HomeMy WebLinkAboutResolution 03-005-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON IN THE MATTER OF APPROVING A PRELIMINARY PLAT OF TWENTY- ONE ACRES± INTO FORTY-EIGHT LOTS. SUBJECT SITE IS LOCATED IN SECTION 3, TOWNSHIP 18 NORTH, RANGE 28, EAST, WM.GRANT CO. WA. RESOLUTION NO. 2003 -005 -CC RESOLUTION APPROVING A PRELIMINARY PLAT Sand Castle Estates LLC WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on December 4, 2002, on the matter of a preliminary plat of twenty-one point two nine acres into forty-eight lots; which is located in a portion of Sections 3, Township l8 North, Range 28 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission on December 4, 2002 did unanimously approve a motion to recommend to the Board of County Commissioners to approve this proposed preliminary plat with thirteen suggested conditions of approval; and, WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on December 30, 2002; and, WHEREAS, the Board of County Commissioners, have reviewed the application file, staff report and Planning Commission minutes; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safely, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the preliminary plat; and, WHEREAS, the proposed preliminary plat meets the applicable requirements of Unified Development Code, Chapter 22.04 "Land Division"; and, WHEREAS, the proposed preliminary plat does comply with the Health District's requirements for sewage disposal and potable water supply; and, Page 2 of 4 IN THE MATTER OF APPROVING A PRELIMINARY PLAT OF TWENTY- ONE ACRES± INTO FORTY-EIGHT LOTS. WHEREAS, the proposed preliminary plat does contain an accurate legal description of the lots being created, and the roads and easements therein; and, WHEREAS, the proposed preliminary plat does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Board of County Commissioners have made a decision to approve the preliminary plat. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, and with the conditions of approval listed below, a preliminary plat of twenty-one point two nine acres into forty-eight lots; which is located in a portion of Sections 3, Township 18 North, Range 28 East, Willamette Meridian, Grant County, Washington; CONDITIONS OF APPROVAL 1. The Proposal shall be in compliance with, the Washington State Environmental Policy Act, the Grant County Unified Development Code and all applicable federal, state, and local regulations, rulings or requirements. 2. Proposal shall comply with all requirements deemed necessary by the Grant County Health District, including: a. The Pelican Point Water system must have approval from the Washington State Department of Health for the number of connections resulting from this expansion. b) A site evaluation will be required for each lot. The evaluation must be done by a certified septic system designer or licensed engineer and submitted to the Health District. A pressure dosing design will be required for each lot. 3. Proposal shall comply with all requirements deemed necessary by the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201 A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 4. Proposal shall comply with all requirements of the Grant County Fire Marshal and shall comply with County Fire Flow Guidelines, the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection and life safety including, location and installation ofhydrant system shall be inspected and approved by Grant County Fire District #k5. Page 3 of 4 IN THE MATTER OF APPROVING A PRELIMINARY PLAT OF TWENTY- ONE ACRES± INTO FORTY-EIGHT LOTS. 5. Roads need to be designated to the Grant County grid system per the Grant County Addressing Ordinance 85 -143 -CC. Developer must contact Grant County Emergency Services Office. 6. Proposal shall comply with all requirements of the Grant County Public Works Department, including, but not limited to the following: a) Scenic Drive shall be extended south to Dune Lake Road. b) A complete road plan and profile is required for approval. Roads shall be built to current County Road Standards or bonded to guaranty the road construction. c) Provide a five-foot utility easement along all lot lines and County roads. d) An access permit is required prior to the issuance of a building permit. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found on the proposed site all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 8. Development shall comply with all requirements of the Grant County Planning Department, including but not limited to: a) All requirements of UDC Chapter 22.04, Article V, Subdivisions and Short Subdivisions. b) The location, width, and nature of "proposed utility easements" located along property lines shall be identified as a "note" and not drawn. c) Add the following "block" of information to the final plat: Zoning: Urban Residential -2 Overall acres e: 21.29 -acres 48 Number of Lots: Max Residential Density: 1 DU per '/4 -acres 85 Max Potential DU's: Roads: ( ) acres R/W Dedicated 9. During road grading and/or construction activities, county roads shall be maintained clear of soil and rocks at the point of ingress/ egress. 10. The developer shall comply with GCC 23.12.040 or work with the City of Moses Lake to determine the wording of a "Covenant" to be recorded with the Grant County Auditor and noted on the face of the plat, that will satisfy the city in regard to the required cash payment for future utilities pursuant to GCC 23.12.040(g). 11. All lots shall have a public utility easement 5 feet in width along all interior lot boundaries and 10 feet in width along all exterior lot boundaries. Approval of the plat shall be contingent upon conformance with all applicable land use rules and regulations in effect as of October 17, 2002. PASSED AND ADOPTED this 7'�± day of _]�nUand 200_'.
