HomeMy WebLinkAboutResolution 01-194-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON IN THE MATTER OF A REPLAT OF LOTS 326 & 327 IN DESERT AIRE #1 SUBDIVISION IN A PORTION OF SECTION 22; TOWNSHIP 14 NORTH; RANGE 23 EAST; WILLAMETTE MERIDIAN, GRANT COUNTY WASHINGTON (CREATING I LOT) RESOLUTION NO. 01 - 194 -CC RESOLUTION APPROVING A PLAT ALTERATION MATHEW & KIM GOSNEY WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on November 7, 2001, on the matter of creating one lot from lots 326 & 327 of Desert Aire #1 in a portion of Section 22, Township 14 North, Range 23 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission on November 7, 2001, made a recommendation to the Board of County Commissioners to approve this proposed plat alteration; and, WHEREAS, the Grant County Board of Countv Commissioners held a closed record public meeting on November 27, 2001; and, WHEREAS, the Board of County Commissioners have made a decision to uphold the recommendation to approve the proposed plat alteration request; and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan; and, WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the plat alteration; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and, NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution. a plat alteration to create one lot from Lots 326 IN THE MATTER OF A RE -PLAT OF LOTS PAGE 2 OF 3 326 & 327 OF DESERT AIRE #1 SUBDIVISION IN A PORTION OF SECTION 22; TOWNSHIP 14 NORTH; RANGE 23 EAST; WM, GRANT COUNTY, WASHINGTON, (CREATING 1 LOT). & 327 of Desert Aire #t Subdivision in a Portion of Seclion 22; Township t4 North, Range 23 East, Willamette Meridian, Grant County, Washington. CONDITIONS: The following are conditions of approval, which were used in the Grant County Board of County Commissioner's closed record public meeting to approve the proposed Plat Alteration: The Proposal shall be in compliance with the Grant County Comprehensive Plan, the Grant County Unified Development Code, the Growth Management Act, The Washington State Environmental Policy Act, the Grant County Zoning Ordinance, the Grant County Resource Lands and Critical Areas Development Ordinance and all applicable federal, state, and local regulations, rulings or requirements. 2. Proposal shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173- 201, Surface Water Standards; WAC 173-201 A, Ground Water Quality Standards; and, WAC 246- 272, On -Site Sewage Systems. 3. Proposal shall comply with all requirements of the Grant County Fire Marshal and shall comply with the Grant County Fire Flow Guidelines, the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection 4. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 5. Preliminary Re -plat approval shall be contingent upon conformance with all applicable land use rules and regulations in effect as of October 22, 2001. 6. Preliminary Re -plat approval shall be consistent with recorded restrictions with Final Plat approval of Desert Aire #1 Subdivision May 4, 1970. 7. Development shall comply with Grant County i Inified Development Code Chapter 22.04 Article 5 "Final Subdivisions and Short Subdivisions." 9. Proposal shall comply with all requirements of Grant County Public Works Department including but not limited to: A) Provide a replat check fee of $100.00 B) Re -label City Street Right of Way to County Road Right of Way 10. Development shall comply with Grant County Auditor Office's requirements including but not limited to: A) The name is not acceptable. There is no Gosney Plat to replat. Changed name needs to be Desert Aire Number 1, Replat #8. B) The surveyors certificate and Auditor's certificate should be changed to address this as a plat, not a survey. C) Building Official should be added to the signature line for the Fire Marshall. Done this P?�- day of November 2001.
