HomeMy WebLinkAboutResolution 06-134-CCOpen Record Public Hearing Desert Aire PUD Master Plan March 21, 2006 10:30 am In Attendance: Richard Stevens LeRoy Allison Deborah Moore Barbara Vasquez Billie Sumrall — Associate Planner Public: None 10:46:59 AM The Commissioners held a public hearing regarding a request from Ross Davidson of the Desert Aire Associates to change the Planned Unit Development Master Plan of Desert Aire to allow the location of single family residential units in an area originally set aside for Commercial development in the Planned Unit Development of Desert Aire AND a minor zone change from Rural Village Commercial to Rural Village Residential 1 in an area previously described as Tract "A". The subject area is planned unti development of Desert Aire located adjacent to Desert Aire No. 9 and lying south of a private drive and north of the Desert Aire Airport property. When platted, this property will intersect with Airport Way and is located within a portion of the east %z of S 22, T 14 N, R 23 E, W M, and the west 'h of S 23, T 14 N, R 23 E, W M, Grant County. The parcel no is 21688514, further described as Tract A, Desert Aire, Division no. 9, Phases 5 and 6. The applicant proposes a PUD Subdivision which will include eleven residential lots each containing .+ acres Commissioner Moore moved to uphold the Planning Commission recommendation to approve recognizing the nine conditions of approval and 12 findings of fact. Commissioner Allison seconded and the motion passed unanimously. The hearing adjourned. BOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON A RESOLUTION APPROVING AN AMENDMENT TO THE PUD (SITE DEVELOPMENT PLAN) FOR DESERT AIRE, IN SECTION 22 &23, TOWNSHIP 14 N. RANGE 23 E. WM. & A MINOR ZONE CHANGE FROM RURAL VILLAGE COMMERCIAL TO RURAL VILLAGE RESIDENTIAL RESOLUTION No. 2006-/,3y -CC Desert Aire Associates ROSS DAVIDSON WHEREAS, the Grant County Board of County Commissioners has been advised that an open record public hearing was conducted before the Grant County Planning Commission on February 1, 2006 in the matter of a request to change the Planned unit Development Master Plan to allow the location of single family residential units in an area originally set aside for Commercial development in the Planned Unit Development of Desert Aire, and a minor zone change to reflect that change from Rural Village Commercial to Rural Village Residential said proposal revision being located in a portion of Section 22 and 23, Township 14 North, Range 23 East, WM Grant County, Washington; and, WHEREAS, the Grant County Planning Commission on February 1, 2006 did unanimously approve a motion to recommend to the Board of County Commissioners to approve this PUD (Site Development Plan) to change the parcels identified as #Tract "A" and further described as Division 9, Phases 5 and 6 to allow single family residential use, and a minor rezone to change the land use from Rural Village Commercial to Rural Village Residential, in the Planned Unit Development of Desert Aire. WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on 2006, and, WHEREAS, the Board of County Commissioners, have reviewed the application file, staff report and Planning Commission recommendation; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal, and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan, the Unified Development Code, other land use regulations, and SEPA, and, WHEREAS, the Board of County Commissioners has found that the public use and interest will apparently be served by the amendment to the PUD (Site Development Plan Revision) and minor zone change; and, Page 1 of 4 WHEREAS, the proposed PUD revision (Site Development Plan) does include a division or sale of land and therefore when submitted will require recording of a plat, and WHEREAS, the proposed PUD revision to the (Site Development Plan) meets the applicable approval criteria of Unified Development Code, Chapter 23 04 800 "Planned Unit Developments" subsection (h); and, NOW, THEREFORE, BE IT HEREBY RESOLVED, THAT the Board of County Commissioners for Grant County, Washington approves by this Resolution, a Planned Unit Development Revision to the Site Development Plan of Desert Aire, along with a minor rezone from Rural Village Commercial to Rural Village Residential allowing the location and construction of single family residential units in an area originally set aside for commercial development, located in a portion of Section 22, and 23 Township 14 North, Range 23 East, Willamette Meridian, Grant County, Washington, further described as Tract "A", Desert Aire, Division 9, Phases 5 and 6 Parcel Number 21688514) CONDITIONS OF APPROVAL 1. The Proposal shall be in compliance with, the Washington State Environmental Policy Act, the Grant County Unified Development Code and all applicable federal, state, and local regulations, rulings or requirements 2. Proposal shall comply with all requirements deemed necessary by the Grant County Health District 3. Proposal shall comply with all requirements deemed necessary by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to, RCW 90 48 080 Discharge of Polluting Water Prohibited, WAC 173-201, Surface Water Standards, WAC 173-201A, Ground Water Quality Standards, and, WAC 246-272, On -Site Sewage Systems 4. Proposal shall comply with all requirements of the Grant County Fire Marshal and shall comply with the Grant County Fire Flow Guidelines, the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection and life safety 5. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are disturbed by proposed construction all construction activity shall stop and the owner/concessionaire shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes, and the Washington State Office of Archaeology and Historic Preservation. Page 2 of 4 FINDINGS OF FACT 1) Does / meet the applicable requirements of UDC Chapter 23 04 "Zoning"; 2) Does / comply with the Comprehensive Plan, the Shoreline Master Program, the zoning code and other land use regulations, and SEPA, 3) Does / comply with health requirements for sewage disposal and potable water supply; 4) Does / function as a single site with respect to, but not limited to, access, interior circulation, open space, landscaping, drainage facilities, facility maintenance and parking; 5) Is / consistent in design, character and appearance with the goals and policies for the zoning district in which the proposed PUD is located; 6) The characteristics of the PUD change will / be reasonably compatible with the types of uses permitted in surrounding areas, 7) The proposed PUD change / will not create undue noise, odor, heat, vibration, air or water pollution impacts on surrounding existing or potential dwelling units; 8) The proposed PUD change / will not materially endanger the health, safety and welfare of the community; 9) The proposed PUD change is / such that pedestrian and vehicular traffic associated with the use will not be hazardous or conflict with existing and anticipated traffic in the local area, 10) The location, size and height of buildings, structures, walls and fences and screening vegetation for the proposed PUD change /shall not hinder or discourage the appropriate development or use of neighboring properties, 11) The proposed PUD / will not cause significant adverse impacts on the human or natural environments that cannot be mitigated by conditions of approval; and 12) The proposed land uses, activities, and structures do / comply with applicable development standards of GCC § 23 12 and performance standards specified in GCC § 23.04, and with any required mitigation measures Page 3 of 4 EFFECTIVE DATE- Upon signature.
