IN THE MATTER OF APPROVING A PLAT ALTERATION TO CONSOLIDATE PORTIONS OF BLOCKS 11, 12,24 AND 25 OF THE TRINIDAD PLAT LOCATED IN A PORTION OF THE NW '/a of SECTION 18, TOWNSHIP 20 NORTH, RANGE 23 EAST, WM. GRANT COUNTY WASINGTON RESOLUTION No. 2005-.Ik-CC RESURVEY OF AND ADDITION TO TRINIDAD WA, REPLAT # 1 EVERETT BRISSEY WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on April 6, 2005 in the matter of a preliminary plat alteration to consolidate portions of Block 11, 12, 24 and 25 of the Trinidad Plat; located in a portion of the NW % of Section 18, Township 20 North, Range 23 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission on April 6, 2005 did approve a motion to recommend to the Board of County Commissioners to approve this proposed preliminary plat alteration with eleven (11) suggested conditions of approval and six (6) findings of fact consistent with approval; and, WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on May 3, 2005; and, WHEREAS, the Board of County Commissioners, have reviewed the application material, staff report and a summary of the Planning Commission hearing; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely affect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the plat alteration; and, IN THE MATTER OF THE APPROVAL OF A RESURVEY OF AND ADDITION TO PRELIMINARY PLAT ALTERATION OF TRINIDAD WA, REPLAT #1 A PORTION OF BLOCKS I I,12, 24 AND 25OF THE TRINIDAD PLAT WHEREAS, the proposed plat alteration, subject the conditions of approval, meets the applicable requirements of Unified Development Code, Chapter 22.04 "Land Division"; and, WHEREAS, the proposed preliminary plat alteration does comply with the Health District's requirements for sewage disposal and potable water supply; and, WHEREAS, the proposed preliminary plat alteration does contain an accurate legal description of the lots being created, and the roads and easements therein; and, WHEREAS, the proposed preliminary plat alteration does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Hoard of County Commissioners have made a decision to approve the preliminary Resurvey of and addition to Trinidad WA, Replat #1 NOW, THEREFORE, RE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, with eleven (11) conditions of approval listed below, a preliminary plat alteration portions of Block 11, 12, 24 & 25 of the Trinidad Plat; located in a portion of the NW '/4 of Section 18, Township 20 North, Range 23 East, Willamette Meridian, Grant County, Washington. Assessor Tax Parcels #05- 0637-000, 05-0911-002, 05-0911-003, 05-0911-004, 05-0911-005, 05-0911-006 and 05-0911- 007. CONDITIONS OF APPROVAL: 1) Development shall be in compliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health District, by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 3) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. -2- IN THE MATTER OF THE APPROVAL OF A RESURVEY OF AND ADDITION TO PRELIMINARY PLAT ALTERATION OF TRINIDAD WA, R.EPLAT #1 A PORTION OF BLOCKS 11,12, 2a AND 25OF THE TRINIDAD PLAT 4) During road grading and/or construction activities, county roads shall be maintained clear of soil and rocks at the point of ingress / egress. 5) This proposal shall comply with the requirements of GCC 23.12.080 Clearing, Grading and Drainage Standards, including but not limited to: a) Clearing and grading activities shall be conducted so as to minimize potential adverse effects on offsite property. b) All development shall ensure that soil erosion and sedimentation of drainage -ways will be controlled to prevent damage to adjoining properties. c) Surface drainage shall not be directed to or discharged onto County Roads or ditches within County right-of-ways unless approved by the County Engineer. 6) Approval of the plat shall be contingent upon conformance with all applicable land use rules and regulations in effect as of November 1, 2004. 7) Development shall comply with all requirements of Grant County Auditor's Office, including but not limited to: a) The name "Resurvey of and addition to Trinidad WA, Replat #1" is approved 8) Development shall comply with all requirements of Grant County's Public Works Department, including but not limited to: a) Provide a $100.00 plat check fee. b) Provide a more accurate vicinity map depicting all county roads in the area. c) Provide a Plat Certificate from the Title Company for land dedicated to Grant County. d) Provide 20' radii at all Right -of -Way intersections. e) An Approach permit must be obtained prior to a building permit. f) The road names used on this plat map reflect the names used on prior plats, however they do not correctly reflect the current road names as shown on our County Road System. The road shown as "Fifth Street" should be 9.7 NW. The road shown as "Walnut Avenue" should be W.9 NW. g) All local access roads must be built to current County Road Standards for gravel roads that call for 4" of base course, 2" of top course and a 26' wide all weather -driving surface. The turnaround provision must be a 50' driving surface cul-de-sac using the same standards as above. h) The road frontage onto Road 9.7 NW for Lot 1 should be increased to a minimum of 50' to accommodate a future approach, for this lot onto the cul-de-sac. 9) This proposal shall comply with all the requirements of the Grant County Emergency Services. 10) Development shall comply with all requirements of the Grant County Health District, including but not limited to: a) The well for each lot must have a radius of 100 feet that is within the boundaries of the plat. b) Well location and the radius of the 100 feet must be shown on face of the plat. -3- IN THE MATTER OF THE APPROVAL OF A RESURVEY OF AND ADDITION TO PRELIMINARY PLAT ALTERATION OF TRINIDAD WA, REPLAT #1 A PORTION OF BLOCKS 11,12, 24 AND 250F THE TRINIDAD PLAT c) A site registration must be completed for each lot to show the requirements and suitability for septic system installation. A licensed engineer or septic system designer must do this work. 11) Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a) Comply with all requirements listed in UDC Chapter 22.04 Article V Final Subdivisions and Short Subdivisions. b) Note 3 of the preliminary plat alteration shall be changed to reflect the following: "Said easement is subject to being extinguished upon an alteration of any boundary of said lots unless said easement is in use." shall be changed to, "Said easement is subject to being relocated upon an alteration of any boundary of said lots unless said easement is in use."
