HomeMy WebLinkAboutResolution 05-171-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION: IN THE MATTER OF APPROVING A PLAT ALTERATION OF LOTS 1 & 8, BLK 1, AND LOT 3, BLK 2, OF WILD MOOSE TRACTS PHASE 1, LOCATED IN A PORTION OF THE SE'/, OF SECTION 18, TOWNSHIPI9 NORTH, RANGE 28 EAST, WM.GRANT COUNTY, WA. RESOLUTION No, 2005- / 7/ -OC WILD GOOSE TRACTS PHASE 1, REPLAT #1 R.ON GEAR WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on December 1, 2004 in the matter of a preliminary plat alteration of Lots 1 & 8, Block 1, and Lot 3, Block 2, of Wild Goose Tracts Phase 1; located in a portion of the SE'/s of Section 18, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission on December 1, 2004 did approve a motion to recommend to the Board of County Commissioners to approve this proposed preliminary plat alteration with twelve (12) suggested conditions of approval and six (6) findings of fact consistent with approval; and, WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on January 11, 2005; and, WHEREAS, the Board of County Commissioners, have reviewed the application material, staff report and a summary of the Planning Commission hearing; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely affect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and., WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the plat alteration; and, WHEREAS, the proposed plat alteration, subject the conditions of approval, meets the applicable requirements of Unified Development Code, Chapter 22.04 "Land Division"; and, IN THE MATTER OF APPROVING A WILD GOOSE TRACTS PRELIMINARY PLAT ALTERATION OF LOTS 1 & 8, PHASE 1, REPLAT #1 BLK 1, AND LOT 3 BLK 2, OF WILD GOOSE TRACTS PHASE 1. WHEREAS, the proposed preliminary plat alteration, does comply with the Health District's requirements for sewage disposal and potable water supply; and, WHEREAS, the proposed preliminary plat alteration does contain an accurate legal description of the lots being created, and the roads and easements therein; and, WHEREAS, the proposed preliminary plat alteration does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Board of County Commissioners have made a decision to approve the preliminary Wild Goose Tracts Phase 1, Repalt #1. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, with twelve (12) conditions of approval listed below, a preliminary plat alteration of Lots 1 & 8, Block 1, and Lot 3, Block 2, of Wild Goose Tracts Phase 1; located in a portion of SE % of Section 18, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington; CONDITIONS OF APPROVAL: 1) Development shall be in compliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health District, by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201 A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 3) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 4) During road grading and/or construction activities, county roads shall be maintained clear of soil and rocks at the point of ingress / egress. 5) This proposal shall comply with the requirements of GCC 23.12.080 Clearing, Grading and Drainage Standards, including but not limited to: a) Clearing and grading activities shall be conducted so as to minimize potential adverse effects on offsite property. IN THE MATTER OF APPROVING A WILD GOOSE TRACTS PRELIMINARY PLAT ALTERATION OF LOTS 1 & 8, PHASE 1, REPLAT #1 BLK 1, AND LOT 3 BLK 2, OF WILD GOOSE TRACTS PHASE 1. b) All development shall ensure that soil erosion and sedimentation of drainage - ways will be controlled to prevent damage to adjoining properties. c) Surface drainage shall not be directed to or discharged onto County Roads or ditches within County right-of-ways unless approved by the County Engineer. 6) Approval of the plat shall be contingent upon conformance with all applicable land use rules and regulations in effect as of November 1, 2004. 7) The applicant shall comply with GCC 23.12 with regard to the development of water and sewer infrastructure —or provide a covenant insuring future sewer and water infrastructure, built to city standards, in favor of the City of Moses Lake. 8) Development shall comply with all requirements of Grant County Auditor's Office, including but not limited to: a) The name "Wild Goose Tracts Phase 1 Replat #1" is approved. b) The legal below the plat name on page two should be exactly the same as page one. 9) Development shall comply with all requirements of Grant County's Public Works Department, including but not limited to: a) Provide a $100.00 plat check fee. b) Provide a Plat Certificate from the Title Company for land dedicated to Grant County. d) An approach permit shall be obtained prior to a building permit. 10) This proposal shall comply with all the requirements of the Grant County Emergency Services, including but not limited to: a) Proponent will need to contact this office. A plat alteration will affect the addressing currently established for phase 1. b) The road name is incorrect. The existing platted road name is Wild Goose Lane NE and shall be labeled as such on the face of the plat alteration. To change the road name the applicant will need to apply for a resolution of change. 11) Development shall comply with all requirements of the Grant County Health District, including but not limited to: a) The location of wells and a 100ft radius wellhead protection zone shall be located on the plat. b) A note shall be placed on the plat stating, "No activities will be allowed within the designated 100ft radius wellhead protection zones which may potentially affect the quality of ground water." 12) Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a) Comply with all requirements listed in UDC Chapter 22.04 Article V Final Subdivisions and Short Subdivisions. b) Comply with all requirements listed in the SEPA Mitigated Determination of Non -Significance issued by Grant County on October 28, 2004. T IN THE MATTER OF APPROVING A WILD GOOSE TRACTS PRELIMINARY PLAT ALTERATION OF LOTS 1 & 8, PHASE 1, REPLAT #1 BLK 1, AND LOT 3 BLK 2, OF WILD GOOSE TRACTS PHASE 1. c) Note 3 of the preliminary plat alteration shall be changed to reflect the following: the sentence, "Said easement is subject to being extiniished upon an alteration of any boundary of said lots unless said easement is in use." shall be changed to, "Said easement is subject to being relocated upon an alteration of any boundary of said lots unless said easement is in use." d) The following "block" of information shall be added to the final plat.
