HomeMy WebLinkAboutResolution 03-103-CCBOARD OF COUNTY COMMISSIONERS GRANT COUNTY, WASHINGTON RESOLUTION: IN THE MATTER OF APPROVING A PRELIMINARY PLAT OF 2.93 ACRES INTO SEVEN LOTS. SUBJECT SITE IS LOCATED IN SECTION 3, TOWNSHIP 18 NORTH, RANGE 28, EAST, WM. GRANT CO. WA. RESOLUTION No. 2003- /0330, -CC APPROVING A PRELIMINARY PLAT OF SANDCASTLE ESTATES #4 WHEREAS, the Grant County Board of County Commissioners have been advised that an open record public hearing was conducted, before the Grant County Planning Commission on May 7, 2003, on the matter of a preliminary plat of 2.93 acres into seven (7) lots; which is located in a portion of Sections 3, Township 18 North, Range 28 East, Willamette Meridian, Grant County, Washington; and, WHEREAS, the Grant County Planning Commission on May 7, 2003 did approve a motion to recommend to the Board of County Commissioners to approve this proposed preliminary plat with eight (8) suggested conditions of approval; and, WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on July 8, 2003; and, WHEREAS, the Board of County Commissioners, have reviewed the application file, staff report and Planning Commission minutes; and, WHEREAS, the Board of County Commissioners have found that the proposal will not adversely effect the health, safety, and general welfare of the public in the vicinity of the proposal; and, WHEREAS, the Board of County Commissioners have found that the proposal is consistent with the Grant County Comprehensive Plan, the Unified Development Code, Chapter 23.04 "Zoning", other land use regulations, and SEPA; and, WHEREAS, the Board of County Commissioners have found that the public use and interest will apparently be served by the preliminary plat; and, WHEREAS, the proposed preliminary plat meets the applicable requirements of Unified Development Code, Chapter 22.04 "Land Division"; and, IN THE MATTER OF APPROVING A SANDCASTLE ESTATES #4 PRELIMINARY PLAT OF 2.93 ACRES± INTO SEVEN LOTS WHEREAS, the proposed preliminary plat does comply with the Health District's requirements for sewage disposal and potable water supply; and, WHEREAS, the proposed preliminary plat does contain an accurate legal description of the lots being created, and the roads and easements therein; and, WHEREAS, the proposed preliminary plat does comply with Grant County regulations pertaining to roads, utilities, drainage, access for emergency vehicles, and other infrastructure improvements; and, WHEREAS, the Board of County Commissioners have made a decision to approve the Sandcastle Estates #4 preliminary plat. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners for Grant County, Washington approve by this Resolution, with the conditions of approval listed below, a preliminary plat of two point nine three (2.93) acres into seven (7) lots; which are located in a portion of Sections 3, Township 18 North, Range 28 East, Willamette Meridian, Grant County, Washington; CONDITIONS OF APPROVAL: 1. Development shall be in compliance with the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. 2. Development shall comply with all applicable requirements of the Grant County Fire Marshall, the Grant County Fire Flow guidelines and the Uniform Building Code and Uniform Fire Code. 3. Development shall comply with all conditions imposed by the Grant County Public Works including but not limited to: a) The road to access proposed lots shall be bonded with Sand Castle Estates #6, or the road is constructed and logged into the (Grant) County Road System before final approval. IN THE MATTER OF APPROVING A SANDCASTLE ESTATES #4 PRELIMINARY PLAT OF 2.93 ACRES± INTO SEVEN LOTS 4. Developer shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Department of Ecology, regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to: site evaluations for septic systems. If the results of the site evaluation for this proposal concluded that the soil has a "l -A" classification, the minimum lot size will need to be .5 (1/2) acres. If the soil were of a 1-A classification the overall acreage of 2.93 acres would be sufficient for 5 lots. Approved water system by the Washington State Department of Health. RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201 A, Ground Water Quality Standards and WAC 246-272, On -Site Sewage Systems, 5. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 6. Development shall comply with the requirements of the Grant Count Emergency Services Office including but not limited to: a) Naming of Roads as per Grant County Ordinance #85 -143 -CC 7. Development shall comply with all requirements of Grant County's Planning Department, including but not limited to: a) Comply with all requirements listed in UDC Chapter 22.04 article V, final subdivisions and short plats. b) Pursuant to GCC 23.04.080(d), the landowner shall be required to acknowledge and sign a Right to Farm Disclosure Form, which shall be recorded with the Grant County Auditor and noted on the face of the plat, or Right to Farm Disclosure statement can be added to the face of the plat. c) Applicant shall comply with GCC § 23.12.040 General Development Standards in Urban Growth Areas. d) The location width and nature of "proposed utility easements" located along property lines shall be identified as a "note" and not drawn; except in those cases where a USBR and/or an irrigation district easements exist along property lines, the utility easements shall run parallel and abutting said easements. e) This Block of information shall be added to the face of the plat. Zoning: UR2 Max Residential Density: 1 DU/.2.5 Acres Overall Acreage: 2.93 Number of Lots: 7 Max Potential DU's 11 Roads Dedicated .72 acres IN THE MATTER OF APPROVING A SANDCASTLE ESTATES #4 PRELIMINARY PLAT OF 24.69 ACRES± INTO SEVEN LOTS A note shall be added to the face of the plat stating that all lot owners shall contribute ten (ten) dollars per month per lot to the pelican point association as agreed to by the developer at the July 8, 2003 board of county commissioners meeting. This capital as well as interest earned shall be used exclusively for development and maintenance of the parks within pelican point. FINDINGS OF FACT The Planning Commission considered the following findings of fact in making its decision to forward a recommendation to the Board of County Commissioners: 1. Whether the application of this Chapter would deny all economically viable or beneficial uses of the property, absent a demonstration by the county that the proposed use(s) are prohibited by the laws of nuisance or other pre-existing limits on the property which prohibit such use(s); 2. Whether there are not) other reasonable uses to which the property can be put; 3. Whether the proposed use or development Qs not) an unreasonable threat to the harm sought to be avoided by the application of this Chapter or the public health, safety or welfare on or off the site for which the reasonable use exception is sought; 4. Whether applicant is not) able to derive reasonable use of the property by subdividing the property or adjusting a boundary line thereby creating the un - developable condition after the effective date of this chapter; 5. Whether the use exception being soughtis) the minimum necessary to allow for reasonable uses of the property; 6. Whether such use exception being sought is) consistent with the general purposes of this chapter and other chapters of the GCC and the public interest; Dated this 21 4k day of July, 2003.
