HomeMy WebLinkAboutResolution 03-013-CC80Att F,.00 'I MM.I I;I i 1 FtS, Ia Oft Cy YVASHIN IN THE MATTER OF A REPLAT OF LOTS #407 & ) #408 OF DESERT AIRE # 1, REPLAT PART, ) LOCATED IN A PORTION OF SECTION 22; ) TOWNSHIP 14 NORTH; RANGE 23 EAST; ) WILLAMETTE MERIDIAN, GRANT COUNTY, ) WASHINGTON, IN ORDER TO CREATE ONE LOT ) RESOLUTION NO. 2003 _013—CC RESOLUTION APPROVING A ONE LOT PLAT ALTERATION RASHELL DENNING WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on December 4, 2002, at 7:00 pm, on the matter of creating ONE (1) lot from lots #407 and #408 of Desert Aire #L Replat Part, located in a portion of Section 22; Township 14 North; Range 23 East; Willamette Meridian, Grant County, Washington; (Parcels: 402-1689-004 and 02-1689-005) and, WHEREAS, the Grant County Planning Commission on December 4, 2002, made a recommendation to the Board of County Commissioners to approve this proposed plat alteration; and, WHEREAS, the Grant County Board of County Commissioners held a closed record public hearing on January 21, 2003; and, WHEREAS, the Board of County Commissioners have made a decision to uphold the recommendation to approve the proposed plat alteration request; and, WHEREAS, the Board of County Commissioners have found that the subject proposal lies in the Rural Village Residential 1 Zoning District of Grant County; and, WHEREAS, the Board of County Commissioners have found that the subject proposal lies in the Rural Village Comprehensive Plan Land -Use Designation and thus is consistent with the underlying zoning district as required by Grant County Code and Washington State Growth Management Act; and, WHEREAS, the Board of County Commissioners have found that the subject replat underwent SEPA review and that a Determination of Non -Significance (DNS) was issued on November 14, 2002; and, WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the plat alteration; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and, IN THE MATTER OF A REPLAT OF LOTS #407 & #408 OF DESERT AIRE #1, REPLAT PART, CREATING ONE (1) LOT. PAGE 2OF3 NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington, approve by this resolution, a plat alteration to create one (1) lot from lots #407 and #408 of Desert Aire #1, Replat Part, located in a portion of Section 22; Township 14 North; Range 23 East; Willamette Meridian; Grant County, Washington. "Conditions of Approval:^ The following are conditions of approval, which were used in the Grant County Board of County Commissioner's closed record public hearing to approve the proposed plat alteration: 1) The Proposal shall be in compliance with the Grant County Comprehensive Plan, the Grant County Unified Development Code, the Growth Management Act, The Washington State Environmental Policy Act, the Grant County Zoning Ordinance, the Grant County Resource Lands and Critical Areas Development Ordinance and all applicable federal, state, and local regulations, rulings or requirements. 2) Proposal shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards: and, WAC 246-272, On -Site Sewage Systems. 3) Proposal shall comply with all requirements of the Grant County Fire Marshal and shall comply with the Grant County Fire Flow Guidelines, the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection. 4) If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 5) Preliminary Re -plat approval shall be contingent upon conformance with all applicable land use rules and regulations in effect as of November 14, 2002. f 6) Preliminary Replat approval shall be consistent with recorded restrictions with Final Plat approval of Desert Aire #1, Replat Part, as recorded on March 26, 1983. 7) Development shall comply with Grant County Unified Development Code including but not limited to Chapter 22.04 & § 22.04.260 "Time Limitations." 8) Development shall comply with Grant County Unified Development Code Chapter 22.04 Article 5 "Final Subdivisions and Short Subdivisions." 9) The location, width, and nature of proposed utility easements located along property lines shall be identified as a "note" on the final plat and not drawn. 10) Development shall comply with all requirements of the Grant County Public Utility District including but not limited to: A) Add to plat "all lots subject to a public utility easement 5' in width on all internal lot boundaries and 10' in width on all exterior lot boundaries." PAGE 3 OF 3 11) Development shall comply with all requirements of the Grant County Auditors' Office including but not limited to: A) The duplicate recorder's certificate and surveyor's certificate on sheet #2 are not needed. B) The name should be "Desert Aire No. 1, Replat No. 16." 12) On sheet 1 of 2 on the face of the plat, change the "block" of information to read as follows Zoning: Rural Village Residential 1 (R VRI) MaxDUDensity: 4DUI I Acre Overall Acreage. 0.68± Acres Number of Lots: I Max Potential DUs: 2 Roads Dedicated: 13) Development shall comply with all requirements of the Grant County Public Works Department including but not limited to: A) Provide a replat check fee of $100.00 B) An approach permit is required prior to the issuance of a building permit. C) Provide USER data on the face of the plat. D) Provide all boundary lines, existing easements and dedications with Auditor file numbers and all proposed easements and dedications E) Provide vicinity map with more detail than has been provided. F) Provide a 5' utility easement along all lot lines and county roads. PASSED AND ADOPTED this 0`3� day of 2003.
