HomeMy WebLinkAboutResolution 03-169-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington RESOLUTION IN THE MATTER OF RESOLUTION No. 03-10 -CC APPROVING A PLAT ALTERATION OF LOT 58 OF THE LARSON SUBDIVISION. THE SUBJECT SITE IS LOCATED IN SECTION 04, TOWNSHIP 19 NORTH, RANGE 28, EAST, WM. GRANT CO., WA. PLAT ALTERATION #9 OF THE LARSON SUBDIVISION NORMAN T. HOPPERSTAD WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on November 5, 2003 in the matter of a preliminary plat alteration of Lot 58 of the Larson Subdivision creating (2) lots from (1); which is located in a portion of Section 04, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington; and WHEREAS, the Grant County Planning Commission on November 5, 2003 did approve a motion to recommend to the Board of County Commissioners to approve this proposed preliminary plat alteration with nine (9) suggested conditions of approval; and WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on December 22, 2003; and WHEREAS, the Board of County Commissioners, have reviewed the application file, staff report and Planning Commission minutes; and WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the preliminary plat alteration; and WHEREAS, the proposed preliminary plat alteration meets the applicable requirements of Unified Development Code, Chapter 22.04 "Land Division"; and WHEREAS, the proposed preliminary plat alteration does comply with the Health District's requirements for sewage disposal and potable water supply; and Page 1 of 3 WHEREAS, the proposed preliminary plat alteration does contain an accurate legal description of the lots being created, and the roads and easements therein; and WHEREAS, the proposed preliminary plat alteration does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and WHEREAS, the Board of County Commissioners have made a decision to approve the Larson Subdivision Replat #9 preliminary plat alteration. NOW, THEREFORE, BE IT RESOLVED, THAT the Board of County Commissioners for Grant County, Washington approve by this Resolution, with the (9) conditions of approval listed below, a preliminary plat alteration of Lot 58 of the Larson Subdivision creating (2) lots from (1); which is located in a portion of Sections 04, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington; CONDITIONS OF APPROVAL: Development shall be in compliance with the Washington State Environmental Policy Act, the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. Proposal shall comply with all requirements deemed necessary by the Grant County Health District, by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 3. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 4. Approval of the plat shall be contingent upon conformance with all applicable land use rules and regulations in effect as of October 7, 2003. 5. This proposal shall comply with all the requirements of the Grant County Fire Marshal, including but not limited to: a. A fire resistive separation is required on the common property line. Contact the Building Department for more information. 6. This proposal shall comply with all the requirements of the Grant County Assessor, including but not limited to: Page 2 of 3 91 91 a. Second half taxes due by 10/31/03. This proposal shall comply with all the requirements of the Grant County Auditor, including but not limited to: a. This Replat shall be named, "Larson Subdivision Replat No. 9. This proposal shall comply with all the requirements of the Grant County Public Works Department, including but not limited to: a. Provide a Plat check fee of $100.00. b. Both Lots shall use the same existing approach and parking area. Lot 58B shall have the right to ingress and egress across Lot 58A to use the approach and parking area, this shall be shown on the face of the Plat. C. A note shall be place on the face of the plat that both lots shall maintain a utility easement to provide access to the power meter and power lines. Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a. Comply with all requirements listed in UDC Chapter 22.04 Article V Final Subdivisions and Short Subdivisions. b. A variance to the setback requirements of Grant County Code 23.12 is required for the approval of this proposal. DATED this aSO day of December, 2003.
