SUBJECT SITE? IS LOCATED ON LOT #4 OF L -J ACRES, IN A PORTION OF SECTION 11, TOWNSHIP 19 NORTH, RANGE 28 EAST, W. M., GRANT COUNTY. WASHINGTON. RESOULTION APPROVING A REASONABLE USE EXEMPTION RESOLUTION NO. 2001-64—CC Bruce Larsen WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on April 4, 2001, on the matter of approving a Reasonable Use Exemption on (1) one lot approximately 2.22 acres in size, located on Lot 4 ol' I. -.I Acres, in a portion of Section 11, Township 19 North, Range 28 East, Willamette Meridian. Grant County, Washington; and WHEREAS, the Grant County Planning Commission on April 4, 2001 made a recommendation to the Board of County Commissioner~ to approve this proposed plat alteration with the (7) seven suggested Conditions of Approval ant (4) Cour Findings of Fact as prepared by the planning staff; and WHEREAS, the Grant County Board of Commissioners held a closed record public meeting at 2.00 p.m. on April 24, 2001 it thy• ( ommtssioners Hearing Room of the Courthouse; and WHEREAS, the Board of County Commissioners have made a decision to uphold the Planning Commission's recommendation to approve the proposed Reasonable Use Exemption request with the (7) seven suggested Condttwnm of Approval and (4) four Findings of Fact; and WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the Reasonahle (Ise Exemption; and WHEREAS, the Board of County Commissioners have found that appropriate provisions for drainage. roads, alleys, utilities, public ways, water supplies, sanitary wastes, parks, playgrounds, fire protection facilities, school situ and grounds and other public and private facilities and improvements have been made: and WHEREAS, the Board of County Commissioners have concluded that the Reasonable Use Exemption conforms to the general purpose of the Comprehensive Plan, the Grant County Unified Dei elopmcnt Code, and S F.P.1_ aii�'. WHEREAS, the Board of County Comnussioners have found that the Reasonable Use Exemption conforms to the Criteria of Approval identified in Section 23.04.170 of the Grant County Umficd Development ('ode an] Page 2 of 3 Resolution 01-64—CC Bruce Larsen Reasonable Use Exemption WHEREAS, that the Board of County Commissioners have approved the Bruce Larsen Reasonable Use Exemption on (1) one lot approximately 2.2 acres to size, located on Lot 4 of L — J Acres, subject to the following seven (7) Conditions of Approval and four (4) Findings of Fact as recommended by the Planning Department CONDITIONS OF APPROVAL: The following are conditions of approval, which were used in the Grant County Board of County Commissioner's closed record public meeting to approNe the proposed Reasonable Use Exemption: Development shall be in compliance with the Growth Management Act, The County - Wide Planning Policies, "The Washington State Fnvironment Policy Act, the Grant County Comprehensive Plan, the Grant Counly t Imfied Development Code, and all applicable local. state, and federal regulatjon�. rulings or requirements 2. Development shall comply with all app) icable requirements of the Grant County Fire Marshall, the Grant County Fire Flow guidelines and the Uniform Budding Code and Uniform Fire Code including but not limited io a. Development shall comply with all condrttons imposed by the Grant County Public Works Department including but not ]muted to a. An access permit must be obtained prior to the issuance of a building permit. 4. Developer shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to: RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201 Surface Water Standards; WAC 173-201A, Ground Water (Quality Standards and W AC 240-2-12, On -Site Sewage Systems. 5. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Colville Confederated P hes and the Washington State Office of Archaeology and Historic Preservation 6. FINDINGS OF FACT: The following are (4) four Findings of Fact, which were used in the Grant County Board of County Commissioner's closed record public meeting to approve the proposed Reasonable Use Exemption: 1) The Grant County Board of County Commissioners (have)(have not) concluded that appropriate provisions for drainage, roads, alleys, utilities, public ways, water supplies, sanitary wastes, parks, playgrounds, fire protection facilities, school sites, and grounds and other public and private facilities and improvements in making its recommendations to the Grant County Commissioners. 2) The Grant County Board of County Commissioners (have)(have not) concluded that the Reasonable Use Exemption conforms to the General Purpose of the Comprehensive Plan, the Grant County Unified Development rode. and SEPA 3) The Grant County Board of County Commissioners (have)(have not) concluded that the public use and interest will be served by the proposal. 4) The Grant County Board of County Commissioners (have)(have not) concluded that the proposed Reasonable Use Exemption conforms to the Criteria for Approval identified in Section 23.04.170 of the Grant County t rafted llcvelopment Code.
