I am emailing you today about my concern around the public hearing for vacating Viewmont DR of Dune Lakes Final PUD Plat, AFN 1 05 3; in section 03 of Township 18 North, Range 28 EWM, all in Grant County, Washington. believe that closing that portion of the road between the Dune Lakes and Pelican Point neighborhood will negatively impact the community. Not only do people use the road for pedestrian access, but it is also an important safety feature between the neighborhoods. By eliminating the access road, Dune Lakes becomes an enclosed cul-de-sac with a single road for egress. This is dangerous because if there were to be a fire or other emergency, that road would be unusable for residents leaving and/or emergency personnel entering. Fire danger is a serious issue in our area with high temperatures, gusty winds, and dry vegetation being a defining characteristic of summer in Eastern Washington. The extra point of access to the neighborhood could save lives and people's homes if a fire were to start in or around the community. If you close the road, it will only benefit the few Dune Lakes residents that wish to close it. It will be a detriment to everyone else in the Pelican Point and Dune Lakes communities who use the road and a safety hazard. Presently, the gate area on the Pelican Point side has been used for a parking area for cars, trucks, boats and RVs. Not only does this block the gate in case of an emergency but it also creates a section that is used Like a cul-de-sac (which it is not), I would like to see the gate taken down so this area will be free of vehicles. We live at 514 Viewmont, a couple houses away from the gate and have observed the use of this area for walkers and bikers. Usually, they have to negotiate around these vehicles to get access through the gate. In an area where people are outdoors getting exercise this is a location that is used quite often. We have enjoyed the distraction from traffic coming through in the past but acknowledge the concern of a permanent gate that does not allow pedestrian traffic and would like to vote against that. Under RCW 36.87.060, a public road cannot be vacated if it remains useful. to the county road system. Testimony from those in opposition and from the applicants themselves repeatedly proves this street is actively used by pedestrians, cyclists, and families moving between Pelican Point and Dune Lakes. Claiming vehicles do not drive on Viewmont is a weak argument the only reason cars do not use it today is the physical gate blocking it. Furthermore, subjective claims of "we want this" or "we were promised this" fail to meet the legal standards required to vacate a public thoroughfare when it's clearly in use by the public. The argument that the gate has stood for 20 years without issue completely ignores two decades of explosive growth. Assuming 2 cars per home and 2 trips per car per day (4 daily trips per household): • 2007: Pelican Point (-200 homes to the north) and Dune Lakes (35 homes) totaled 235 homes. • Present: Pelican Point doubled to —400 homes as its southern half filled in, while Dune Lakes grew to —110 homes, totaling —510 homes today. • Future: The addition of —150 planned homes from The Farms at Dune Lakes will bring the total area count to —662 homes. Vehicle traffic has surged from 1,080 daily trips (540 cars across 235 homes) in 2007 to 2,048 daily trips (1,024 cars across 512 homes) today. Adding The Farms at Dune Lakes will push traffic past 2,648 daily trips (adding 300 cars and 600 daily trips). This is a 2.5x increase in the number of homes and car trips on Dune Lakes Road. Respectfully, I urge the Commissioners to consider the needs of the Pelican Point neighborhood in this matter. We urgently need improved ingress and egress to accommodate this explosive growth. Relying on limited exits creates severe bottlenecks and catastrophic risk during emergency evacuations like wildland fires or improving emergency service access. What if the recent Dune Lake homeowners fire had grown out of control and there was only one way out? This would be a different conversation. Giving the county road to 3 applicants and leaving the gate in place forces pedestrians onto Dune Lakes Road which completely lacks streetlights, shoulders, and adequate space, while actively placing walking children and adults in harm's way, increasing the likelihood of a pedestrian -vehicle collision. Meanwhile, adjacent property owners continue to treat this public right-of-way as a private RV parking lot. Furthermore, Secretary of State records reveal clear conflict of interest: an adjacent homeowning applicant has a family member sitting on the Dune Lakes HOA board. Leveraging HOA authority to privatize public infrastructure for illegitimate applicants who are simultaneously generating hundreds of new traffic trips via "The Farms" development is unacceptable self -dealing. The HOA is not a majority frontage owner that the RCW describes. Both the Fire Marshal and Public Works formally recommend removing the gate during the 2nd or 3rd hearing. Lastly, giving this road to 3 families directly contradicts the Board's clear commitment to countywide public safety which is seen in recent initiatives like the SS4A Safer Streets and Roads for All Plan and the Potato Hill Road speed reduction. Public streets belong to the entire community, not a handful of adjacent property owners. I am concerned that this matter has now reached a third round of discussion, despite the significant public safety and community concerns that remain unresolved. In addition to the points I have previously raised, I ask that the following considerations be included in the record. • Accessibility: Closing this access point would significantly reduce safe access for individuals with disabilities and those with limited mobility. The route is used daily by pedestrians, cyclists, and residents, and with an assisted living facility planned nearby, the need for a safe and accessible connection will only increase. There is no comparable alternative route that provides the same level of safety. • Emergency Access: I must again emphasize the dangers associated with limiting the neighborhood to a single point of ingress and egress. In the event of a wildfire, medical emergency, traffic collision, or other incident that blocks the only entrance, emergency response times could be delayed. Those delays have the potential to increase property damage, injuries, and even the loss of life. • Established Public Use: While I am not an attorney, I believe the long-standing public use of this access may warrant consideration under Washington's prescriptive easement laws. At a minimum, the history of public access deserves careful legal review before any action is taken. • Reasonable Expectations of Property Owners: The petitioners purchased their homes with full knowledge of the existing gate and public access. Likewise, many other homeowners chose to purchase in this neighborhood because of the connectivity, accessibility, and safe environment it provides. Those residents also have reasonable expectations that should be considered. Neighborhoods naturally include pedestrians, cyclists, children playing, pets, and homes in close proximity. Individuals seeking complete privacy generally choose larger rural properties rather than residential neighborhoods. Our community continues to grow, with more than 100 new homes planned in the area. Restricting access at a time of significant growth is contrary to so -Lind planning and public safety. While concerns regarding the gate may have existed decades ago, I have not seen documentation supporting the current proposal, and community needs have evolved considerably since then. Rather than vacating this access, I believe the community would be better served by opening it. Doing so would improve emergency response, traffic circulation, pedestrian safety, and overall neighborhood connectivity. We have already experienced fires within Dune Lake, including one over the Fourth of July weekend. It is not difficult to imagine a future scenario where additional homes are occupied, families are celebrating a holiday, and emergency responders are delayed because there is only one way into the neighborhood. Opening the access would also provide practical benefits for road maintenance, school bus operations, garbage collection, and everyday travel. I see numerous advantages to maintaining and improving this connection, but I struggle to identify any meaningful benefit to the broader community from closing it. I respectfully ask that the decision be made based on what best serves the safety, accessibility, and long-term interests of the entire community not solely the preferences of a small number of adjacent property owners. T The Board of County Commissioners of Grant County Washington has received a petition to vacate portions of right-of-way being a portion of Viewmont Drive lying in Section 3, Township 18 N, Range 28 East W.M., all in Grant County, Washington, as shown on the attached Exhibit A. I cannot find a record of permit for a gate to exist across this fire apparatus access road. would also oppose the vacation of this section of road as it would further limit access, by reducing access points of emergency services to a large number of residences in that area. The ability for emergency services to move through a community is paramount to public safety. The gate is already a hinderance to emergency response, possibly delaying lifesaving care or emergency law enforcement response to a critical incident, completely vacating the street would be severely detrimental. would further recommend the gate be removed as it appears to have been placed without proper review or permit. Unless the Dune Lake community has unanimously decided to gate the whole HOA area, then that gate serves no purpose other than, to create a roadblock. By opening the gate: • Emergency Vehicles would have multiple access points to the area • School bus routes could be revised and more efficient • Residents would have another way out in case of fire or other emergency(we are in a hot, heavy sage brush area) Many factors are coming into play in the area. New housing is being develop along Dune Lakes with currently one way into the area. One incident on the road, can block anyone from getting home, or getting out. By removing the gate, that will help reduce the risk. Other concern is the cost of the road. Taxpayers paid for it, its not like some gravel, not improved road, it is clearly paved. Are we going to be paid for the work that went into that road? What utilities run through it? If repair is needed is permission going to be needed to access the area? I would like to petition that the gate be removed and the road actually be opened up. They are building new homes on Dune Lake that will not have a way to exit without u-turning or going around the entire Dune Lake area. 49065 is being developed. It makes sense to open the gate so Castlewood could become an exit point. Walkers, cyclist also use that gated area as a path, as it is safer to do so. Under RCW 36.87.060, a road may only be vacated if it is found "useless as part of the county road system" and if the "public will be benefited." This petition fails both tests for the following reasons: 1. (2) As an alternative, the county legislative authority may appoint a hearing officer to conduct a public hearing to consider -the report of the engineer and to take testimony and evidence relating to the proposed vacation. Following the hearing, the hearing officer shall prepare a record of the proceedings and a recommendation to the county legislative authority concerning the proposed vacation. [1969 ex.s. c 185 s 5.] RCW 36.87.120 Appraised value as basis for compensation Appraisal costs. Any ordinance adopted pursuant to this chapter may require that compensation for the vacation of county roads within particular classes -shall equal all or a percentage of the appraised value of the vacated road as of the effective date of the vacation. Costs of county appraisals of roads pursuant to such ordinances shall be deemed expenses incurred in vacation proceedings, and shall be paid in the manner provided by RCW 36.87.070. The term "public utility" as used in this section shall include utilities owned, operated, or maintained by every gas company, electrical company, telephone company, telegraph company, and water company whether or not such company is privately owned or owned by a governmental entity.
