HomeMy WebLinkAboutResolution 01-186-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington IN THE MATTER OF ESTABLISHING CERTAIN ROADS AS PART OF THE COUNTY ROAD SYSTEM Resolution No. 2001 -186 -CC ORDER OF ESTABLISHMENT WHEREAS, in accordance with RCW 36.81.010, the Board of County Commissioners declared its intention to establish certain roads as county roads through the creation of County Road Improvement District 2001-1 in its Resolution No. 2001 -146 -CC and held hearings on October 2 and November 5, 2001 for said purpose, and WHEREAS, those certain roads lying in the N 112 of Section 33, T 21 N, R 26 EWM are described as follows: Road Name Termini 12.8 -NW Rd. from Dodson to C.5 -NW C.3 -NW Rd. from 12.8 -NW south to Cul-de-sac C.5 -NW Rd. from 12.8 -NW south to Cul-de-sac as shown on that certain Record Survey found in Book I County Auditor, recorded on October 5, 1976, and Richt-of-Wav Width Road Cul-de-sac Length 60 ft. n/a 0.50 mi 60 ft. 80 ft. 0.27 mi 60 ft. 80 ft. 0.27 mi Total 1.04 mi Page 51 of Surveys, records of the Grant WHEREAS, the Board of County Commissioners did create County Road Improvement District No. 2001-1 in its Resolution No. 2001 -182 -CC and did order the County Road Engineer to proceed to establish a county road project, and WHEREAS, the County Road Engineer has made an examination and survey thereof and reported the results of his examination and provided surveys, maps, and other related data related to the true location, course, and width of certain roads to the Board of County Commissioners, and WHEREAS, the County Road Engineer published the resolution of intent at least twice for two consecutive weeks and posted said roadways at least twenty days prior to the hearing for said road improvement district, and WHEREAS, The Board of County Commissioners declares its intention to act through RC W 36.75.080 entitled "Highways used ten years are county roads"; finds that the above described roads have been used by the public for more than ten years; finds the properties underlying the roads and rights-of-way have no monetary value as shown from the records of the Grant County Assessor and Page -1- Grant County receives no taxes from said rights-of-way; and finds all rights -of way and properties associated with the roads described above are for public use. NOW, THEREFORE, BE IT RESOLVED, the Board of County Commissioners finds that the roads and rights-of-way described above are a public necessity and establishes said roads and rights-of-way as a part of the county road system, and BE IT FURTHER RESOLVED, the Board of County Commissioners, acting through RCW 36.75.080 entitled "Highways used ten years are county roads", now declares that all rights-of-way associated with the above described roads as shown in the record survey found in Book 1, Page 51 of Surveys, records of the Grant County Auditor, recorded on October 5, 1976, and all properties now occupied by the roads described above are Grant County rights-of-way. Grant County assumes all responsibilities associated with the improvement and maintenance of said roads and rights-of- way. DONE THIS DAY OF &(, 4" 2001.
