all requirements listed in the SEPA Mitigated Determination of Non -Significance Issued by Grant County on February 16. 2006 c) The developer shall place a note on the plat identifying that the geological hazard setback and cliffs as a priority habitat area and only low impact uses are allowed within this area. d) Change the name of the road along the west side of the plat and in the Vicinity map from Huber Rd to Sunland Road. e) On page 2 place a signature line for the notaries signature and correct formatting. 12) Development shall comply with all requirements of the Grant County Emergency Services including but not limited to: a) The proponent shall contact this office for addressing.
