I. INTRODUCTION,
Grant County has utilized a Land Use Hearing Examiner for many years. I have
been serving as the Grant County Land Use Hearing Examiner since December, 2004.
My current contract with Grant County automatically renews every two years, but is
subject to termination at any time,,
The Grant County Code requires the Hearing Examiner to report, in writing, to the
Board of Commissioners at least once per year, The purpose of this report is to review the
administration of the County's land use policies and regulating resolutions, as well as
reporting on the number and type of decisions rendered since the prior report.
This report is on all actions from January 1, 2025, through December, 2025.

uses. The project shall be served by an on -site septic system and potable water by the Port
of Royal Slope. The parent parcel is in the Urban Light Industrial (ULI) zoning district and

0399 & SEPA - P 24-0400. A Conditional Use Permit proposing the construction of a 3.5-
million-gallon standpipe reservoir (Reservoir No. 10) with an approximate overflow height
of 140 feet, a 65-foot diameter, and a structure footprint of approximately 1.9,500 square
feet. A pump house building (approximately 470 sf) is also proposed for the new reservoir.
Reservoir No. 10 is intended to provide water storage in the City's Moses Pointe Pressure
Zone, which is currently a closed zone. The improvement site will be accessed by a
municipal easement through Melby Way NE. The project is proposed on a parcel located
within the Urban Residential 2 zoning district. The site address of the proposal is 4731
Road F NE, Moses Lake, WA. The subject parcel is a portion of the northwest quarter of
Section 07, Township 19N, Range 28E, W.M., Grant County, WA. (Parcel # 17-0176-

P 24-0372 Riverstone Land Holdings CUP. This project was a Conditional Use Permit
and SEPA to allow the establishment of a surface mine and extraction operation for sand,
gravel, and rock within an approximate 75-acre parcel. Approximately 5,445,000 cubic

approximately 2.5 miles north of Mattawa. Located in the SW quadrant of Section 22,
Township 15 North, Range 22 East, W.M. Grant County, WA. Parcel 4 15-0176-001. The
applicant was Riverstone Land Holdings, LLC; 22132 Rd T.7 SW; Mattawa, WA 99349.

cubic yards of material have been introduced. Wetlands are present in the prej ect area with
habitat assessments and wetland delineations with proposed mitigation measures to be

P 24-0168 Basin Septic Services. Conditional Use Permit and SEPA Checklist for the
expansion of an established 86-acre Septage Material Land Application and Holding
Lagoon Site. The expansion of the site will be 240 acres of existing dryland farming and
partially 'irrigated fields. This proposal is located in the Rural Resource (RRes) Zoning
District of Grant County. Septage materials will be incorporated into farm ground within 6
hours of application. Dryland agricultural growing practices Will be utilized to facilitate
the applied seepage materials. Some of the septage materials will be ,stored seasonally in a
previously established surface lagoons until conditions permit application to land areas.

parcels are located approximately 11 miles northeast of Moses Lake, WA, near the

P 25-0199 Coty O'Neel CUP. This is an application for a Conditional Use Permit for the
operation of a mini -storage facility and an accessory outdoor storage yard for storage of
vehicles, boats, and RVs on an I I -acre site at the 'intersection of White Trail Road (Rd 5
NW) and Hwy 281 N. The project is split into two phases and Will include a total of 24
buildings, one of which is an existing shop and attached residence. The existing residence
will become a Caretaker's residence. All other existing structures Will be removed, and 23
new storage buildings Will be constructed. Total square footage of proposed storage is
approximately 130,000 sq. ft. consisting of 622 storage units and approximately 170
outdoor surface parking spaces. The proposed development includes grading of
approximately 20,000 cy of cut and 20,000 cy of fill to balance all the soil that is currently
on -site including the earthen berm for which a separate grading permit is required. No
export or import of soil is anticipated. The site address of proposed storage facility is
16918 Rd 5 NW (parcel 15-1084-000), within aLAMIRD — Rural Community (RC)
zoning district in the SW comer of Section 05, Township 19 N, Range 24 E, Grant County,
WA. The applicant was Coty O'Neel, 4745 Highway 281 N, WA 98848. The contact

P 25-0201 Capstone Realty. This is an application for a Conditional, Use Permit and
SEPA environmental review are proposed for a surface mining operation involving gravel
extraction and crushed aggregate production on approximately 40 acres within a 620-acre
parcel. The project anticipates extracting about 2.5 million cubic yards of material over a
25-year period. Excavated materials will be crushed and screened onsite to produce
construction -grade aggregate for both commercial sale and construction use. The

98848. The site is located on Overen Road NW, % of a mile south from the intersection of
Baird Springs Rd NW(47' 18' 13.2 "N 119'52'42.6 "W) and is all of Section 24, Township
21, Range 23, E.W.M,, Grant County, WA (Parcel(s) #15-0709-000 & 15- 0708-000). After
an open record public hearing and review of the file, this CUP was approved subject to
eight conditions of approval with subparts.
P 24-0394 Dry Fall Energy Center. The Dry Falls Energy Center project is a 400-
megawatt (MW) solar photovoltaic (Pv) energy generation facility coupled to a 200 MW
AC battery energy storage system (BES S). The project lease boundary spans 2,515 acres of
33 privately owned land. The project area will be bordered by a chain -link security fence.
The proposed project point of interconnect (P01) is one of three existing Bonneville Power
Administration (BPA) transmission lines that bisect the site: Grand Coulee to Hanford
500-kilovolt (W), Potholes to Grand Coulee 230-kV, or Rocky Ford to Grand Coulee 230-

by a Class A water system. Each lot will be served by an individual on -site septic system.

P 24-0225 Sagecliffe Subdivision. This is a preliminary Subdivision application to create
25 parcels for use as individual residential hospitality units from one current tax parcel.
The project is a portion of existing- Tract B of the Columbia River reserve Phase I Planned
Unit Development. The site currently contains 25 recreational yurt structures that will be
removed. This location is an additional phase to the Cave B area development. Water will
be supplied through the Familigia Water District LLC, Cave B Winery Water System. This
location has a community septic system adjacently located. The proposed residential
hospitality unit parcels will be approximately 4800 square feet in size. A Mitigated
Determination of non -significance issued by Grant County for the Columbia River

adopted this document as being appropriate for this proposal after a review and has

Rd. NW, Quincey., WA, 98848. After an open record public hearing and review of the
entire file this subdivision was approved subject to eight conditions of approval with

P 24-0388 Molitor Sun Bason Major Plat. The proponents are Dan & Jada Molitor; 559

111. CONCLUSION
I have been serving as the fall time Hearing Examiner for Grant County since 2005.
Throughout this year I have never been requested to remove myself as a Hearing .
Examiner, nor have been required to remove myself as a Hearing Examiner due to any
conflict of interest/appearance of fairness issues.
Hearings have been held and evidence gathered in an orderly fashion. Written
decisions have been rendered on a timely basis. While I do not know whether any of my
decisions from this year have been appealed, I do know that none of my decisions have
been returned to me from any higher court.
I would invite each of you to attend a hearing. You will find that I consider it an
important part of my duty to allow all members of the public to present the evidence and
testimony they -wish to be included into the record, so long as it is consistent with the laws
as set forth in this state.

Yakima. I also serve as Hearing Examiner for Chelan -Douglas Health District.
I would like to commend Jim Anderson -Cook, and the entire Grant County
Planning Department and staff for their professionalism in the preparation and presentation
of their staff reports and their conduct at hearings. Their neir diligence and hard work make my
job easier as they present the application materials and preliminary evidence in a succinct
and easily comprehensible format. It allows me to do my job on a more efficient basis
which saves the County money. They are always prepared and always professional at
hearings. In short, you have a Planning Department of which the entire County can be
