RESOLUTION OF THE CASCADE VALLEY WATER DISTRICT j
INDEMNIFYING THE ELECTED OR APPOINTED OFFICIALS,
EMPLOYEES AND VOLUNTEERS OF THE WATER DISTRICT
AS PROVIDED BY RCW 36.16.138
RECITALS:
1. The Cascade Valley Water District may elect to indemnify the elected or
appointed officials, employees and volunteers of the Cascade Valley Water
District;
2. Authority for this action is contained in RCW 36.16.138.
IT IS RESOLVED:
1. The Cascade Valley Water District does hereby indemnify and hold personally
harmless all of its elected and appointed officials, employees, volunteers, and
agents for any actions, claim or proceeding instituted against said individual
arising out of the performance, purported performance, or failure of performance
while acting within the scope of their employment and in good faith of the duties
for or the employment with the Cascade Valley Water District. The Cascade
Valley Water District holds said individuals harmless from any expenses
connected with the defense, settlement, or monetary judgments from such
actions, claims or proceedings. The purchase of insurance for this purpose for
said individual shall not be considered compensation for them.
2. The Water District Attorney is authorized to execute all documents necessary to
accomplish the purposes and intent of this Resolution.
3. The Water District's insurer's determination as to whether the elected or
appointed official, employee, volunteer or agent was acting with the scope of their
employment and in good faith of their duties with the Water District shall
determine the Water District's obligation to indemnify and hold harmless under
this agreement.
ADOPTED BY THE BOARD OF COMMISSIONERS OF CASCADE VALLEY
WATER DISTRICT, THIS 30h DAY OF December 2024.
