HomeMy WebLinkAboutResolution 01-230-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION NO. 2001 -230 -cc A Resolution Approving A Minor Zone Change From Public Facility To Urban Light Industrial. Parcel Number 17-1039-000, A 6.2 -Acre Parcel In Section 32 Township 20 Range 28. WHEREAS, in compliance with the Growth Management Act of 1990, Grant County adopted a Comprehensive Plan in September of 1999; and WHEREAS, Grant County adopted the Unified Development Code (UDC) in October of 2000, establishing official zoning districts in cgnformance with the Comprehensive Plan; and, WHEREAS, the Unified Development Code Chapter 25.12 "Legislative Actions" § 040 establishes a process for making Amendments to the Comprehensive Plan; and, WHEREAS, the Unified Development Code Chapter 23.04 "Zoning Districts" § 150 establishes a process for Minor Zoning Amendments which are consistent with the goals and policies of the Comprehensive Plan; and, WHEREAS, on November 6, 2001, Resolution 2001 -176 -CC "A Resolution Relating to Comprehensive Planning in Grant County in Accordance with the Washington State Growth Management Act (RCW 36.70 A) and amending the September, 1999 Comprehensive Plan", was signed by the Grant County Board of Commissioners; and, WHEREAS, Resolution 2001 -176 -CC included approval of a land use designation change (#2000-32) from Public Facility to Light Industrial for the subject parcel number 17-1039-000; and. WHEREAS, an application for a Minor Zone Change has been processed in accordance with the UDC Chapter 23.04 "Zoning Districts", Chapter 24.04 "SEPA", and Chapter 25.04 "Permit Application Review Procedures"; and, WHEREAS, the Grant County Planning Commission held an Open Record Public Hearing regarding this proposed zone change, during their regular meeting on November 7, 2001; and, WHEREAS, after consideration of the staff report and public comment concerning this zone change, the Planning Commission voted unanimously to recommend approval of this zone change to the hoard of County Commissioners, with the five conditions of approval suggested by staff and adding a sixth condition of approval stating that, "If Sonico does not apply for a Building Permit within 12 months the zoning will revert to Public Facility."; and, WHEREAS, the Grant County Board of Commissioners held an Open Record Public Hearing regarding this proposed zone change on December 31, 2001; and, WHEREAS, after consideration of the Planning Commissions report and recommendation for approval, public comment and staff comments, the Board of County Commissioners voted unanimously to delete the sixth condition of approval added by the Planning Commission, because if the zoning were to revert to Public Facility it would be in nonconformance with the amended Comprehensive Plan Land Use designation; and. WHEREAS, with the deletion of condition number six the Board of County Commissioners voted unanimously to accept the Planning Commission's recommendation to approve the zone change. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners hereby approve the zone change for parcel number 17-1039-000, a 6.2 -acre parcel, from Public Facility to Urban Light Industrial with the five conditions of approval recommended by the Planning Commission but excluding condition number six. PASSED by the Board of County Commissioners in regular session at Ephrata, Washington, then signed by its members and attested to by its Clerk in authorization of such passage this 31st day of'--- December 20Q 1 .
