A REPLAT OF LOT #414 OF THE LARSON SUBDIVISION PLAT CONSISTING OF 1.5 ACRES, SUBJECT SITE IS LOCATED IN A PORTION OF SECTION 4, TOWNSHIP 19 NORTH, RANGE 28, EAST, WM.GRANT CO., WASHINGTON RESOLUTION NO. 04-11,�r -CC WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on August 4, 2004, at 7:00 pm, on the matter of creating three (3) lots from Lot #414 of the Larson Subdivision plat, located in a portion of Section 4; Township 19 North; Range 28 Bast; Willamette Meridian, Grant County, Washington; (Parcel: #31-0414-400) and, WHEREAS, the Grant County Planning Commission on August 4, 2004, made a unanimous recommendation of approval to the Board of County Commissioners; and, WHEREAS, the Grant County Board of County Commissioners held a closed record public hearing on, 2004; and, WHEREAS, the Board of County Commissioners have made a decision to uphold the recommendation to approve the proposed plat alteration contingent upon conformance with the) conditions of approval listed herein and in the staff report presented by the Project Planner; and, WHEREAS, the Board of County Commissioners have been advised by the Planning Department that the subject parcel currently contains three duplexes ; and, WHEREAS, the Board of County Commissioners have been advised by the Planning Department that the subject replat was processed in accordance with the requirements of the Grant County Code, Chapter 22.04 "Subdivisions and Plats," Chapter 23.12 "Development Standards," and Chapter 25.04 "Permit Application Review Procedures-" and, WHEREAS, the Board of County Commissioners have been advised by the Planning Department that pursuant to Grant County Code, Chapter 24.08, critical areas review was performed and that the subject parcel does not appear to lie in any designated areas and, Page 1 of 3 V IN THE MATTER OF APPROVING A PRELIMINARY PLAT ALTERATION OF LOT 414, LARSON SUBDIVISION WHEREAS, the Board of County Commissioners has found that the subject proposal lies in the Urban Residential 3 Zoning District and corresponding Comprehensive Plan Land -Use Designation and thus is consistent with the underlying zoning district as required by Grant County Code and RCW 36.70A; and, WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the replat; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and, NOW, THEREFORE, BE IT HEREBY RESOLVED THAT the Board of County Commissioners for Grant County, Washington, approves by this Resolution, a plat alteration to create three (3) lots from lot #414, located in a portion of Section 4 Township 19 North; Range 23 East; Willamette Meridian, Grant County, Washington; (Parcel #31-00414-000), and; CONDITIONS OF APPROVAL: 1) The Proposal shall be in compliance with the Grant County Comprehensive Plan, the Grant County Unified Development Code, the Growth Management Act, the Washington State Environmental Policy Act, the Grant County Unified Development Code, the Grant County Resource Lands and Critical Areas Development Ordinance and all other applicable federal, state, and local regulations, rulings or requirements.. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 3) Proposal shall comply with all requirements of the Grant County Fire Marshal and shall comply with the Grant County Fire Flow Guidelines, the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection. 4) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found, all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribe, and the Washington State Office of Archaeology and Historic Preservation. 5) Preliminary Re -plat approval shall be contingent upon conformance with all applicable land use rules and regulation in effect per the Unified Development Code. 6) Development shall comply with Grant County Unified Development Code Chapter 22.04 Article 5 "Final Subdivisions and Short Subdivisions." Page 2 of 3 r1 IN TIM MATTER OF APPROVING A PRELIMINARY PLAT ALTERATION OF LOT 414, LARSON SUBDIVISION 7) Development shall comply with all requirements of the Grant County Auditors' Office including but not limited to: A) The replat name must be changed. "Larson Subdivision Replat No. 8" has already been assigned to project 03-3702. The Replat must be named "Larson Subdivision Replat No. 12". B) The map looks good except three references to short plat on page 2 that should be plat or replat. Two in the Bureau compliance requirement line and one in the Irrigation District approval. Also, sheet two says Sheet 1 of 2 at the bottom right hand corner. 8) Development shall comply with all requirements of the Grant County Public Works Department including but not limited to: A) Provide replat check fee of $100.00 B) An access permit must be obtained for Lot #1 and the driveway entrance shall be built according to the detail sheet, "Cement Concrete Driveway Entrance".. C) Conform to Grant County Public Works Department Plat requirements. D) Lots #2 and #3 have a non -conforming driveway entrance and shall be upgraded to The details shown on the "Cement Concrete Driveway Entrance" requirements. E) Lot #1 shall have a minimum of 50' frontage along Lowry Road and provide a parking area for four (4) vehicles. EFFECTIVE DATE: Upon Signature. DATED this SO day of A/)J,6�2004.
