HomeMy WebLinkAboutResolution 03-141-CCBOARD OF COUNTY COMMISSIONERS Grant County, Washington RESOLUTION IN THE MATTER OF APPROVING RESOLUTION No. 03 -011 -CC THE PRELIMINARY PLAT, A SIX (6) LOT SUBDIVISION ON 6.67 ACRES IN THE URBAN Resolution Approving a RESIDENTIAL 3 ZONE OF GRANT COUNTY, Preliminary Plat for LOCATED IN A PORTION OF SECTION 21; TOWNSHIP 19 NORTH; RANGE 28 EAST; John Albrandt WILLAMETTE MERIDIAN, WASHINGTON. WHEREAS, the Board of County Commissioners of Grant County have been advised by the Grant County Planning Commission that an open record public hearing was conducted on July 2, 2003, on the matter to allow a six (6) lot subdivision of approximately 6.67 acres located in a portion of the Section 21, Township 19 North, Range 28 East, Willamette Meridian, Grant County, Washington; and WHEREAS, the Grant Cour ty Planning Commission on July 2, 2003, conducted an open -record public hearing and made a recommendation to the Board of County Commissioners to approve the proposed preliminary plat with ten (10) conditions of approval along with one (1) additional condition of approval added at the public hearing by the Grant County Planning Commission; and WHEREAS, the Grant County Board of Commissioners held a closed record public hearing on September 23, 2003 at 3:30 p.m. in the Commissioners Hearings Room of the Grant County Courthouse in Ephrata, Washington; and WHEREAS, the Board of County Commissioners have made a decision to uphold the recommendation from the Grant County Planning Commission to approve the proposed preliminary plat request; and WHEREAS, the Board of County Commissioners have upheld the findings and conclusions of the Grant County Planning Commission; and WHEREAS, the Albrandt Major Preliminary Plat Application has been processed in accordance with Chapter 25.04 "Permit Application Review Procedures" of the Unified Development Code; and WHEREAS, the Board of County Commissioners, have found that the proposed subdivision is consistent with the Grant County Unified Development Code; and WHEREAS, the Board of County Commissioners have found that the proposed subdivision is consistent with the Grant County Comprehensive Plan; and Page 1 of 4 WHEREAS, the Board of County Commissioners have found that the proposed subdivision underwent SEPA review and a Mitigated Determination of Non -Significance (MDNS) was issued on June 16, 2003; and WHEREAS, the Board of County Commissioners have found that the proposed subdivision underwent Critical Areas review according to Grant County Code Chapter 24.08 and does not appear to lie in any; and WHEREAS, the Board of County Commissioners have found that the proponent has made appropriate provisions for drainage, roads, alleys, utilities, public ways, water supplies, sanitary wastes, parks, playgrounds, fire protection facilities, school sites, and grounds and other public and private facilities and improvements; and NOW, THEREFORE, BE IT RESOLVED THAT the Board of County Commissioners for Grant County, Washington, approve by this Resolution, the Preliminary Long Plat the Albrandt Major Plat, a six (6) lot subdivision of approximately 6.67 acres; and The subject preliminary plat is located in a portion of Section 21; Township 19 North; Range 28 East; Willamette Meridian, Grant County, Washington. (Parcel Number: 17-0776-000) CONDITIONS OF APPROVAL Development shall be in compliance with the Grant County Comprehensive Plan, the Grant County Unified Development Code, and all applicable local, state, and federal regulations, rulings or requirements. Development shall comply with all applicable requirements of the Grant County Fire Marshall, the Grant County Fire Flow guidelines and the Uniform Building Code and Uniform Fire Code. 3. Development shall comply with all conditions imposed by the Grant County Public Works Department including but no limited to: a. Provided a Plat Check fee of $100.00 plus $2.00 per lot for a total of $112.00; b. Provide right of way width along the length of Melody Lane configured for approval by the Grant County Engineer; C. Locate features: permanent buildings, wells watercourses and lakes; and d. Access permit must be obtained before building permits. 4. Developer shall comply with all requirements deemed necessary by the Grant County Health District, the Washington State Department of Health, and the Washington State Page 2 of 4 Department of Ecology, regarding domestic water supply, sewage systems and storm water control and treatment including, but not limited to: site evaluations for septic systems. RCW 90.48.080 Discharge of Polluting Water Prohibited; WAC 173-201, Surface Water Standards; WAC 173-201 A, Ground Water Quality Standards and WAC 246-272, On -Site Sewage Systems. 5. If any Native American Grave site(s) or archaeological/cultural resources (Indian Artifacts) are found all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Department, Colville Confederated Tribes and the Washington State Office of Archaeology and Historic Preservation. 6. Preliminary Long Subdivision approval shall be contingent upon conformance with all applicable land use rules and regulations in effect as of May 26, 2003. Development shall comply with the requirements of the Grant Count Emergency Services Office including but not limited to: a. Establishment of an address for development at this location. 8. The proponent must apply for and be successfully granted a variance to the requirement of having a 20' minimum setback from front property line along the county road Melody Lane for the existing structure on lot #3 and lot #2, pursuant to Grant County Unified Development Code Chapter and 23.12 Table 1. 9. Development shall comply with all requirements of the U.S. Bureau of Reclamation Including but not limited to: a. Addition to the final plat regarding language and signature lines required by the Department of the Interior Bureau of Reclamation and the Quincy Columbia Basin Irrigation District. 10. Pursuant to GCC UDC Ch 23.12.040(e)(1)(C), the Applicant shall work with the City of Moses Lake to develop covenant language regarding the development of future street, curb, sidewalk, gutter, water and sewer infrastructure requirements in favor of the City of Moses Lake. The Covenant shall be recorded and noted on the face of the plat. 11. A notation shall be added to the face of the plat stating that the location of future development shall recognize the potential future lot lines and easements identified on the redevelopment plan.
