The existing parcel (160346000) does not meet the current density requirement of the Agriculture Zone of one dwelling unit per 40 acres. Project site is located approximately 12 miles South of Ephrata on Dodson Road and 300 feet north of the intersection of Dodson Road and Road 5 NW in the SW quarter of S 4, T 19, R 26 E, WM. 4 1924 PM Commissioner Allison moved to grant the application recognizing the 7 Condition of Approval and 6 Findings of Fact, Commissioner Moore seconded. The motion passed unanimously. The hearing adjourned. BOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON A RESOLUTION APPROVING A REASONABLE USE EXCEPTION ON A 2.43 ACRE PARCEL LOCATED IN A PORTION OF SECTION 4, TOWNSHIP 19 NORTH, RANGE 26 E. WM, GRANT COUNTY, WASHINGTON RESOLUTION NO. RESOLUTION APPROVING A REASONABLE USE EXCEPTION Nicholas & Kelly Cobb WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on March 1, 2006, on the matter of granting a Reasonable Use Exception to Nicholas & Kelly Cobb to allow the development of a 2.43 -acre parcel in the Agriculture Zone of Grant County. The subject parcel (416-0346-000) is located in a portion of Section 4, Township 19 North, and Range 26 East Willamette Meridian, Grant County, Washington. WHEREAS, the Grant County Planning Commission on March 1, 2006 made a recommendation to the Board of County Commissioners to approve this proposed Reasonable Use Exception WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on April 4, 2006. WHEREAS, the Board of County Commissioners have made a decision to uphold the recommendation to approve the proposed Reasonable Use Exception; WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan; WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the Reasonable Use Exception; WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; IN THE MATTER OF THE APPROVAL OF REASONABLE USE EXCEPTION OF NICHOLAS & KELLY COBB NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, that a Reasonable Use Exception be granted to Nicholas & Kelly Cobb to allow the development of a 2.43 acre parcel for a single family dwelling unit in the Agriculture Zone which is located in a portion of Section 4, Township 19 North, Range 26 East, Willamette Meridian, Grant County, Washington. CONDITIONS OF APPROVAL: 1) Development shall be in compliance with the Washington State Environment Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2) Proposal shall comply with all requirements deemed necessary by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 3) Proposal shall comply with all requirements of the Grant County Fire Marshal and shall comply with the Grant County Fire Flow Guidelines, the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection and life safety. 4) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Colville Confederated Tnbes and the Washington State Office of Archaeology and Historic Preservation. 5) Reasonable Use Exception approval shall be contingent upon conformance with all applicable land use rules and regulations in effect as of January 30, 2006. 6) Development shall comply with all requirements of the Grant County Public Works Department including but not limited to, A) An approach permit must be obtained prior to a building permit. 7) Development shall comply with all requirements of the Grant County Health District including but not limited to: A) Contact the Grant County Health District for information regarding application for the septic system B) The Health District recommends that the well be located 100 feet from the property line to control potential sources of contamination to the aquifer. 2- IN THE MATTER OF THE APPROVAL OF REASONABLE USE EXCEPTION OF NICHOLAS & KELLY COBB Dated this day of April, 2006.
