RESOLUTION IN THE MATTER OF RESOLUTION No. 26- 01( -CC
AMENDING THE HEADER OF TITLE 6
OF THE GRANT COUNTY CODE TO
ALIGN WITH CURRENT LAW
WHEREAS, the Board of county Commissioners is codifying an ordinance relating to the
purchase and sale of "kratom" in unincorporated Grant County; and,
WHEREAS, this Ordinance is most appropriately located in Title 6 of the County Code which
regulates Peace and Safety; and,
WHEREAS, the current header reads "Peace, Safety and Morals"; and,
WHEREAS, the government is prohibited from passing legislation on morality grounds alone, or
from mandating its own moral code, E.g., Lawrence v. Texas, 539 U.S. 558, 123 S.Ct. 2472 (2003); and,
WHEREAS, the Board of County Commissioners is vested with the authority to legislate as
dictated by RCW 36.32.120; and,
WHEREAS, the Board of County Commissioners seeks to clarify that any legislation within
Title 6 has not been enacted on the basis of morality, but rather the authority of RCW 36.32.120.
NOW, THEREFORE, BE IT HEREBY RESOLVED, that the Board of County
Commissioners of Grant County, State of Washington, AMENDS the header of Title 6:
