SPECIAL DEPUTY PROSECUTVINTG ATTORiNEY
COMES NOW Brandon K. Guernsey, the Prosecuting Attorney for Grant County,
Washington, and pursuant to the authority of RCW 36.27.040, hereby appoints John W. Bany of
Baker Stroh i Cowden and Rice LLC, of Seattle, Washington, to serve as a Special Deputy
Prosecuting Attorney pursuant to the terms below-,

The Prosecuting Attorney appoints a SPECIAL DEPUTY PROSECUT11ING ATTORNEY
(S.D.) to perfonn and render legal, assistance., advice, and litigation. if necessary. The

representation is limited to the cases directly assigned by the Grant County Prosecutor's Office
or Grant County's n*sk pool as approvedby the Grant County Prosecutor's Office. Currently,
those cases are: Israel v. Grant Couqy-, 25-2-00282-19; Mooc�v v. Grant County, 2.-25-ev-00022;

Section L SERVICES
The S.D. appointed pursuant to said statute, shall be pn*man'ly responsible for the legal
cases Israel v. Grant County, 25-2-00282-19;1loodiy v. Grant County, 2-,25-cv-00022;
Valdovinos v. Grant Countv 2-.25-ev-00324; and Valdovinos i-s Grant County, 25-2-01523-13.
Specifically, the S.D. shall be pn*rnan*ly responsible for, but not limited to, the following acts:
1. Prepare all legal documents for the proper conduct of proceedings pert ainina to
litigation, enforcement actions and/or administrative hearings, as directed by the
PAO: and

2. Provide such legal guidance and assistance, supervision and consultation, *Including
advice. and provide to COUNTYlecyal opinions regarding,these matters as may be
appropriate, and as directed by the PAO.
,Section 3: COMPENSATION AND STATUS
1. Cases assigned through Grant Counqr's risk pool Will not be billed to Grant County.
2. Case status updates shall be submitted to the Civil Deputy Prosecuting Attorney or
their designee for tracking by COIJNTY. Furth more, the S.D. shall specifically
keep the Grant County Civil Deputy Prosecutor Attorney or their desictnee apprised of

all matters concerning this case, as if the S.D. were in-house counsel for COUNTY.
'Section 4: TERM
This Agreement may be terminated by either party giving written notice thereof The
COUNT TY may provide notice of immediate termination. S.D. shall provide thirty (3 0) days'
notice.
This Agreement shall be in full force and effect through December '3 1. 2026, unless
othemes e terminated or extended by the parties.
Section 5: CONTFLICTS OF INTEREST
Not-kvithstanding, anything to the contraqr contained herein, S.D. shall not and shall haNle
no oblioation to provide legal services under this Agreement, where to do so, would or could
reasonably be construed to rise to a conflict of interest under the Washington Rules of
Professional Conduct (RPC). In any instance in which S.D. is prohibited from providing legal
Services under this Agueement by reason of an actual or potential conflict of interest, S.D. shall
havieno duty or obligation to provide the Prosecuting Attorney for Grant County, Washim ggton.
Grant County,, or any other party or third -party with conflict counsel.
