HomeMy WebLinkAboutResolution 02-193-CCBOARD OF COUNTY COMMISSIONERS Grant Countv, Washington A RESOLUTION APPROVING THE 1 RESOLUTION NO. 02193 -CC FORMATION OF GRANT COUNTY ROAD 1 IMPROVEMENT DISTRICT NO. 02-1 t (TURNKEY ROAD) FOR ROAD AND I STREET LIGHTING 1 A Resolution of the Board of County Commissioners of Grant County, Washington, to form a street and road lighting road improvement district and to order improvements to the street and road lighting within the boundaries of said proposed road and street lighting road improvement district by and through the construction, installation, improvement, operation, and maintenance of street and road lighting systems within the boundaries of said proposed road and street lighting road improvement district; setting forth the nature and the territorial extent of the improvement; stating the estimated cost and expense of the improvements and operating costs and the amount proposed to be borne by the property within the proposed district. WHEREAS, Grant County (the "County"), Washington, is a Class 3 county, duly organized and existing under the Constitution and laws of the State of Washington; and WHEREAS, the Board of County Commissioners (the "BOCC") of the County, is authorized to conduct proceedings and to initiate raid improvement districts for street and road lighting pursuant to chapter 36.88 RCW; and WHEREAS, the BOCC was presented with a petition by the property owners on Turnkey Road NE requesting that the County form a road and Improvement district for street and road lighting; and A RESOLUTION APPROVING THE FORMATION OF GRANT COUNTY ROAD IMPROVEMENT DISTRICT NO. 02 1 FOR ROAD AND STREET LIGHT1\11 H,AFORMSVCIVIL8AM-R\RESOLUTIONS\RID 120402DOC Page I WHEREAS, the County Auditor determined that the petition contained signatures of the owners of the property, according to the records of the County Auditor, to an aggregate amount of a majority of the lineal frontage upon the improvement t o be made and of the area within the limits of the assessment district to be created therefore; and WHEREAS, the BOCC determined that the petition was legally sufficient according to the records of the County Auditor; and WHEREAS, the BOCC determined that it is advisable and necessary for the public health, safety and welfare to establish, and construct certain 4rect and road lighting improvements; and WHEREAS, the BOCC determined that the property in the proposed district was sufficiently developed to qualify for a road improvement district for street and road lighting; and WHEREAS, the County Road Engineer ("Engineer") recommends that the property in the proposed district is sufficiently developed to qualify for a road improvement district for street and road lighting; and WHEREAS, the BOCC determined that it is economically feasible to construct said improvements, and that a road improvement district for street and road lighting be created and assessments be levied therein in order to pay the costs and expenses of the acquisition, construction, installation, maintenance and operation of such improvements by PUD No. 2 of Grant County; and WHEREAS, the BOCC determined that the most equitable way to finance such improvements is by the creation of a road improvement district for street and road lighting, the costs of which shall be borne by the property owners within the district, and WHEREAS, the BOCC decided to establish the road improvement district for road and street lighting. THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Grant County, Washington, as follows: SECTION 1: The BOCC hereby orders the creation and establishment ofroad improvement district for street and road lighting, to be designated and known as Grant County Road Improvement District No. 02-1 (RID No. 02-1), which district includes all properties within the District and to order the acquisition, construction and installation of the improvements to the area within the County described in Exhibit "A" attached hereto, and by this reference made a part hereof as though fully set forth herein. The BOCC has determined that the plan of improvement and construction for RID No. 02-1 is feasible and, the benefits to be derived by the creation of RID No. 02-1 do not exceed the costs and expenses of the formation of RID No 02- and the construction and improvement. A RESOLUTION APPROVING THE FORMATION OF GRANT COUNTY ROAD IMPROVEMENT DISTRICT NO. 02 1 FOR ROAD AND STREET LIGHTIN( H:«'ORMS\CIVILB\M-R\RESOLUTIONSIRfD I1040Z DOC Page 2 SECTION 2: The nature of the improvements will consist of designing, installing and constructing, operating and maintaining a street and road lighting system, and other work as maybe necessaryin conjunction with the development of RID No. 02-1. Itis hereby provided that the plans for the acquisition, construction and installation of the improvements shall be subject to such changes in detail not affecting the service to be provided and as shall be authorized by the BOCC either prior to or during the course of construction. The territorial extent of the proposed improvements shall be that portion of Grant County encompassed by the property owners on Turnkey Road NF„ Moses Lake, Grant County, Washington, more particularly described in Exhibit "A," attached hereto and by this reference made a part hereof as though fully set forth herein. SECTION 3: The territorial extent of the boundaries of RID No. 02-1 are also set forth in Exhibit "A." SECTION 4: The total original construction costs of acquiring and constructing the proposed improvements shall be bome by PUD No. 2 of Grant County (PUD), and the annual operating and maintenance costs, including administrative fees, shal I be home by the property owners within the proposed district. The total costs of required improvements, and the annual operating and maintenance costs, including administrative fees, shall be assessed to the properties in RID No. 02-1. The method of assessment and payment for said lighting system shall be an annual assessment to be assessed to each property owner within the district, based on the number ofparcels owned within the RID, to pay the annual costs of operation as determined by the PUD, plus costs to the County in administering said district which is not to exceed ten percent. Said annual assessment shall be prepared by the County upon advice from the PUD as to the annual anticipated lighting costs of the district and shall be certified by the BOCC to the County Treasurer for collection by the County Treasurer; and, said special assessment shall be a lien upon the respective lots, tracts and parcels of land within the district pursuant to chapter ')6.88 RCW. The first assessment roll shall be presented upon the completion of the lighting project and the turning on of the lights by the PUD. The initial assessment will be Thirty Six and No/100 Dollars ($36.00) per year, for each lot, tract, or parcel of land, for the first calendar year, including the cost of power. The annual assessment shall be the same each succeeding year. No new assessment roll will be prepared unless or until there is an increase or decrease in the annual anticipated lighting costs submitted to the County by the PUD in which event a new annual assessment shall be prepared. The monthly billings will be held until the County collects the annual assessments from the landowners. Due dates for payments, interest and penalties sha I I correspond with those already established for the payment of real property taxes. A RESOLUTION APPROVING THE FORMATION OF GRANT COUNTY ROAD IMPROVEMENT DISTRICT NO. 02 1 FOR ROAD AND STREET LIGHTING H:\FORMS\CIVIL8\M-R\RESOLUTIONS\RID 12040: DOC Page 3 SECTION 5: A public hearing was held on .January 23, 2002, at 1:30 p.m., in the Grant County Courthouse, Commissioners' Hearing Room, located at 35 C Street NW, Ephrata, Washington 98823, when and where owners or reputed owners of property within the boundaries of proposed RID No. 02-1, appeared and stated their vie,,vs relating to the creation of proposed RID No. 02- 1, the making of the proposed improvements, the method of payment therefore and all objections thereto. Those persons who desired to object to the formation of proposed RID No. 02-1 and the ordering of the improvements therein, were able to present such objections, in writing, to the Clerk of the BOCC, prior to the time of the hearing. The total project costs will be paid by special assessments levied against property within proposed RID No. 02-1, and specially benefited by such improvements, SECTION 6: The BOCC reviewed a diagram or print showing thereon the lots, tracts and parcels of land and other property which will he specially benefited thereby, and the estimated amount of the cost and expense of such improvement to be borne by each lot, tract or parcel of land or other property, and also designation thereon all property which is being purchased under contract from Grant County. SECTION 7: The Clerk of the BOCC gave notice of the aforementioned hearing by publication in at least two (2 ) consecutive issues of a newspaper of general publication in Grant County, the date of first publication at least fifteen ( t '�) days prior to the date fixed for public hearing before the BOCC. Notice was given each owner or reputed owner of any lot, tract or parcel of land or other property within the proposed improvement district by mailing said notice to the owner or reputed owner of the property as shown on the tax rolls of the County Treasurer at the address shown thereon, at least fifteen (15) days before the date fixed for the public hearing. Said notice shall set forth the nature of the proposed improvement, the total estimated cost, the proportion of total cost to be borne by assessments, the estimated amount of the cost and expense of such improvement to be borne by the particular lot, tract or parcel, the date and place of the hearing before the BOCC. The notice given to the public or to the owners of specific lots, tracts, or parcels of land relating to the formation of the improvement district contained a statement that actual assessments may vary from assessment estimates so long as they do not exceed a figure equal to the increased true and fair value the improvement adds to the properh . BOUNDARIES AND TERRITORIAL EXTENT OF UTILITY LOCAI. IMPROVEMENT DISTRICT NO. 02-1 The improvements will consist of designing, installing, constructing, maintaining and operating a street and road lighting system and other work as may be necessary in conjunction with the development of this utility local improvement distrnc The nature and territorial extent of the proposed improvements is generally outlined as follows: a portion of Turnkey NE, Northeast of Moses Lake Urant County, Washington. The legal description of the boundaries of proposed RID No. 02-1 is as follows: A portion of Section 32 and 33, Township 20 North, Range 28 East, W.M., and a Portion of Section 4, Township 19 North, Range 28 East, W.M., County of Grant, State of Washington, described as follow s: A tract of land commencing at the intersection of Patton Blvd. And Arlington Drive (Grant County Airport); thence North 53°50'54" East along the centerline of 22"d Avenue, a distance of 30.15 feet, thence North 30°26'41" West, a distance of 30.15 feet to the intersection of the right-of-way for 22"d Avenue and Patton Blvd., said point being the True Point of Beginning; thence continuing North 30°26'41" West along the Northeasterly right-of-way boundary line of Patton Blvd., a distance of 1570.93 feet. continuing Northwesterly along the Northeasterly right-of-way boundary line of said street, a distance of 99.07 feet along a curve concave to the Northeast having a radius of 686.20 feet, said chord being North 22°05'33" West, a distance of 98.36 feet; thence Northeasterly parallel with the Northwesterly boundary of Lot 21of Turnkey Estates #1, a plat recorded in Book 11 Page 12, Grant Countv Washington, to an intersection with the Northeasterly boundary of Lot 22 of said plat; thence South 56°26'01" East along said Northeasterly boundary of said Lot 22 to the most Northerly corner of Lot 21; thence South 56°26'01" East, 19.85 feet: thence South4l°47'58" East, a distance of 257.83 feet; thence South 30"25"39" East, a distance of 1312.38 feet to the Northwesterly right-of-way boundary line for the street known as 22"d Avenue; thence South 53°50'54" West along the Northwesterly right-of-way boundary line of said street, a distance o" 170.85 feet to the True Point of Beginning.
