C"OMES NOW Brandon K. Guemsey, the Prosecuting Attorney for Grant County,
Washington, and pursuant to the authon"ty of RCW 36.27.040, hereby appoints William J. Dow
of Floyd, Pflueger, Kearns, Nedderman & Gress P.S, of Seattle, Washington, to serve as a
Special Deputy Prosecuting Attorney pursuant to the terms below-,

PURPOSE
The prosecut* g Attorney appoints a SPECIAL DEPUTY PROSECUTING ATTORNEY
in I
(S.D.) to perform and render legal assistance, advice, and lifigation, if trecessary. The
representation 'is limited to the cases directly assigned by the GTant County Prosecutor"s Office
or Grant County's risk pool as approved by the Grant County Prosecutor's Office. Currently, that

The S.D. appointed pursuant to said statute, shall be primarily responsible for the legal
case Pinckard v. Grant County, 25-2-00769-11 Specifically, the S.D. shall be primarily
responsible for, but not limited to, the following acts:
1, Prepare all legal documents for the proper conduct of proceedings pertaining to
litigation, enforcement actions and/or adrninl*strafive hearings, as directed by the
PLO; and
2, Provide such legal guidance and assistance, supervision and consultation, including

advice, and provide to COUNTY legal opinions regarding these matters as may be
appropriate.. and as directed by the PLO,

COMPENSATION AND STATUS
1. Cases assigned through Grant County' s fisk pool will not be billed to Grant County.
1 Case status updates shall be submitted to the Civil Deputy Prosecuting Attorney or
their designee for tracking by COU',NITY. Furthermore, the S.D. shall specifically
keep the Grant County Civil Deputy Prosecutor Attorney or the designee apprised of
all matters conceming this case, as if the S.D. were in-house counsel for COUNTY.

notice.

,Section 5*1: CONFLICTS OF INTEREST
Notwithstanding anything to the contrary contained herein, S.D. shall not and shall have
no obligation to provide legal services under this agreement, w-here to do so, would or could
reasonably be construed to rise to a conflict of interest under the Washington Rules, of
Professional Conduct (CPC). In any 'instance in which S.D. is prohibited from pro*v-,i*di'-ng legal
sen!ices under this Agreement by reason of an actual or potential conffiet of interest, S.D. shall
have no duty or obligation to pro -vide the Prosecuting Attorney for Grant County, Washington,
Grant County, or any other party or third -party with conflict counsel.
