HomeMy WebLinkAboutResolution 01-016-CCGRANT COUNTY BOARD of COMMISSIONERS Grant County, Washington ORDINANCE NO. 01- 16 -CC AN ORDINANCE AMENDING THE UNIFIED DEVELOPMENT CODE REGARDING MINERAL PROCESSING ACCESSORY TO EXTRACTION OPERATIONS IN THE RURAL REMOTE ZONE OF GRANT COUNTY, WAtiHING"ION. Recitals: WHEREAS, in 1990 the Washington State Legislature passed and the Governor signed into law the Growth Management Act (GMA) as contained in SHB No. 2929 (Washington Laws, 1990 1" Ex. Sess., Ch.17), which was subsequently coli fieri as, among other chapters, Chapter 36.70A RCW; and WHEREAS, Chapter 36.70A RCW required Grant County to adopt a comprehensive plan and development regulations that are consistent with and implement the comprehensive plan; and WHEREAS, on September 30, 1999, the Grant County Board of Commissioners adopted Ordinance No. 99 -158 -CC, adopting the Grant County Comprehensive Plan together with the integrated Draft Environmental Impact Statement and the Final Environmental Impact Statement; and WHEREAS, the Grant County Comprehensive Plan is intended to, among other things, direct and prepare for future growth and development in the County; and WHEREAS, implementation of the Comprehensive Plan is essential to direct the future growth and development of the County in a manner consistent with the Comprehensive Plan's goals, objectives, policies, land use designations, future land use map and mapping criteria; and WHEREAS, the general purpose of the adoption of development regulations is to implement the goals and policies of the Grant County Comprehensive Plan and to: 1. Encourage land use decision-making in accordance with the public interest, protection of private property rights and the public good, and applicable laNN c ofthe State of Washington; 2. Protect the general public health, safety, and welfare_ 3. Implement the Grant County Comprehensive Plan goals and policies through land use and other regulations; 4. Provide for the economic, social, and aesthetic advantages of orderly development through harmonious groupings of compatible and complenientary land uses and the application of appropriate development standards; 5. Provide for adequate public facilities and services in conjunction with development; and, 6. Promote general public safety by regulating developinent of lands containing physical hazards and to minimize adverse em ironmental impacts of', lcv_-Iopilicnt: and WHEREAS, on September 25, 2000 the Board of Gram County Commissioners adopted the Grant County Unified Development Code, Ordrian_r A,1 W-1 14-C(, which became effective October 1, 2000; and WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on January 3, 2001 on the matter of amending the Grant County Unified Development Code in regard to changing mineral processing accessory to extraction operations in the rural remote zone of Grant County, Washington, from a Prohibited Use to a Conditional Use, and; WHEREAS, the Grant County Planning Commission on January 3, 2001 voted unanimously to recommend approval of the UDC Amendment, and; WHEREAS, upon public notice, the Board of Grant County Commissioners conducted an open record public hearing on January 23, 2001, to consider the recommendations and findings of fact of the Grant County Planning Commission along with other public comment pertaining to the proposed Unified Development Code amendment; and WHEREAS, the Board of County Commissioners have been advised by the Grant County Planning Department that the proposed UDC Amendment was processed in accordance with the requirements of UDC Chapter 25.12 "Legislative Action,", and WHEREAS, the Board of County Commissioners have been advised by the Grant County Planning Department that the proposed UDC Amendment was processed in accordance with the requirements of UDC Chapter 24.04 "State Environmental Policy Act"; and WHEREAS, the Board of County Commissioners of Grant County have found that a Determination of Significance and Adoption of E cisung Environmental Documentation was issued for this proposal on December 14. 2000; and WHEREAS, the Board of County Commissioners have Lound that the proposal is consistent with the Grant County Comprehensive Plan and )nternalk consistent with the rest of the Unified Development Code; and WHEREAS, The Board of County Commissioners End that the public use and interest will be served by the UDC Amendment; and WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and WHEREAS, the Board of County Commissioners have made a decision to uphold the recommendation to approve the UDC Amendment, and WHEREAS, the Board of Grant County Commissioners adopts the recommendations and findings of fact of the Grant County Planning Commission Recorded Motion dated January 3, 2001, NOW, THEREFORE, the Grant County Board of County Commissioners do hereby ordain and amend the Grant County Unified Development Code as follows: Amend Chapter 23.04, Zoning, Table 4, Allowable Land Uses for Rural Lands, Special and Overlay Districts, cQ Resource Lands 7oning Districts, Page 70: • "Mineral Processing Accessory to Extraction Operationsg" in the Rural Remote Zoning District shall be "C" [a Conditional use subject to Type III review procedures...]. (see attached Table 4) BE IT FURTHER ORDAINED, that the effective date of this ordinance shall be the day of .2001.
