Allison. All of the Commissioners were in attendance with the Clerk of the Board. The Commissioners read and approved the minutes of the preceding session as written. The Commissioners approved the request by the Juvenile Probation Department for Joy Huesties to take two days leave without pay on August 30 and 31. Chairman Allison was authorized to sign the Notice of Separation or Work Interruption of Rick J. Bomar of the Juvenile Probation Department. The Commissioners approved the request by the Maintenance Department for the purchase of a Hypertherm 900 Plasma cutter in the amount of $2,200. The Commissioners approved the starting salary of Henry A. Gonzalez of the District Court Department as a Spanish interpreter at the rate of $20.00 per hour on an as -needed basis. The Commissioners approved the starting salary of $2,106 per month for Adriana De La O to fill an open Counselor position at Grant County PARC. The Commissioners approved the starting salary of $2,354 per month for Javier V. Valdez of the Grant County PARC as a Counselor Intern. The Commissioners approved the starting salary of Annette M. Moore Rudnicki of the Grant County Park at $1,967.40 per month, effective August 30, 2001. ` The Commissioners replaced Tim Snead and Deborah Moore as members of the Grant County Reserve Officer Board of Trustees. LeRoy C. Allison and another person to be designated by the Commissioners will now serve as members of the Board. The Commissioners signed a Consulting Agreement with Owen Human Resource Consulting. The Commissioners signed an amendment to the Grant County Operations contract #EM010356 with the Military Department, Emergency Management Division. As of this date the Board by a majority vote does approve for payment those vouchers included in the list filed in the Auditors Office 8/20/01 in the total amount of $885,082.24. A motion was made by Commissioner Snead, seconded by Commissioner Moore that the Public Hearing scheduled for 2:00 p.m. regarding the appeal of the Grant County Planning Department notice of Decision, File No.: 01-3091 regarding the establishment of a temporary diesel powered electric generating facility requested by Justin and Farrah Brown be continued to a time uncertain at the request of Mr. Brown. The motion carried. Chairman Allison was authorized to sign the Interlocal Cooperative Agreement ICA -2002-018 on behalf of the Grant County Juvenile Court with the Office of the Administrator for the Courts regarding CASAs in dependency matters. As there was no further business to come before the Board the session was continued until August 21 . August 21, 2001 The session was continued at 9:00 a.m. with all of the Commissioners in attendance with the Clerk of the Board. The Commissioners met with the Public Works Director regarding Public Works Fuel Management System, upgrading to existing IMS cost accounting system, increase in operational and monthly assignment fees, CPG Meeting, Royal City shop. The Commissioners held a Public Meeting regarding the Murphy Preliminary Plat application. A motion was made by Commissioner Snead, seconded by Commissioner Moore to set the matter for Public Hearing on September 11, 2001 at 2:30 p.m. The motion carried. The Commissioners held a Public Hearing in accordance with Chapter 25.12 of the Grant County Unified Development Code and Chapter II of the Comprehensive Plan to consider proposed amendments to the Grant County Comprehensive Plan submitted in accordance with the criteria listed in Section 2, page 2-10, of said Plan adopted in September 1, 1999, and in accordance with State Law RCW 36.70A, as recommended by the Grant County Planning Commission. The Hearing was opened by Chairman LeRoy Allison. He invited County Planner, Billie Sumrall to speak. Billie reviewed the requested changes to the Comprehensive Plan. After some discussion it was decided to proceed with the items on the list that had been approved by the Planning Commission first. 2000 -3 -Tim Hansen change from Agriculture to Rural Residential. There was no public input. A motion was made by Commissioner Moore, seconded by Commissioner Snead that the Public Comment period be closed. The motion carried. A motion was made by Commissioner Snead, seconded by Commissioner Moore to uphold the Planning Commission recommendation for approval with findings provided by the Planning Department. The motion carried. 2000 -4 -City of Quincy, UGA Boundary change to bring the municipally owned domestic and industrial sewer plant and the City airport within the City Urban Growth Boundary area. Mayor Dick Zimbleman spoke urging approval. A motion was made by Commissioner Moore, seconded by Commissioner Snead that the Public Comment period be closed. The motion carried. The motion carried. 2000-5-Allan.Schrom-6-John Schrom-7-Robert Schrom-Allan Schrom-Change from Open Space Conservation to Agriculture -Robert Schrom spoke urging approval of the action. A motion was made by Commissioner Snead, seconded by Commissioner Moore that the Public Comment period be closed. The motion carried. The motion carried. 2000 -12 -13 -Larry Hall -Change from Urban Residential to Commercial -There was no public comment. The motion carried. 2000 -45 -Grant County Errata Sheets -Correction of inadvertent clerical, non -substantive errors to the Comprehensive Plan. There was no need for a vote. 2000 -46 -Town of Wheeler -Correction of mapping discrepancy to Rural Community -There was no public comment. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. The motion carried. 2000 -47 -Moses Lake UGA-Correction of mapping along Stratford Road -There was no public comment. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. The motion carried. 2000 -48 -Port of Moses Lake -Correction of land use designation, to reflect Port ownership -There was no public comment. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. A motion was made by Commissioner Moore, seconded by Commissioner Snead to uphold the Planning Commission recommendation for approval with findings provided by the Planning Department. The motion carried. 2000 -49 -Moses Lake-Genie/Jones property, correct land use designation of Moses Lake UGA area from Ag to Urban Reserve -Cheryl Volk had a question about the Urban Reserve designation. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. A motion was made by Commissioner Moore, seconded by Commissioner Snead to uphold the Planning Commission recommendation for approval with findings provided by the Planning Department. The motion carried. 2000 -50 -Eastern Washington Growth Management Hearings Board - Amend shall/should language. There was no public comment. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. A motion was made by Commissioner Moore, seconded by Commissioner Snead to uphold the Planning Commission recommendation for approval with findings provided by the Planning Department. The motion carried. 2000 -51 -Grant County -Rural Lands recalculation for Comprehensive Plan amendments and Ephrata UGA-Scott Clark, Grant County Planning Director expOlained this item. It was not an item open to discussion, including a mapping change as required by the Growth Management Hearings Board. Gail Bargman had questions about compliance. 2000 -8 -Larry Laughlin -Request for amendment to the Performance Standards of the Agriculture Zoning District -County Planner Billie Sumrall explained the history of this issue. Mr. Laughlin was not in attendance. There was no public comment. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. A motion was made by Commissioner Moore, seconded by Commissioner Snead to uphold the Planning Commission denial with the recommendation to go through the Uniform Development Code process. The motion carried. 2000 -9 -Nick Tommer-Change from Agriculture to Rural Residential and to identify the area around Naylor Junction as being a RAID -Kirk Sager spoke in opposition to this land being a RAID. Donna Tommer spoke, indicating that the landowner wanted to go back to their first request on this property. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. A motion was made by Commissioner Moore seconded by Commissioner Snead to uphold the Planning commission denial with findings provided by the Planning Department. The motion carried. 2000 -17 -Grant County Housing Authority -Change from Urban Residential to Commercial -John Poling with the Housing Authority spoke in opposition to the denial action. Feels that after 50 years changes are needed. Feels that the proposals they are looking at would be good for the area. Bob Bernd spoke for the Housing Authority also. He indicated if their request was allowed as a conditional use they would be pleased. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. A motion was made by Commissioner Moore, seconded by Commissioner Snead to uphold the Planning Commission denial and promote a conditional use process with findings provided by the Planning Department. The motion carried. 2000 -18 -Grant County Housing Authority -Change from Urban Residential to Commercial -There was no recommendation from the Planning commission, however there was a concern with traffic which was discussed. John Poling spoke in favor of the Housing Authority proposal. Robert Schrom also spoke in favor of the Housing Authority proposal, as did Bob Bernd. The City of Moses Lake was opposed to the Housing Authority proposal. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. A motion was made by Commissioner Moore, seconded by Commissioner Snead to approve as a P.D.A. to Commercial with the stipulation that there was an agreement with the Housing Authority through the P.D.A. The motion carried. A motion was made by Commissioner Moore seconded by Commissioner Snead to continue the hearing until August 22, 2001 at 1:30 p.m. The motion carried. As there was no further business to come before the Board the session was continued until August 22, 2001. August 22, 2001 The session was continued at 9:00 a.m. with all of the Commissioners in attendance with the Clerk of the Board. The Commissioners notified the Accounting Department to implement the 3 percent salary increase for Brett Hill to be retroactive to January 1, 2001. A motion was made by Commissioner Snead, seconded by Commissioner Moore that Resolution Number 2001 -133 -CC relating to the transfer of funds within the 2001 budget of the Law and Justice Fund #121, Department #163 in the amount of $2,200 be passed. The motion carried. The Commissioners continued the Public Hearing on the year 2000 Comprehensive Plan Amendments. 2000 -22 -Astro Enterprises, Carol Jones -Change from Urban Reserve to Commercial -A letter was submitted by Susan R. Miller, also a response from the City of Moses Lake, both letters were in favor of the Planning Commission denial on this property. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. A motion was made by Commissioner Moore, seconded by Commissioner Snead to uphold the denial of the Planning Commission on this property. The motion carried. Commissioner Allison stated that he felt there would be a need for some sort of community public services in this area in the future. 2000 -24 -Ed McLeary, Trout Lodge -Change from Rural Remote to Rural Residential -The Planning Commission felt that a gravel road would have to be updated. Ed McCleary owner asked for Rural Remote 1 and doesn't feel it is remote. Fred Slaugh realtor supported Mr. McCleary's view; he feels that people are looking for the type of development Mr. McCleary is recommending. Commissioner Allison asked Planner Billie Sumrall to clarify whether RR I or RR2 would be appropriate. A motion was made by Commissioner Snead, seconded by Commissioner Moore to close the Public Comment period. The motion carried. A motion was made by Commissioner Snead, seconded by Commissioner Moore to change the designation to Rural Residential 1, with findings to be provided by the Planning Department. The motion carried. 2000 -25 -McLeary Family, Limited Partnership -From Open Space to Recreation Development -This property is located on Park Lake. Mr. McLeary explained that the property is buildable and not remote. It has highway, fire protection, school bus, and garbage pickup, he feels it should be developed; it has 3 wells on the property. Fred Slough spoke in agreement with Mr. McLeary. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. Planning Staff stated that Rural Residential 1 and 2 would work on this property. A motion was made by Commissioner Snead, seconded by Commissioner Moore to approve with the Rural Residential 2 designation with Planning to provide findings. The motion carried. 2000 -29 -Michael Stutzman-change from Rural Remote to Rural Residential 11 -In reviewing this matter it was discovered that there was a mapping discrepancy. A motion was made by Commissioner Moore, seconded by Commissioner Snead to table the matter for clarification with public comment to remain open. The motion carried. 2000 -30 -Fred Slough -change from Rural Residential to Commercial or Industrial -There was no recommendation from the Planning Commission on this property. Fred Slough explained that this property had access on to highway 17 and another County road. It is not agricultural land, and fits with the County desire to protect agricultural land. There was no opposition from either the City of Moses Lake, or the City of Ephrata. He feels it is within the law and should be zoned to Commercial or Industrial. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. A motion was made by Commissioner Snead, seconded by Commissioner Moore to approve to Commercial or Industrial with Planning staff to provide findings. Commissioner Snead is in favor; Commissioner Moore feels this is not a place for Commercial or Industrial development. Commissioner Allison felt that if an error was made he would rather it be on the developers' side, and they can justify the proposal. Mr. Slough would like the 5 acres near the crossroads to be zoned Commercial and the rest of the area to Light Industrial. There was a motion to amend the motion by Commissioners Snead, to change to Rural Commercial on the 5 acres nearest the intersection and the balance to be zoned Industrial with the proponent providing a map and Planning Staff to write up findings. Second by Commissioner Allison. The motion carried. Commissioner Moore opposed. 2000 -35 -Wayne Mayhugh-Change from Agriculture to Rural Residential -Wayne Mayhugh requested that this property be changed from Agriculture to rural Remote. The Planning Commission denied, felt it should remain in Agricultural zone. Mr. Moritz spoke in favor of the property remaining in Agricultural zone; he has property in the vicinity and farms the property. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. A motion was made by Commissioner Moore, seconded by Commissioner Snead to uphold the Planning Commission denial of the change. The motion carried. 2000 -36 -Ethel Mae Hesseltine Estate -Change from Agriculture to Rural Residential -This request was denied by the Planning Commission. Stan Hansen stated that the area was in a flood plan and he has seen much of the property flooded in the spring. He also stated that there were burrowing owls, and long bill curlews in the area, and that this was a fragile Shrub Steppe environment. He was in support of'denial of the requested change. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. A motion was made by Commissioner Moore, seconded by Commissioner Snead to uphold the Planning Commission denial of the change. The motion carried. 2000 -37 -Paul Lauzier Estate -change from Agriculture to Rural Residential -The Planning commission had no recommendation on this request. A motion was made by Commissioner Moore, seconded by Commissioner Snead to close the Public Comment period. The motion carried. A motion was made by Commissioner Moore, seconded by Commissioner Snead to deny the requested change with findings to be provided by the Planning Department. The motion carried. A motion was made by Commissioner Moore, seconded by Commissioner Snead to incorporate the proposed changes and findings into the Comprehensive Plan. The motion carried. This matter was continued until August 28, 2001 at 3:30 p.m. to make a decision on 2000 -29 -Michael Stutzman request. As there was no further business to come before the Board the session was adjourned until August 27, 2001.
