( `iambertain Family Trust WHEREAS, the Board of County Commissioners of Gran< County have been advieP-j by the Grant County Planning Commission that an open record public hearing was conducted on May 2, 2001 on the matter of Desert View Acres Preliminary Plat, a twelve (12) lot subdivision located on approximately 87 acres in the Rural Residential I zone in a portion of Section 21, Township 22 North, Range 27 East, Willamette Meridian, Grant County, Washington. WHEREAS, the Desert View Acres Plat application has been processed in accordance with Chapter 25.04 "Permit Application Review Procedures" of the Unified Development Code-, WHEREAS, the Desert View Acres Preliminary Plat is in conformance with the requirements of Chapter 22.04 "Land Divisions" of the Unified Development ( ode: WHEREAS, the Desert View Acres Preliminary Plat is in conformance with the requirements of the Grant County Unified Development Code; WHEREAS, the Grant County Planning Commission made a recommendation to approve the preliminary plat at the open record public hearing on May 2. 2001 with eleven (1 1) conditions of approval; WHEREAS, the Grant County Board of County Commissioners have held a Closed Record Public Meeting on May 29, 2001; WHEREAS, the Board of County Commissioners have made a decision to approve the Desert View Acres Preliminary Plat recognizing the eleven (1 I ) Conditions of Approval and three (3) Findings of Fact as submitted by Planning Department Staff; WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan; Desert View Acres Preliminary Plat File # 00-'0 12 1 5/30/01 WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by approval of the plat; WHEREAS, the Board of County Commissioners have found that the requirements of the State Environmental Policy Act have been complied with and a Mitigated Determination of Non -Significance (MT)NS) was issued on this proposal on April 4, 2001; WHEREAS, the Board of County Commissioners have found that the preliminary plat does comply with the intent of the Washington State Growth Management Act; WHEREAS, the Board of County Commissioners have approved the Desert View Acres Preliminary Plat subject to the following eleven (1 1) Conditions of Approval & three (3) Findings of Fact as recommended by the Grant County Planning Commission Conditions of Approval: 1. Development shall be in compliance with the Grant County Comprehensive Plan, the Growth Management Act, The Washington State Environmental Policy Act, the Grant County Unified Development Code, the Grant County Unified Development Code Chapter 24.08 Critical Areas and Cultural Resources and all applicable federal, state, and local regulations, rulings or requirements. 2. Development shall comply with all applicable requirements of the Grant County Fire Marshall/ Building Official, the Grant County Fire Flow guidelines and the Uniform Building Code and Uniform Fire Code. 3. Development shall comply with all improvements required by the Grant County Department of Public Works including, but not limited to: a. Provide a Plat check fee of $100.00 plus $2.00 per lot for a total of $126.00. b. Conform to Basic Plat Requirements. c. Provide County intersection detail conforming to WSDOT requirements and obtain necessary approach. The approach angle may need to be revised. d. Internal plat road must be built to current County Road Standards which call for 4" of base course, 2" of top course with a 2 shot BST finished width of 26 feet Alignment near lots 6 & 7 must be a curve and not an angle point. e. The easement at the end of the cul-de-sac to the west plat boundary must be labeled as an easement for Future Public Road/Utility. Width to be less than 60 feet. f. Correct spelling of Non-Biuldable and Zoneing to Non -Buildable and Zoning. g. Access permit must be obtained prior to issuance of a building permit. 4. Developer shall comply with all requirements deemed necessary by the Grant County Health District, Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control treatment including, but not limited Desert View Acres Preliminary Plat File # 00-301 5110/0 1 to: RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201 A. Ground Water Quality Standards and WAC 246-272, On -Site Sewage Systems. 5. If any Native American Grave site(s) or archeological/cultural resources (Indian Artifacts) are found all construction shall stop and the owner/developer shall immediately notify the Colville Confederated Tribes and the Washington State Office of Archeology and Historic Preservation. 6. Developer shall comply with all requirements deemed necessary by the Washington State Department of Transportation including, but not limited to: a. Applicant shall provide the WSDOT an engineering traffic study, signed and sealed by a professional engineer registered in accordance with Chapter 18.43 RCW. b. A condition for the final approval of the subject plat is that the proponents present an approved WSDOT Access Connection for their designated location. The permit will not be approved until the connection meets all standards necessary to support the development, are in place, and complete. The proponent shall be responsible for funding any necessary improvements. 7. Developer shall comply with all requirements deemed necessary by the Washington State Department of Ecology. 8. Developer shall comply with all requirements deemed necessary by the Grant County PUD including, but not limited to: a. All lots subject to a Public Utility easement of 5- on all interior lot boundaries and 10' on all exterior lot boundaries. 9. Developer shall comply with all requirements deemed necessary by Grant County Emergency Services including, but not limited to: a. Road names and addressing will be established per the Grant County Ordinance No. 85 -143 - CC. 10. Developer shall comply with all requirements deemed necessary by the United States Department of Interior, Bureau of Reclamation and Quincy Columbia Basin Irrigation District, 11. Developer shall comply with the Final Plat Approval Criteria identified in Section 22.04.440 of the Grant County Unified Development Code. Desert View Acres Preliminary Plat File ft 00-301? 5 30'01 3 Findings of Fact: 1) The Grant County Board of County Commissioners (has) concluded that appropriate provisions for drainage, roads, alleys, utilities, public ways, water supplies, sanitary wastes, parks, playgrounds, fire protection facilities, school sites, and grounds and other public and private facilities and improvements in making its recommendations to the Grant County Commissioners. 2) The Grant County Board of County Commissioners (has) concluded that the Desert View Acres Preliminary Plat conforms to the general purpose of the Comprehensive Plan and Grant County Unified Development Code. 3) The Grant County Board of County Commissioners (has) concluded that the public use and interest will serve this proposal. NOW THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, the Preliminary Plat of Desert View Acres located in a portion of Section 21, Township 22 North, Range 27 East, Willamette Meridian, Grant County Washington more fully described as follows: Done this a" day of -2001 Attest:\ Clerk kfoe Board Commissioher, im Snead Chairman.
