HomeMy WebLinkAboutResolution 03-039-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington A RESOLUTION APPROVING A REPLAT RESOLUTION NO. 2003-*VCC OF LOT #413, CONSISTING OF 1.1491 ACRES, LOCATED IN LARSON SUBDIVISION IN ORDER TO CREATE THREE (3) LOTS. LOT #1 WILL BE 0.4271 ACRES, LOT #2 WILL BE 0.4061 ACRES, AND LOT #3 WILL BE 0.316± ACRES. WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on March 5, 2003, at 7:00 p in, on the matter of creating three (3) lots from lot #413 of Larson Subdivision, located in a portion of Sections 4 and 5; Township 19 North; Range 28 East; Willamette Meridian, Grant County, Washington; (Parcel: #31-0413-000); and WHEREAS, the Grant County Planning Commission on March 5, 2003, made a unanimous recommendation of approval to the Board of County Commissioners; and WHEREAS, the Grant C ounty Board of County Commissioners held a closed record public hearing on April 1, 2003; and WHEREAS, the Board of County Commissioners have made a decision to uphold the recommendation to approve the proposed plat alteration request; and WHEREAS, the Board of County Commissioners have been advised by the Planning Department that the subject replat was processed in accordance with the requirements of the Grant County Code, Chapter 22.04 "Subdivisions and Plats," Chapter 23.12 "Development Standards," and Chapter 25.04 "Permit Application Review Procedures;" and WHEREAS, the Board o f County Commissioners have b een advised by the Planning Department that pursuant to Grant County Code, Chapter 24.08, critical areas review was performed and that the subject parcel does not appear to lie therein; and WHEREAS, the Board o f County Commissioners has found that the subject proposal lies in the Urban Residential 3 Zoning District and corresponding Residential Medium Density Comprehensive Plan Land -Use Designation and thus is consistent as required by Grant County Code and RCW 36.70A; and WHEREAS, the Board of County Commissioners have found that the subject replat underwent SEPA review pursuant to Grant County Code, Chapter 24.04 and that a Determination of Non -Significance (DNS) was issued on February 7, 2003; and A Resolution Approving A Replat Of Lot #413, Consisting Of 1.149± Acres, Located In Larson Subdivision H VCommissionersVOFields\Resolution-OrdinanccAIncker doc Page 1 of 4 WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the replat; and WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal, NOW, T HEREFORE, BE I T H EREBY RESOLVED T HAT t he Board of County Commissioners for Grant County, Washington, approve by this resolution, a plat alteration to create three (3) lots from lot #413 of Larson Subdivision located in a portion of Sections 4 and 5; Township 19 North; Range 28 East; Willamette Meridian; Grant County, Washington. "Conditions of Approval" 1. The Proposal shall be in compliance with the Grant County Comprehensive Plan, the Grant County Unified Development Code, the Growth Management Act, The Washington State Environmental Policy Act, the Grant County Zoning Ordinance, the Grant County Resource Lands and Critical Areas Development Ordinance and all applicable federal, state, and local regulations, rulings or requirements. 2. Proposal shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to; RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201A, Ground Water Quality Standards; and, WAC 246-272, On -Site Sewage Systems. 3. Proposal shall comply with all requirements of the Grant County Fire Marshal and shall comply with the Grant County Fire Flow Guidelines, the Uniform Building Code, Uniform Fire Code and all other applicable requirements for fire protection. 4. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, the Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 5. Preliminary Re -plat approval shall be contingent upon conformance with all applicable land use rules and regulations in effect as of February 7, 2003. 6. Preliminary Replat approval shall be consistent with recorded restrictions with Final Plat approval of Larson Subdivision, as recorded in the Auditors' Office on April 25, 1978. 7. Development shall comply with Grant County Unified Development Code including but not limited to Chapter 22.04 and § 22.04.260 "Time Limitations." Development shall comply with Grant County Unified Development Code Chapter 22.04 Article 5 "Final Subdivisions and Short Subdivisions." 9. The location, width, and nature of proposed utility easements located along property lines shall be identified as a "note" on the final plat and not drawn. 10. Development shall comply with all requirements of the Grant County Auditors' Office including but not limited to: a. All references to "short plat" on the plat maps shall be changed to "replat." 11. On sheet l o f 2 on the face o f the p lat, change the "block o f information" to read as follows: Zoning: Urban Residential 3 (UR3) MaxDUDensity: 8DUI I Acre Overall Acreage: 1.149± Acres Number of Lots: 3 Max Potential DUs: 9 Roads Dedicated: 0.00- Acres R/W Dedicated to County 12. Pursuant to GCC § § 22.04.320 (h) (7), minimum road frontage for each lot is fifty (50) feet. Therefore, please correct lot #1 to reflect this requirement. 13. Development shall comply with all requirements of the Grant County Department of Emergency Services including but not limited to: a. Addressing will remain as established: Lot 1: 934 and 936 Lowry Lot 2: 938 and 940 Lowry Lot 3: 942 and 944 Lowry 14. Development shall comply with all requirements of the Grant County Planning Commission including but not limited to: The subject six (6) car garage, currently located on proposed lot #1 and 2, shall be moved entirely onto one of the proposed lots. 15. Development shall comply with all requirements of the Grant County Public Works Department including but not limited to: a. Provide a $100.00 replat check fee. b. A 5' utility easement is required along all interior lot lines.
