HomeMy WebLinkAboutResolution 04-035-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington RESOLUTION IN THE MATTER OF RESOLUTION No. 04- 035 -CC APPROVING A PLAT ALTERATION OF LOT #209 OF THE LARSON SUBDIVISION. THE SUBJECT SITE IS LOCATED IN PLAT ALTERATION #10 OF THE SECTION 04, TOWNSHIP 19 NORTH, LARSON SUBDIVISION RANGE 28, EWM, GRANT COUNTY, WA NORMAN T. HOPPERSTAD WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on November 5, 2003 in the matter of a preliminary plat alteration of Lot 209 of the Larson Subdivision creating (2) lots from (1); which is located in a portion of Section 04, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission on November 5, 2003 did approve a motion to recommend to the Board of County Commissioners t5 approve this proposed preliminary plat alteration with thirteen (13) suggested conditions of approval; and, WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on February 10, 2004; and, WHEREAS, the Board of County Commissioners, have reviewed the application file, staff report and Planning Commission minutes; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the preliminary plat alteration; and, WHEREAS, the proposed preliminary plat alteration meets the applicable requirements of Unified Development Code, Chapter 22.04 "Land Division"; and, WHEREAS, the proposed preliminary plat alteration does comply with the Health District's requirements for sewage disposal and potable water supply; and, Page 1 of 4 WHEREAS, the proposed preliminary plat alteration does contain an accurate legal description of the lots being created, and the roads and easements therein; and, WHEREAS, the proposed preliminary plat alteration does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Board of County Commissioners have made a decision to approve the Larson Subdivision Replat #10 preliminary plat alteration. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, with the (13) conditions of approval listed below, a preliminary plat alteration of Lot 209 of the Larson Subdivision creating (2) lots from (1); which is located in a portion of Sections 04, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington; Conditions Of Approval: The Proposal shall be in compliance with the Grant County Comprehensive Plan, the Grant County Unified Development Coee, the Growth Management Act, The Washington State Environmental Policy Act, the Grant County Zoning Ordinance, the Grant County Resource Lands and Critical Areas Development Ordinance and all applicable federal, state, and local regulations, rulings or requirements. Proposal shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. Proposal shall comply with all requirements of the Grant County Fire Marshal and shall comply with the Grant County Fire Flow Guidelines, the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection. 4. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 5. Preliminary Re -plat approval shall be contingent upon conformance with all applicable land use rules and regulations in effect as of October 6, 2003. 6. Development shall comply with Grant County Unified Development Code Chapter 22.04 Article 5 "Fipal Subdivisions and Short Subdivisions." Page 2 of 4 7 13 W, 10. 11 12. 13 Development shall comply with all requirements of the Grant County Auditors' Office including but not limited to: a. The name of the subject replat shall be "Larson Subdivision Replat #10." On sheet 1 of 3 on the face of the plat, change the "block of information" to read as follows: Zoning: Max DU Density: Overall Acreage: Number of Lots: Max Potential DUs: Roads Dedicated: Urban Residential 3 (UR3) 8 DU/ 1 Acre .56t Acres 4 0.00 Acres Since the existing 2 -car carport located on the subject parcel will encroach upon zoning district setbacks, an approved variance permit is required prior to final replat approval. A recommended condition of approval by the Grant County Planning Commission was the provision on the final plat for existing power and PUD approachment Development shall comply with all requirements of the Grant County Public Works Department including but not limited to: a. Provide replat check fee of $100.00 b. Both lots shall use the same existing approach and parking area. Lot 209A shall have the right to ingress and egress across Lot 209B and Lot 209B shall have the right to ingress and egress across Lot 209A to use the approach, parking area and walkway, this shall show on the face oaf the plat. Found 5/8" rebar and caps need description. C. An easement through Lot 210 for the driveway needs to be obtained and shown on the face of the plat. Development shall comply with all requirements of the U.S. Bureau of Reclamation. Including but not limited to: a. Insertion on to final plat of Bureau of Reclamation language with regards to the Columbia Basin Irrigation Project Development shall comply with the requirements of the Grant County Auditors office including but not limited to: a.
