HomeMy WebLinkAboutResolution 06-161-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION: IN THE MATTER OF APPROVING A PLAT ALTERATION OF LOT 1 OF PELICAN POINT ADDITION #5, LOCATED IN A PORTION OF SECTION 3, TOWNSHIP 18 NORTH, RANGE 23 EAST, WM. GRANT COUNTY, WA RESOLUTION No. 2006 -/(0/ -CC JOHNSON RE -PLAT WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on April 5, 2006 in the matter of a preliminary plat alteration of Lot 1 of Pelican Point Addition #5, located in a portion of Section 3, Township 18 North, Range 23 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission on April 5, 2006 did approve a motion to recommend to the Board of County Commissioners to approve this proposed preliminary plat alteration with twelve (12) suggested conditions of approval and six (6) findings of fact consistent with approval; and, WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on May 9, 2006; and, WHEREAS, the Board of County Commissioners, have reviewed the application material, staff report and a summary of the Planning Commission hearing; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely affect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the plat alteration, and, WHEREAS, the proposed plat alteration, subject to the conditions of approval, meets the applicable requirements of Unified Development Code, Chapter 22.04 "Land Division"; and, IN THE MATTER OF APPROVING A JOHNSON RE -PLAT PRELIMINARY PLAT ALTERATION OF LOT 1, PELICAN POINT ADDITION #5 WHEREAS, the proposed preliminary plat alteration does comply with the Health District's requirements for sewage disposal and potable water supply; and, WHEREAS, the proposed preliminary plat alteration does contain an accurate legal description of the lots being created, and the roads and easements therein; and, WHEREAS, the proposed preliminary plat alteration does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Board of County Commissioners have made a decision to approve the preliminary Johnson Re -Plat. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, with twelve (12) conditions of approval listed below, a preliminary plat alteration of Lot 1 of the Pelican Point Addition #5; located in a portion of Section 3, Township 18 North, Range 23 East, Willamette Meridian, Grant County, Washington, Assessor parcel # 12-0881-101; CONDITIONS OF APPROVAL: 1) Development shall be in compliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health District, by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 3) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 4) During road grading and/or construction activities, county roads shall be maintained clear of soil and rocks at the point of ingress / egress. 5) This proposal shall comply with the requirements of GCC 23 12.080 Clearing, Grading and Drainage Standards, including but not limited to a) Clearing and grading activities shall be conducted so as to minimize potential adverse effects on offsite property. b) All development shall ensure that soil erosion and sedimentation of drainage -ways will be controlled to prevent damage to adjoining properties. 2- IN THE MATTER OF APPROVING A JOHNSON RE -PLAT PRELIMINARY PLAT ALTERATION OF LOT 1, PELICAN POINT ADDITION #5 c) Surface drainage shall not be directed to or discharged onto County Roads or ditches within County right-of-ways unless approved by the County Engineer. 6) Approval of the plat shall be contingent upon conformance with all applicable land use rules and regulations in effect as of February 9. 2006. 7) Development shall comply with all requirements of Grant County Auditor's Office, including but not limited to: a) The name "Johnson Replat" is approved 8) Development shall comply with all requirements of Grant County's Public Works Department, including but not limited to: a) Provide a $100.00 plat check fee. b) An Approach permit must be obtained prior to a building permit. c) A hatched/shaded are must be added to the plat starting on the southwest end of segment "C4" following through the curve in the northwesterly direction to the southeast end of segment "Cl". This hatched/shaded area shall be labeled "No Access". 9) This proposal shall comply with all the requirements of the Grant County Emergency Services including but not limited to: a) Proponent shall contact this office to correct address on each lot. 10)Development shall comply with all requirements of the Grant County Health District, including but not limited to: a) An evaluation of the soil conditions for both lots is necessary to determine if the lot size proposed is adequate. The work must be done by a licensed engineer or septic system designer. b) Final approval of these lots will be conditional upon completion of a site registration and Method II analysis as explained in WAC 246-272-20501 (2) (d) (ii). 11) Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a) Comply with all requirements listed in UDC Chapter 22.04 Article V Final Subdivisions and Short Subdivisions b) Correct formatting within notary acknowledgment and add signature line for notary. c) Correct the road name from Viewcrest Drive to Viewmont Drive and Viewmont Drive to Viewcrest Drive. d) Correct the vicinity map e) Add the following `Block" of information. Plat Information Zoning: Urban Residential — 2 Max. DU Density. 4 units / 1 acre Overall Acreage: .60 acre Roads: (add information) Water: Pelican Point Water Association Sewer: Individual on-site septic system 3- IN THE MATTER OF APPROVING A JOHNSON RE -PLAT PRELIMINARY PLAT ALTERATION OF LOT 1, PELICAN POINT ADDITION #5 12) The applicant shall comply with GCC 23.12 with regards to the development of sewer infrastructure or provide a covenant insuring future sewer infrastructure, built to city standards, in favor of the City of Moses Lake and notification of covenant be placed on the face of the plat along with the Auditor's file number.
