HomeMy WebLinkAboutResolution 02-102-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON IN THE MATTER OF A REPLAT OF LOTS 464 & 465 OF DESERT AIRE #1 IN A PORTION OF SECTION 22; TOWNSHIP 14 NORTH; RANGE 23 EAST; WILLAMETTE MERIDIAN, GRANT COUNTY, WASHINGTON RESOLUTION NO. 2002 -102 -Cc RESOLUTION APPROVING A PLAT ALTERATION ROGER AND NANCY SCHMAHL WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on May 1, 2002, on the matter consolidating lots 29 & 30 of Desert Aire #6 in a portion of the Section 26; Township 14 North; Range 23 East; Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission on May 1, 2002, made a recommendation to the Board of County Commissioners to approve this proposed plat alteration; and, WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on June 3, 2002; and, WHEREAS, the Board of County Commissioners have made a decision to uphold the recommendation to approve the proposed plat alteration request; and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan; and, WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the plat alteration; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposal has been reviewed for Critical and Cultural Resource Areas according to the Unified Development Code Chapter 24.08 and Critical Areas Maps and appears to not be located in any of these areas; and, WHEREAS, the Board of County Commissioners have concluded that appropriate provisions for drainage, roads, alleys, utilities, public ways, water supplies, sanitary wastes, parks, playgrounds, fire protection facilities, school sites, and grounds and other public and private facilities and improvements have been made in making its decision IN THE MATTER OF A REPLAT OF LOTS PAGE 2 OF 3 464 & 465 OF DESERT AIRE #1 IN A PORTION SECTION 22; TOWNSHIP 14 NORTH; RANGE 23 EAST; WILLAMETTE MERIDIAN, ROGER AND NANCY GRANT COUNTY, WASHINGTON SCHMAHL NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, a plat alteration to consolidate Lots 464 & 465 of Desert Aire #1 in a Portion of Section 22; Township 14 North; Range 23 East; Willamette Meridian, Grant County, Washington. Conditions of Approval: The Following are conditions of approval which were utilized in the Grant County Board of County Commissioner's closed record public hearing to approve the granting of this plat alteration 1. Development shall be in compliance with the Growth Management Act, The County -Wide Planning Policies, The Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2. Development shall comply with all applicable requirements of the Grant County Fire Flow guidelines and the Uniform Building Code and Uniform Fire Code. 3. Development shall comply with all improvements required by the Grant County Public Works Department 4. Developer shall comply with all requirements deemed necessary by the Grant County Health District , the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to: RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201 A, Ground Water Quality Standards and WAC 246-272, On -Site Sewage Systems. Proposal shall comply with all requirements of the Grant County Assessor's Office. Approval of the plat alteration shall be contingent upon conformances with all applicable land use rules and regulations in effect as of April 4, 2002. IN THE MATTER OF A REPLAT OF LOTS 464 & 465 OF DESERT AIRE # IN A PORTION SECTION 22; TOWNSHIP 14 NORTH; PAGE 3 OF 3 RANGE 23 EAST; WILLAMETTE MERIDIAN, ROGER AND NANCY GRANT COUNTY, WASHINGTON SCHMAHL 7. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation.
